A BILL
To amend title III of the Public Health Service Act to
include rural emergency hospitals in the definition of
a covered entity for purposes of the 340B drug discount
program.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Rural 340B Access 4
Act of 2025’’. 5

SEC. 2. INCLUDING RURAL EMERGENCY HOSPITALS AS 1
COVERED ENTITIES FOR PURPOSES OF THE 2
340B DRUG DISCOUNT PROGRAM. 3
Section 340B(a)(4) of the Public Health Service Act 4
(42 U.S.C. 256b(a)(4)) is amended by adding at the end 5
the following new subparagraph: 6
‘‘(P) An entity that is a rural emergency 7
hospital (as defined in section 1861(kkk)(2) of 8
the Social Security Act) that is owned or oper-9
ated by a unit of State or local government, is 10
a public or private non-profit corporation which 11
is formally granted governmental powers by a 12
unit of State or local government, or is a pri-13
vate non-profit rural emergency hospital which 14
has a contract with a State or local government 15
to provide health care services to low income in-16
dividuals who are not entitled to benefits under 17
title XVIII of the Social Security Act or eligible 18
for assistance under the State plan under this 19
title.’’. 20
