To amend title 23, United States Code, to establish an
axle weight variance for certain commercial motor vehi-
cles transporting dry bulk goods, and for other purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Vehicle Axle Redis-4
tribution Increases Allow New Capacities for Efficiency 5
Act’’ or the ‘‘VARIANCE Act’’. 6
SEC. 2. DRY BULK AXLE WEIGHT VARIANCE. 7
Section 127 of title 23, United States Code, is 8
amended by adding at the end the following: 9

‘‘(z) DRYBULKAXLEWEIGHTVARIANCE.— 1
‘‘(1) W
EIGHT VARIANCE.—Notwithstanding any 2
other provision of this section, except for the max-3
imum gross vehicle weight limitation, a commercial 4
motor vehicle transporting dry bulk goods may not 5
exceed 110 percent of the maximum weight on any 6
axle or axle group described in subsection (a), in-7
cluding any enforcement tolerance. 8
‘‘(2) D
RY BULK GOODS DEFINED .—In this sub-9
section, the term ‘dry bulk goods’ means any homo-10
geneous unmarked, unpackaged, nonliquid cargo 11
being transported in a trailer specifically designed 12
for that purpose.’’. 13
