3030 NGENERAL.—Title II of the Congressional 3
3131 Budget and Impoundment Control Act of 1974 (2 U.S.C. 4
3232 601 et seq.) is amended by adding at the end the fol-5
3333 lowing: 6
3434 ‘‘SEC. 204. PANEL OF HEALTH ADVISORS. 7
3535 ‘‘(a) I
3636 NGENERAL.—The Panel of Health Advisors 8
3737 (in this section referred to as the ‘Panel’) shall be within 9
3838 the Congressional Budget Office. 10
3939 ‘‘(b) D
4040 UTIES ANDPRIORITYTARGETAREAS.— 11
4141 ‘‘(1) D
4242 UTIES.—The Panel shall— 12
4343 ‘‘(A) provide technical and functional ex-13
4444 pertise and recommendations to the Congres-14
4545 sional Budget Office to improve the office’s 15
4646 studies, analysis, and cost estimates related to 16
4747 health and health care issues and policies; 17
4848 ‘‘(B) meet at least once annually; and 18
4949 ‘‘(C) issue an annual report to the chair 19
5050 and ranking minority members of the Com-20
5151 mittee on the Budget of the House of Rep-21
5252 resentatives and the Committee on the Budget 22
5353 of the Senate which— 23
5454 ‘‘(i) details the work of the Panel and 24
5555 includes such recommendations as have 25
5656 been approved by a vote of at least 9 mem-26

6666 clause (i) and the extent to which any such 7
6767 recommendations were integrated into the 8
6868 office’s studies and cost estimates. 9

7070 RIORITY TARGET AREAS .—For the pur-10
7171 poses of this section, the Director of the Congres-11
7272 sional Budget Office, in consultation with the chairs 12
7373 and ranking minority members of the Committee on 13
7474 the Budget of the House of Representatives and the 14
7575 Committee on the Budget of the Senate, as well as 15
7676 members on the Panel, shall determine priorities to 16
7777 address in meetings of the Panel, and the report de-17
7878 tailed under paragraph (1)(C). The Panel shall pro-18
7979 vide expertise and recommendations under para-19
8080 graph (1) with specific respect to the following 20
8181 areas: 21
8282 ‘‘(A) Non-economic and economic studies 22
8383 on health and health care issues and policies 23
8484 developed by the Congressional Budget Office. 24

9393 nomic and economic impacts of health care pol-6
9494 icy changes and legislation. 7
9595 ‘‘(D) Health care components of the Con-8
9696 gressional Budget Office’s annual Budget and 9
9797 Economic Outlook publications, Federal Health 10
9898 Subsidies for Health Insurance reports, Health 11
9999 Insurance Coverage Projections, and other offi-12
100100 cial publications related to health and health 13
101101 care by the Congressional Budget Office. 14
102102 ‘‘(3) P
103103 UBLICATION.—The Director of the Con-15
104104 gressional Budget Office shall publish, on the Of-16
105105 fice’s public website, the annual report prepared pur-17
106106 suant to paragraph (1)(C). 18
107107 ‘‘(4) E
108108 THICAL DISCLOSURE ; CONFIDEN-19
109109 TIALITY.—The Director of the Congressional Budget 20
110110 Office may establish— 21
111111 ‘‘(A) a system for public disclosure by 22
112112 members of the Panel related to potential con-23
113113 flicts of interest relating to such members; and 24

118118 bers of the Panel to protect information ob-2
119119 tained by the Government on a confidential 3
120120 basis to inform official work products and con-4
121121 fidential congressional requests for analytical 5
122122 reports and budgetary scoring estimates. 6

