32	32	To amend title 41, United States Code, to prohibit the Fed-
33	33	eral Government from entering into contracts with an
34	34	entity that discriminates against the firearm and ammu-
35	35	nition industry, and for other purposes.
36	36	Be it enacted by the Senate and House of Representa-1
37	37	tives of the United States of America in Congress assembled, 2

41	41	SECTION 1. SHORT TITLE. 1
42	42	This Act may be cited as the ‘‘Firearm Industry Non- 2
43	43	Discrimination Act’’ or the ‘‘FIND Act’’. 3
44	44	SEC. 2. PROHIBITION ON ENTERING INTO CONTRACTS 4
45	45	WITH ENTITIES DISCRIMINATING AGAINST 5
46	46	THE FIREARM AND AMMUNITION INDUSTRY. 6
47	47	(a) P
48	48	ROHIBITION.—Chapter 47 of title 41, United 7
49	49	States Code, is amended by adding at the end the fol-8
50	50	lowing: 9
51	51	‘‘§ 4715. Prohibition on entering into contracts with 10
52	52	entities discriminating against the fire-11
53	53	arm and ammunition industry. 12
54	54	‘‘(a) P
55	55	ROHIBITION.— 13
56	56	‘‘(1) I
57	57	N GENERAL.—The head of an executive 14
58	58	agency shall include in each contract for the pro-15
59	59	curement of goods or services awarded by the execu-16
60	60	tive agency, a clause requiring the prime contractor 17
61	61	to certify that the contractor— 18
62	62	‘‘(A) has no policy, practice, guidance, or 19
63	63	directive that discriminates against a firearm 20
64	64	entity or firearm trade association; and 21
65	65	‘‘(B) will not adopt a policy, practice, guid-22
66	66	ance, or directive that discriminates against a 23
67	67	firearm entity or firearm trade association dur-24
68	68	ing the term of the contract. 25

72	72	‘‘(2) SUBCONTRACTS.—The head of an execu-1
73	73	tive agency shall include in each contract for the 2
74	74	procurement of goods or services awarded by the ex-3
75	75	ecutive agency, a clause that prohibits the prime 4
76	76	contractor on such contract from— 5
77	77	‘‘(A) awarding a first-tier subcontract with 6
78	78	a value greater than 10 percent of the total 7
79	79	value of the prime contract to an entity that 8
80	80	fails to certify in writing to the prime con-9
81	81	tractor that the entity— 10
82	82	‘‘(i) has no policy, practice, guidance, 11
83	83	or directive that discriminates against a 12
84	84	firearm entity or firearm trade association; 13
85	85	and 14
86	86	‘‘(ii) will not adopt a policy, practice, 15
87	87	guidance, or directive that discriminates 16
88	88	against a firearm entity or firearm trade 17
89	89	association during the term of the con-18
90	90	tract; and 19
91	91	‘‘(B) structuring subcontract tiers in a 20
92	92	manner designed to avoid violating subpara-21
93	93	graph (A) by enabling a subcontractor to per-22
94	94	form more than 10 percent of the total value of 23
95	95	the prime contract as a lower-tier subcon-24
96	96	tractor. 25

100	100	‘‘(3) PENALTIES.—The clause included in con-1
101	101	tracts pursuant to paragraph (1) or paragraph (2) 2
102	102	shall provide that, in the event that the prime con-3
103	103	tractor violates the clause— 4
104	104	‘‘(A) the prime contract shall be termi-5
105	105	nated for default; and 6
106	106	‘‘(B) a suspension or debarment pro-7
107	107	ceeding will be initiated for the contractor on 8
108	108	the basis of the violation. 9
109	109	‘‘(b) E
110	110	XCEPTION.—Subsection (a) shall not apply to 10
111	111	a contract for the procurement of goods or services that 11
112	112	is a sole-source contract. 12
113	113	‘‘(c) D
114	114	EFINITIONS.—In this section: 13
115	115	‘‘(1) D
116	116	ISCRIMINATE.—The term ‘discriminate’ 14
117	117	means to— 15
118	118	‘‘(A) make a judgement about a policy, 16
119	119	practice, guidance, or directive on the basis 17
120	120	of— 18
121	121	‘‘(i) partial criteria or a category- 19
122	122	based assessment analysis, rather than— 20
123	123	‘‘(I) on a case-by-case basis; or 21
124	124	‘‘(II) using empirical data evalu-22
125	125	ated under quantifiable standards; or 23
126	126	‘‘(ii) criteria other than criteria free 24
127	127	from— 25

