4242 This Act may be cited as the ‘‘Firearm Industry Non- 2
4343 Discrimination Act’’ or the ‘‘FIND Act’’. 3
4444 SEC. 2. PROHIBITION ON ENTERING INTO CONTRACTS 4
4545 WITH ENTITIES DISCRIMINATING AGAINST 5
4646 THE FIREARM AND AMMUNITION INDUSTRY. 6

4848 ROHIBITION.—Chapter 47 of title 41, United 7
4949 States Code, is amended by adding at the end the fol-8
5050 lowing: 9
5151 ‘‘§ 4715. Prohibition on entering into contracts with 10
5252 entities discriminating against the fire-11
5353 arm and ammunition industry. 12
5454 ‘‘(a) P
5555 ROHIBITION.— 13
5656 ‘‘(1) I
5757 N GENERAL.—The head of an executive 14
5858 agency shall include in each contract for the pro-15
5959 curement of goods or services awarded by the execu-16
6060 tive agency, a clause requiring the prime contractor 17
6161 to certify that the contractor— 18
6262 ‘‘(A) has no policy, practice, guidance, or 19
6363 directive that discriminates against a firearm 20
6464 entity or firearm trade association; and 21
6565 ‘‘(B) will not adopt a policy, practice, guid-22
6666 ance, or directive that discriminates against a 23
6767 firearm entity or firearm trade association dur-24
6868 ing the term of the contract. 25

7272 ‘‘(2) SUBCONTRACTS.—The head of an execu-1
7373 tive agency shall include in each contract for the 2
7474 procurement of goods or services awarded by the ex-3
7575 ecutive agency, a clause that prohibits the prime 4
7676 contractor on such contract from— 5
7777 ‘‘(A) awarding a first-tier subcontract with 6
7878 a value greater than 10 percent of the total 7
7979 value of the prime contract to an entity that 8
8080 fails to certify in writing to the prime con-9
8181 tractor that the entity— 10
8282 ‘‘(i) has no policy, practice, guidance, 11
8383 or directive that discriminates against a 12
8484 firearm entity or firearm trade association; 13
8585 and 14
8686 ‘‘(ii) will not adopt a policy, practice, 15
8787 guidance, or directive that discriminates 16
8888 against a firearm entity or firearm trade 17
8989 association during the term of the con-18
9090 tract; and 19
9191 ‘‘(B) structuring subcontract tiers in a 20
9292 manner designed to avoid violating subpara-21
9393 graph (A) by enabling a subcontractor to per-22
9494 form more than 10 percent of the total value of 23
9595 the prime contract as a lower-tier subcon-24
9696 tractor. 25

100100 ‘‘(3) PENALTIES.—The clause included in con-1
101101 tracts pursuant to paragraph (1) or paragraph (2) 2
102102 shall provide that, in the event that the prime con-3
103103 tractor violates the clause— 4
104104 ‘‘(A) the prime contract shall be termi-5
105105 nated for default; and 6
106106 ‘‘(B) a suspension or debarment pro-7
107107 ceeding will be initiated for the contractor on 8
108108 the basis of the violation. 9
109109 ‘‘(b) E
110110 XCEPTION.—Subsection (a) shall not apply to 10
111111 a contract for the procurement of goods or services that 11
112112 is a sole-source contract. 12
113113 ‘‘(c) D
114114 EFINITIONS.—In this section: 13
115115 ‘‘(1) D
116116 ISCRIMINATE.—The term ‘discriminate’ 14
117117 means to— 15
118118 ‘‘(A) make a judgement about a policy, 16
119119 practice, guidance, or directive on the basis 17
120120 of— 18
121121 ‘‘(i) partial criteria or a category- 19
122122 based assessment analysis, rather than— 20
123123 ‘‘(I) on a case-by-case basis; or 21
124124 ‘‘(II) using empirical data evalu-22
125125 ated under quantifiable standards; or 23
126126 ‘‘(ii) criteria other than criteria free 24
127127 from— 25

132132 against or dislike for the firearm enti-2
133133 ty or trade association or the products 3
134134 or services sold by the firearm entity 4
135135 or trade association; or 5
136136 ‘‘(II) favoritism for market alter-6
137137 natives to the business of the firearm 7
138138 entity or the trade association; 8
139139 ‘‘(B) refuse to provide services, or deny, 9
140140 cancel, or limit services, to the firearm entity or 10
141141 trade association on the basis of criteria other 11
142142 than— 12
143143 ‘‘(i) criteria free from— 13
144144 ‘‘(I) favoritism or prejudice 14
145145 against or dislike for the firearm enti-15
146146 ty or trade association or the products 16
147147 or services sold by the firearm entity 17
148148 or trade association; or 18
149149 ‘‘(II) favoritism for market alter-19
150150 natives to the business of the firearm 20
151151 entity or the trade association; 21
152152 ‘‘(ii) criteria related to credit history 22
153153 and financial risk specific to a customer or 23
154154 potential customer; or 24

159159 with Federal, State, or local law; or 2
160160 ‘‘(C) limit the operations of the firearm en-3
161161 tity or trade association in manner not required 4
162162 by— 5
163163 ‘‘(i) Federal, State, or local law; or 6
164164 ‘‘(ii) Federal, State, or local regula-7
165165 tion. 8
166166 ‘‘(2) F
167167 IREARM ENTITY.—The term ‘firearm en-9
168168 tity’ means any— 10
169169 ‘‘(A) person who is licensed under section 11
170170 923 of title 18 to import, manufacture, or deal 12
171171 in firearms; 13
172172 ‘‘(B) seller of ammunition, as defined in 14
173173 section 7903 of title 15; 15
174174 ‘‘(C) manufacturer or importer of, or deal-16
175175 er in, a secure gun storage or safety device, as 17
176176 defined in section 921(a) of title 18; and 18
177177 ‘‘(D) manufacturer or importer of, or deal-19
178178 er in, a component part or accessory of a fire-20
179179 arm or ammunition. 21

181181 IREARM TRADE ASSOCIATION .—The term 22
182182 ‘firearm trade association’ has the meaning in sec-23
183183 tion 7903 of title 15. 24

187187 ‘‘(4) FIRST-TIER SUBCONTRACT .—The term 1
188188 ‘first-tier subcontract’ means a subcontract entered 2
189189 into by a subcontractor with the prime contractor 3
190190 for the purposes of carrying out the prime contract. 4

192192 OWER-TIER SUBCONTRACTOR .—The term 5
193193 ‘lower-tier subcontractor’ means any person entering 6
194194 into a contract with a subcontractor of a prime con-7
195195 tractor for the purposes of carrying out the prime 8
196196 contract. 9
197197 ‘‘(6) P
198198 RIME CONTRACT; PRIME CONTRACTOR .— 10
199199 The terms ‘prime contract’ and ‘prime contractor’ 11
200200 have the meaning given those terms in section 8701 12
201201 of title 41.’’. 13

203203 PPLICATION.—Section 4715 of title 41, United 14
204204 States Code, as added by subsection (a), shall apply with 15
205205 respect to contracts awarded on or after the date of the 16
206206 enactment of this Act. 17
207207 (c) C
208208 LERICALAMENDMENT.—The table of sections 18
209209 for chapter 47 of title 41, United States Code, is amended 19
210210 by adding at the end the following: 20
211211 ‘‘4715. Prohibition on entering into contracts with entities discriminating
212212 against the firearm and ammunition industry.’’.
