2323 Be it enacted by the Senate and House of Representa-1
2424 tives of the United States of America in Congress assembled, 2
2525 SECTION 1. SHORT TITLE. 3
2626 This Act may be cited as the ‘‘Veterans Affairs 4
2727 Transfer of Information and Sharing of Disability Exam-5
2828 ination Procedures With DOD Doctors Act’’. 6

3737 Section 1145(a)(5) of title 10, United States Code, 6
3838 is amended by adding at the end the following new sub-7
3939 paragraphs: 8
4040 ‘‘(E) If a member of the Armed Forces who is re-9
4141 quired to receive a physical examination under subpara-10
4242 graph (A) has or is believed to have a medical condition 11
4343 that will or may make the member eligible for disability 12
4444 compensation and benefits from the Department of Vet-13
4545 erans Affairs, the physical examination shall be performed 14
4646 by a health care provider who is certified by the Secretary 15
4747 of Veterans Affairs to determine such eligibility. If such 16
4848 a condition is discovered during the physical examination 17
4949 and the health care provider performing the examination 18
5050 is not certified by the Secretary of Veterans Affairs, the 19
5151 examination shall be completed by a health care provider 20
5252 certified by the Secretary of Veterans Affairs. 21
5353 ‘‘(F) An eligibility determination made as part of a 22
5454 physical examination under subparagraph (C) shall be 23
5555 binding on the Department of Veterans Affairs and be 24
5656 used as the basis for assigning a disability rating for the 25
5757 separating member.’’. 26

6464 The Secretary of Veterans Affairs and the Secretary 4
6565 of Defense shall jointly establish a system to be used by 5
6666 both the Department of Defense and the Department of 6
6767 Veterans Affairs to establish and maintain the medical 7
6868 and personnel records of members of the Armed Forces 8
6969 and veterans. Such system shall provide for data sharing 9
