3232 ELAY OFECQM IMPLEMENTATION.—The Sec-2

3535 tion of the requirement for ACOs to transition from re-5
3636 porting quality measures via the Centers for Medicare & 6
3737 Medicare Services Web Interface portal to electronic Clin-7
3838 ical Quality Metrics (eCQMs), as described in the rule ti-8
3939 tled ‘‘Medicare and Medicaid Programs; CY 2025 Pay-9
4040 ment Policies under the Physician Fee Schedule and Other 10
4141 Changes to Part B Payment and Coverage Policies; Medi-11
4242 care Shared Savings Program Requirements; Medicare 12
4343 Prescription Drug Inflation Rebate Program; and Medi-13
4444 care Overpayments’’ (89 Fed. Reg. 97710 (December 9, 14

4949 ETHODS.— 17

5151 N GENERAL.—Not later than January 1, 18
5252 2026, the Secretary shall establish and commence a 19
5353 pilot program to test digital reporting methods for 20
5454 quality measures on a subset of ACOs and ACO par-21
5555 ticipants that submit an application to participate in 22
5656 such pilot program at such time and in such form 23
5757 as the Secretary determines appropriate. 24

5959 EMPORARY EXEMPTION FROM ECQM RE -25
6060 QUIREMENTS.—An ACO or an ACO participant par-26

6868 O EFFECT ON PAYMENT INCENTIVES .— 4
6969 Participation in the pilot program shall have no ef-5
7070 fect on the eligibility of an ACO or an ACO partici-6
7171 pant to qualify for or earn an incentive payment 7
7272 under section 1833(z) of the Social Security Act (42 8
7373 U.S.C. 1395l(z)) or a payment adjustment under 9
7474 section 1848(q) of such Act (42 U.S.C. 1395w– 10
7575 4(q)). 11

7777 ECHNICAL ASSISTANCE .—The Secretary 12
7878 shall provide technical assistance, including waivers 13
7979 from any applicable quality reporting requirements, 14
8080 to ACOs and providers participating in the pilot pro-15
8181 gram to incentivize their participation and to evalu-16
8282 ate the efficacy of digital reporting methods. 17

8484 EPORT.—Not later than January 1, 2028, 18
8585 the Secretary shall submit to Congress a report that 19
8686 includes— 20
8787 (A) the findings and results of the pilot 21
8888 program carried out under paragraph (1); and 22
8989 (B) any recommendations for increasing 23
9090 the adoption by additional ACOs of the digital 24

102102 digital quality reporting metrics and formats. Such 7
103103 standards shall ensure that all EHR systems used 8
104104 by an ACO are capable of supporting digital report-9
105105 ing methods across a diverse range of practice sizes, 10
106106 specialties, and geographic locations. 11

108108 ONSULTATION.—In developing the stand-12
109109 ards described in paragraph (1), the Secretary shall 13
110110 collaborate with relevant stakeholders, including rep-14
111111 resentatives of the National Committee for Quality 15
112112 Assurance, EHR vendors, ACOs, payers, and na-16
113113 tional medical and specialty physician groups. 17

123123 purpose of meeting such requirements until the date 24
124124 on which the Secretary promulgates the standard-25

138138 (1) ACO.—The term ‘‘ACO’’ has the meaning 9
139139 given the term ‘‘accountable care organization’’ in 10
140140 section 425.20 of title 42, Code of Federal Regula-11

143143 PARTICIPANT.—The term ‘‘ACO par-13
144144 ticipant’’ has the meaning given such term in section 14
145145 425.20 of title 42, Code of Federal Regulations. 15
146146 (3) EHR.—The term ‘‘EHR’’ has the meaning 16
147147 given the term ‘‘certified EHR technology’’ in sec-17
148148 tion 1848(o) of the Social Security Act (42 U.S.C. 18
