Be it enacted by the Senate and House of Representa-1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘No Abortion Coverage 4 for Medicaid Act’’. 5 SEC. 2. FINDINGS. 6 Congress finds the following: 7 VerDate Sep 11 2014 21:47 Feb 19, 2025 Jkt 059200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H719.IH H719 kjohnson on DSK7ZCZBW3PROD with $$_JOB 2 •HR 719 IH (1) The Hyde Amendment was first enacted in 1 1976 and has prevented taxpayer funds for abor-2 tions. 3 (2) The most recently enacted Hyde Amend-4 ment states that no appropriated dollars shall be ex-5 pended for any abortion or health benefits coverage 6 that includes coverage of abortion. 7 (3) The Department of Health and Human 8 Services sent a letter to the States on August 6, 9 2022, inviting States to use Medicaid funding under 10 the demonstration authority under section 1115 of 11 the Social Security Act to expand access to elective 12 abortions. 13 (4) The Hyde Amendment applies to all Med-14 icaid funds and cannot be superseded by a waiver 15 under section 1115 of the Social Security Act. 16 (5) Legislation to permanently prohibit Med-17 icaid dollars from going to elective abortions, includ-18 ing payment for abortions and services that neces-19 sitate receipt for services of abortion, is consistent 20 with the Hyde Amendment. 21 VerDate Sep 11 2014 21:47 Feb 19, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H719.IH H719 kjohnson on DSK7ZCZBW3PROD with $$_JOB 3 •HR 719 IH SEC. 3. LIMITING DEMONSTRATION PROJECTS RELATED 1 TO ABORTION UNDER MEDICAID AND CHIP. 2 Section 1115 of the Social Security Act (42 U.S.C. 3 1315) is amended by adding at the end the following new 4 subsection: 5 ‘‘(g) L IMITATION ON DEMONSTRATION PROJECTS 6 R ELATED TOABORTION.— 7 ‘‘(1) I N GENERAL.—Subject to paragraph (2), 8 beginning on enactment, the Secretary may not ap-9 prove an application (or extension) for any experi-10 mental, pilot, or demonstration project undertaken 11 under subsection (a) to promote the objectives of 12 title XIX or title XXI that provides Federal finan-13 cial assistance for abortion, or health benefits cov-14 erage that includes abortion, including expenses for 15 travel or lodging for the purpose of obtaining an 16 abortion. 17 ‘‘(2) E XCEPTIONS.—The limitations on para-18 graph (1) shall not apply to— 19 ‘‘(A) an abortion with respect to a preg-20 nancy resulting from of an act of rape or incest; 21 ‘‘(B) treatment to address a physical dis-22 order, physical injury, or physical illness, in-23 cluding a life-endangering physical condition 24 caused by or arising from the pregnancy itself, 25 that would, as certified by a physician, place 26 VerDate Sep 11 2014 21:47 Feb 19, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H719.IH H719 kjohnson on DSK7ZCZBW3PROD with $$_JOB 4 •HR 719 IH the individual in danger of death unless such 1 abortion is performed; or 2 ‘‘(C) treatment for miscarriage or ectopic 3 pregnancy.’’. 4 Æ VerDate Sep 11 2014 21:47 Feb 19, 2025 Jkt 059200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H719.IH H719 kjohnson on DSK7ZCZBW3PROD with $$_JOB
