57	57	tives of the United States of America in Congress assembled, 2
58	58	SECTION 1. SHORT TITLE. 3
59	59	This Act may be cited as the ‘‘Whole Milk for 4
60	60	Healthy Kids Act of 2025’’. 5
61	61	SEC. 2. ORGANIC OR NON-ORGANIC WHOLE MILK PERMIS-6
62	62	SIBLE. 7
63	63	Section 9(a)(2) of the Richard B. Russell National 8
64	64	School Lunch Act (42 U.S.C. 1758(a)(2)) is amended— 9
65	65	(1) by amending subparagraph (A) to read as 10
66	66	follows: 11
67	67	‘‘(A) I
68	68	N GENERAL.—Lunches served by 12
69	69	schools participating in the school lunch pro-13
70	70	gram under this Act— 14
71	71	‘‘(i) shall offer students a variety of 15
72	72	fluid milk; 16
73	73	‘‘(ii) may offer students flavored and 17
74	74	unflavored organic or non-organic whole, 18
75	75	reduced-fat, low-fat, and fat-free fluid milk 19
76	76	and lactose-free fluid milk; and 20
77	77	‘‘(iii) shall provide a substitute for 21
78	78	fluid milk for students whose disability re-22
79	79	stricts their diet, on receipt of a written 23
80	80	statement from a licensed physician, par-24
81	81	ent, or legal guardian that identifies the 25

85	85	disability that restricts the student’s diet 1
86	86	and that specifies the substitute for fluid 2
87	87	milk.’’; and 3
88	88	(2) by adding at the end the following: 4
89	89	‘‘(D) S
90	90	ATURATED FAT.—Milk fat included 5
91	91	in any fluid milk provided under subparagraph 6
92	92	(A) shall not be considered saturated fat for 7
93	93	purposes of measuring compliance with the al-8
94	94	lowable average saturated fat content of a meal 9
95	95	under section 210.10 of title 7, Code of Federal 10
96	96	Regulations (or successor regulations). 11
97	97	‘‘(E) P
98	98	ROHIBITION ON CERTAIN PUR -12
99	99	CHASES.—The Secretary shall prohibit schools 13
100	100	participating in the school lunch program under 14
101	101	this Act from purchasing or offering milk pro-15
102	102	duced by China state-owned enterprises. 16
103	103	‘‘(F) L
104	104	IMITATION ON AUTHORITY .—The 17
105	105	Secretary may not prohibit any school partici-18
106	106	pating in the school lunch program under this 19
107	107	Act from offering students the milk described in 20
108	108	subparagraph (A)(ii).’’. 21
