SHORT TITLE. 3 This Act may be cited as the ‘‘Whole Milk for 4 Healthy Kids Act of 2025’’. 5 SEC. 2. ORGANIC OR NON-ORGANIC WHOLE MILK PERMIS-6 SIBLE. 7 Section 9(a)(2) of the Richard B. Russell National 8 School Lunch Act (42 U.S.C. 1758(a)(2)) is amended— 9 (1) by amending subparagraph (A) to read as 10 follows: 11 ‘‘(A) I N GENERAL.—Lunches served by 12 schools participating in the school lunch pro-13 gram under this Act— 14 ‘‘(i) shall offer students a variety of 15 fluid milk; 16 ‘‘(ii) may offer students flavored and 17 unflavored organic or non-organic whole, 18 reduced-fat, low-fat, and fat-free fluid milk 19 and lactose-free fluid milk; and 20 ‘‘(iii) shall provide a substitute for 21 fluid milk for students whose disability re-22 stricts their diet, on receipt of a written 23 statement from a licensed physician, par-24 ent, or legal guardian that identifies the 25 VerDate Sep 11 2014 22:37 Feb 07, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H649.IH H649 ssavage on LAPJG3WLY3PROD with BILLS 3 •HR 649 IH disability that restricts the student’s diet 1 and that specifies the substitute for fluid 2 milk.’’; and 3 (2) by adding at the end the following: 4 ‘‘(D) S ATURATED FAT.—Milk fat included 5 in any fluid milk provided under subparagraph 6 (A) shall not be considered saturated fat for 7 purposes of measuring compliance with the al-8 lowable average saturated fat content of a meal 9 under section 210.10 of title 7, Code of Federal 10 Regulations (or successor regulations). 11 ‘‘(E) P ROHIBITION ON CERTAIN PUR -12 CHASES.—The Secretary shall prohibit schools 13 participating in the school lunch program under 14 this Act from purchasing or offering milk pro-15 duced by China state-owned enterprises. 16 ‘‘(F) L IMITATION ON AUTHORITY .—The 17 Secretary may not prohibit any school partici-18 pating in the school lunch program under this 19 Act from offering students the milk described in 20 subparagraph (A)(ii).’’. 21 Æ VerDate Sep 11 2014 22:37 Feb 07, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\H649.IH H649 ssavage on LAPJG3WLY3PROD with BILLS