132	132	against or dislike for the firearm enti-2
133	133	ty or trade association or the products 3
134	134	or services sold by the firearm entity 4
135	135	or trade association; or 5
136	136	‘‘(II) favoritism for market alter-6
137	137	natives to the business of the firearm 7
138	138	entity or the trade association; 8
139	139	‘‘(B) refuse to provide services, or deny, 9
140	140	cancel, or limit services, to the firearm entity or 10
141	141	trade association on the basis of criteria other 11
142	142	than— 12
143	143	‘‘(i) criteria free from— 13
144	144	‘‘(I) favoritism or prejudice 14
145	145	against or dislike for the firearm enti-15
146	146	ty or trade association or the products 16
147	147	or services sold by the firearm entity 17
148	148	or trade association; or 18
149	149	‘‘(II) favoritism for market alter-19
150	150	natives to the business of the firearm 20
151	151	entity or the trade association; 21
152	152	‘‘(ii) criteria related to credit history 22
153	153	and financial risk specific to a customer or 23
154	154	potential customer; or 24

159	159	with Federal, State, or local law; or 2
160	160	‘‘(C) limit the operations of the firearm en-3
161	161	tity or trade association in manner not required 4
162	162	by— 5
163	163	‘‘(i) Federal, State, or local law; or 6
164	164	‘‘(ii) Federal, State, or local regula-7
165	165	tion. 8
166	166	‘‘(2) F
167	167	IREARM ENTITY.—The term ‘firearm en-9
168	168	tity’ means any— 10
169	169	‘‘(A) person who is licensed under section 11
170	170	923 of title 18 to import, manufacture, or deal 12
171	171	in firearms; 13
172	172	‘‘(B) seller of ammunition, as defined in 14
173	173	section 7903 of title 15; 15
174	174	‘‘(C) manufacturer or importer of, or deal-16
175	175	er in, a secure gun storage or safety device, as 17
176	176	defined in section 921(a) of title 18; and 18
177	177	‘‘(D) manufacturer or importer of, or deal-19
178	178	er in, a component part or accessory of a fire-20
179	179	arm or ammunition. 21

181	181	IREARM TRADE ASSOCIATION .—The term 22
182	182	‘firearm trade association’ has the meaning in sec-23
183	183	tion 7903 of title 15. 24

187	187	‘‘(4) FIRST-TIER SUBCONTRACT .—The term 1
188	188	‘first-tier subcontract’ means a subcontract entered 2
189	189	into by a subcontractor with the prime contractor 3
190	190	for the purposes of carrying out the prime contract. 4

192	192	OWER-TIER SUBCONTRACTOR .—The term 5
193	193	‘lower-tier subcontractor’ means any person entering 6
194	194	into a contract with a subcontractor of a prime con-7
195	195	tractor for the purposes of carrying out the prime 8
196	196	contract. 9
197	197	‘‘(6) P
198	198	RIME CONTRACT; PRIME CONTRACTOR .— 10
199	199	The terms ‘prime contract’ and ‘prime contractor’ 11
200	200	have the meaning given those terms in section 8701 12
201	201	of title 41.’’. 13

203	203	PPLICATION.—Section 4715 of title 41, United 14
204	204	States Code, as added by subsection (a), shall apply with 15
205	205	respect to contracts awarded on or after the date of the 16
206	206	enactment of this Act. 17

208	208	LERICALAMENDMENT.—The table of sections 18
209	209	for chapter 47 of title 41, United States Code, is amended 19
210	210	by adding at the end the following: 20
211	211	‘‘4715. Prohibition on entering into contracts with entities discriminating
212	212	against the firearm and ammunition industry.’’.
