Be it enacted by the Senate and House of Representa-1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Why Does the IRS 4 Need Guns Act’’. 5 SEC. 2. DEFINITIONS. 6 For purposes of this Act: 7 VerDate Sep 11 2014 03:44 May 01, 2025 Jkt 059200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H2915.IH H2915 ssavage on LAPJG3WLY3PROD with BILLS 2 •HR 2915 IH (1) AMMUNITION.—The term ‘‘ammunition’’ 1 has the same meaning given such term under section 2 921(a)(17) of title 18, United States Code. 3 (2) C OMMISSIONER.—The term ‘‘Commis-4 sioner’’ means the Commissioner of Internal Rev-5 enue. 6 (3) F IREARM.—The term ‘‘firearm’’ has the 7 same meaning given such term under section 8 921(a)(3) of title 18, United States Code. 9 SEC. 3. PROHIBITION ON USE OF FUNDS. 10 (a) I NGENERAL.—Notwithstanding any other provi-11 sion of law, none of the funds authorized to be appro-12 priated or otherwise made available for any fiscal year 13 may be obligated or expended by the Commissioner to pur-14 chase, receive, or store any firearm or ammunition. 15 (b) E FFECTIVEDATE.—This section shall take effect 16 on the date which is 120 days after the date of enactment 17 of this Act. 18 SEC. 4. TRANSFER OF FIREARMS AND AMMUNITION. 19 Not later than the date which is 120 days after the 20 date of enactment of this Act, the Commissioner shall 21 transfer to the Administrator of General Services— 22 (1) any firearms owned by, or under the control 23 of, the Internal Revenue Service; and 24 VerDate Sep 11 2014 03:44 May 01, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2915.IH H2915 ssavage on LAPJG3WLY3PROD with BILLS 3 •HR 2915 IH (2) any ammunition owned by, or under the 1 control of, the Internal Revenue Service. 2 SEC. 5. SALE OF FIREARMS. 3 (a) I NGENERAL.—Not later than the date which is 4 30 days after the date on which the transfer described 5 in section 4 has been completed, the Administrator of Gen-6 eral Services shall— 7 (1) initiate the sale or auction of any firearms 8 described in paragraph (1) of such section to li-9 censed dealers (as defined in section 921(a)(11) of 10 title 18, United States Code); and 11 (2) initiate the auction of any ammunition de-12 scribed in paragraph (2) of section 4 to members of 13 the general public. 14 (b) P ROCEEDS.—Any proceeds from the sale or auc-15 tion of property described in subsection (a) shall be depos-16 ited in the general fund of the Treasury for the sole pur-17 pose of deficit reduction. 18 SEC. 6. ADMINISTRATION OF CRIMINAL INVESTIGATIONS 19 BY ATTORNEY GENERAL. 20 (a) I NGENERAL.—With respect to the administra-21 tion and enforcement of— 22 (1) any of the criminal provisions of the inter-23 nal revenue laws, 24 VerDate Sep 11 2014 03:44 May 01, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H2915.IH H2915 ssavage on LAPJG3WLY3PROD with BILLS 4 •HR 2915 IH (2) any other criminal provisions of law relating 1 to internal revenue for the enforcement of which the 2 Secretary of the Treasury, as of the date of enact-3 ment of this Act, was responsible, or 4 (3) any other law for which the Secretary of the 5 Treasury, as of the date of enactment of this Act, 6 delegated investigatory authority to the Internal 7 Revenue Service, 8 such administration and enforcement shall be performed 9 by or under the supervision of the Attorney General. 10 (b) P ERFORMANCE OF TRANSFERREDFUNCTIONS.— 11 The Attorney General may make such provisions as the 12 Attorney General determines appropriate to authorize the 13 performance by any officer, employee, or agency of the De-14 partment of Justice of any function transferred to the At-15 torney General under this section. 16 (c) T RANSFER OFAUTHORITIES, FUNCTIONS, PER-17 SONNEL, ANDASSETS TO THE DEPARTMENT OF JUS-18 TICE.—Notwithstanding any other provision of law, there 19 are transferred to the Department of Justice the authori-20 ties, functions, personnel, and assets of the Criminal In-21 vestigation Division of the Internal Revenue Service, 22 which shall be maintained as a distinct entity within the 23 Criminal Division of the Department of Justice, including 24 the related functions of the Secretary of the Treasury. 25 VerDate Sep 11 2014 03:44 May 01, 2025 Jkt 059200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H2915.IH H2915 ssavage on LAPJG3WLY3PROD with BILLS 5 •HR 2915 IH (d) EFFECTIVEDATE.—This section shall take effect 1 on the date which is 90 days after the date of enactment 2 of this Act. 3 Æ VerDate Sep 11 2014 03:44 May 01, 2025 Jkt 059200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6301 E:\BILLS\H2915.IH H2915 ssavage on LAPJG3WLY3PROD with BILLS
