16	16	To require the head of an agency to issue and sign any
17	17	rule issued by that agency, and for other purposes.
18	18	Be it enacted by the Senate and House of Representa-1
19	19	tives of the United States of America in Congress assembled, 2
20	20	SECTION 1. SHORT TITLE. 3
21	21	This Act may be cited as the ‘‘Ensuring Account-4
22	22	ability in Agency Rulemaking Act’’. 5
23	23	SEC. 2. RULEMAKING REQUIREMENTS. 6

25	25	PPROVALREQUIRED.— 7

27	27	ULES PROMULGATED BY SENATE CON -8
28	28	FIRMED APPOINTEE .—Except as provided in para-9

33	33	of title 5, United States Code, shall be issued and 2
34	34	signed by an individual appointed by the President, 3
35	35	by and with the advice and consent of the Senate. 4

37	37	NITIATION OF RULEMAKING AND REGU -5
38	38	LATORY AGENDA.—Except as provided in paragraph 6
39	39	(3), any rule initiated under section 553 of title 5, 7
40	40	United States Code, shall be initiated by a senior 8
41	41	appointee. 9
42	42	(3) E
43	43	XCEPTION.—Paragraph (1) or (2) does 10
44	44	not apply if the head of an agency— 11
45	45	(A) determines, on a nondelegable basis, 12
46	46	that compliance with the relevant paragraph 13
47	47	would impede public safety or security; 14
48	48	(B) submits to the Administrator a notifi-15
49	49	cation disclosing the reasons for the exemption; 16
50	50	and 17
51	51	(C) publishes such notification, consistent 18
52	52	with public safety, security, and privacy inter-19
53	53	ests, in the Federal Register. 20

55	55	VERSIGHT.— 21
56	56	(1) A
57	57	GENCY COMPLIANCE .—The head of each 22
58	58	agency shall ensure that the issuance of any agency 23
59	59	rule promulgated under section 553 of title 5, 24

64	64	this section. 2

66	66	GUIDANCE AND COMPLIANCE .—The 3
67	67	Administrator shall provide guidance on the imple-4
68	68	mentation of and shall monitor agency compliance 5
69	69	with this section. 6

71	71	ULES OFCONSTRUCTION.—This section may 7
72	72	not be construed to impair or otherwise affect the func-8
73	73	tions of the Director of the Office of Management and 9
74	74	Budget relating to budgetary, administrative, or legislative 10
75	75	proposals. 11

77	77	EFINITIONS.—In this section: 12
78	78	(1) A
79	79	DMINISTRATOR.—The term ‘‘Adminis-13
80	80	trator’’ means the Administrator of the Office of In-14
81	81	formation and Regulatory Affairs (OIRA) in the Of-15
82	82	fice of Management and Budget (OMB). 16
83	83	(2) A
84	84	GENCY.—The term ‘‘agency’’ has the 17
85	85	meaning given that term under section 551 of title 18
86	86	5, United States Code. 19
87	87	(3) R
88	88	ULE.—The term ‘‘rule’’ has the meaning 20
89	89	given that term in section 551 of title 5, United 21
90	90	States Code, and does not include any rule of agency 22
91	91	organization, procedure, or practice that does not 23
92	92	substantially affect the rights or obligations of non- 24
93	93	agency parties. 25

97	97	(4) SENIOR APPOINTEE.—The term ‘‘senior ap-1
98	98	pointee’’ means an individual appointed by the 2
99	99	President, or performing the functions and duties of 3
100	100	an office that requires appointment by the Presi-4
101	101	dent, or a non-career member of the Senior Execu-5
102	102	tive Service (or equivalent agency system). 6
