1818 SECTION 1. SHORT TITLE. 3
1919 This Act may be cited as the ‘‘Every Drop Counts 4
2020 Act’’. 5
2121 SEC. 2. ELIGIBLE WATER STORAGE PROJECTS. 6
2222 (a) I
2323 NGENERAL.—Subparagraph (B) of section 7
2424 40903(b)(1) of the Infrastructure Investment and Jobs 8
2525 Act (43 U.S.C. 3203(b)(1)(B)) is amended to read as fol-9

3030 ‘‘(B) ELIGIBLE PROJECTS.—The following 1
3131 projects shall be eligible for consideration for a 2
3232 grant under this section: 3
3333 ‘‘(i) G
3434 ENERAL ACRE -FEET CAPAC-4
3535 ITY.—A project that— 5
3636 ‘‘(I) has water storage capacity 6
3737 of not less than 200 acre-feet and not 7
3838 more than 30,000 acre-feet; and 8
3939 ‘‘(II)(aa) increases surface water 9
4040 or groundwater storage; or 10
4141 ‘‘(bb) conveys water, directly or 11
4242 indirectly, to or from surface water or 12
4343 groundwater storage. 13
4444 ‘‘(ii) A
4545 VERAGE ANNUAL PROJECT LIFE 14
4646 ACRE-FEET CAPACITY.—A project that— 15
4747 ‘‘(I) has water storage capacity 16
4848 of recharges not less than 200 acre- 17
4949 feet and not more than 150,000 acre- 18
5050 feet on an average annual basis over 19
5151 the life of the project for storage or 20
5252 use; and 21
5353 ‘‘(II)(aa) increases groundwater 22
5454 aquifer storage; 23

6161 ‘‘(cc) both increases groundwater 4
6262 aquifer storage and conveys water, di-5

6464 water from groundwater storage; and 7
6565 ‘‘(dd) stabilizes groundwater lev-8

6868 UTHORITY.—Section 40903(e) of the Infrastruc-10
6969 ture Investment and Jobs Act (43 U.S.C. 3203(e)) is 11
7070 amended by striking ‘‘5’’ and inserting ‘‘10’’. 12
7171 SEC. 3. STATUTORY CONSTRUCTION. 13
7272 Nothing in the amendment made by section 2 shall 14
7373 be construed— 15
7474 (1) to supersede or in any manner affect or 16
7575 conflict with State water law, Federal water law, 17
7676 interstate compacts, or treaty obligations; 18
7777 (2) to authorize any acquisition of water by the 19
7878 Federal Government; or 20
7979 (3) to supersede or infringe on any water 21
8080 rights. 22
