| 35 | 35 | | purchase or lease a non-tactical passenger vehicle from a 5 |

| 36 | 36 | | non-Federal entity that is not a zero-emission vehicle if 6 |

| 37 | 37 | | the head determines that, with respect to a particular cir-7 |

| 38 | 38 | | cumstance, using a zero-emission vehicle will not be tech-8 |