124124 EMBERSHIP.— 7
125125 ‘‘(1) N
126126 UMBER AND APPOINTMENT .—The mem-8
127127 bership of the Panel shall include 15 members ap-9
128128 pointed not later than 90 days after the date of the 10
129129 enactment of this section, of which— 11
130130 ‘‘(A) 3 members shall be appointed by the 12
131131 chair of the Committee on the Budget of the 13
132132 House of Representatives; 14
133133 ‘‘(B) 3 members shall be appointed by the 15
134134 ranking minority member of the Committee on 16
135135 the Budget of the House of Representatives; 17
136136 ‘‘(C) 3 members shall be appointed by the 18
137137 chair of the Committee on the Budget of the 19
138138 Senate; 20
139139 ‘‘(D) 3 members shall be appointed by the 21
140140 ranking minority member of the Committee on 22
141141 the Budget of the Senate; and 23
142142 ‘‘(E) 3 members shall be appointed by the 24
143143 Director of the Congressional Budget Office. 25

147147 ‘‘(2) QUALIFICATIONS.—The membership of the 1
148148 Panel shall aim to include, but not be limited to, in-2
149149 dividuals with national recognition for their expertise 3
150150 in health finance and economics, actuarial science, 4
151151 health facility management, life sciences and drug 5
152152 development, investment in health care companies, 6
153153 health plans and integrated delivery systems, reim-7
154154 bursement of health facilities, allopathic and osteo-8
155155 pathic physicians, and other providers of health serv-9
156156 ices, Medicare, Medicaid, and other related fields. 10
157157 ‘‘(3) S
158158 PECIAL GOVERNMENT EMPLOYEES .— 11
159159 Members of the Panel shall serve as special Govern-12
160160 ment employees (as defined in section 202(a) of title 13
161161 18, United States Code). 14

165165 N GENERAL.—The terms of the members 16
166166 of the Panel shall be for 3 years, except that the Di-17
167167 rector of the Congressional Budget Office shall des-18
168168 ignate staggered terms of the members first ap-19
169169 pointed. 20

171171 ACANCIES.— 21
172172 ‘‘(A) I
173173 N GENERAL.—A vacancy in the 22
174174 Panel shall be filled in the manner in which the 23
175175 original appointment was made. 24

179179 ‘‘(B) TERM OF MEMBER APPOINTED TO 1
180180 FILL VACANCY.—Any member appointed to fill 2
181181 a vacancy occurring before the expiration of the 3
182182 term for which the member’s predecessor was 4
183183 appointed shall be appointed only for the re-5
184184 mainder of that term, except that a member 6
185185 may serve after the expiration of that member’s 7
186186 term until a successor has taken office. 8
187187 ‘‘(3) C
188188 HAIR; VICE CHAIR.— 9
189189 ‘‘(A) I
190190 N GENERAL.—The Director of the 10
191191 Congressional Budget Office shall designate a 11
192192 member of the Panel, at the time of appoint-12
193193 ment of the member, as chair and a member as 13
194194 vice chair for that term of appointment, except 14
195195 that in the case of vacancy of the chair or vice 15
196196 chair, the Director of the Congressional Budget 16
197197 Office may designate another member for the 17
198198 remainder of that member’s term. 18
199199 ‘‘(B) R
200200 EQUIREMENTS.— The chair and 19
201201 vice chair shall be appointed by the Director of 20
202202 the Congressional Budget Office— 21
203203 ‘‘(i) after considering recommenda-22
204204 tions received from the chairs of the Com-23
205205 mittees on the Budget of the House of 24
206206 Representatives and the Senate; 25

211211 ation; and 2
212212 ‘‘(iii) solely on the basis of their fit-3
213213 ness to perform their duties. 4
214214 ‘‘(4) L
215215 IMITS.—Members of the Panel shall be 5
216216 limited to two 3-year terms, for a total of not to ex-6
217217 ceed 6 years of service on the Panel. For purposes 7
218218 of this paragraph, any year of service on the Panel 8
219219 by a person appointed to fill a vacancy under para-9
220220 graph (2) shall be included in determining the num-10
221221 ber of years that such person has served on the 11
222222 Panel.’’. 12

224224 LERICALAMENDMENT.—The table of contents 13
225225 of such Act is amended by inserting after the item relating 14
226226 to section 203 the following: 15
