18	18	Be it enacted by the Senate and House of Representa-1
19	19	tives of the United States of America in Congress assembled, 2
20	20	SECTION 1. SHORT TITLE. 3
21	21	This Act may be cited as the ‘‘Healthy Equipping 4
22	22	And Lending Technical Help Panel Act’’ or the 5
23	23	‘‘HEALTH Panel Act’’. 6

30	30	NGENERAL.—Title II of the Congressional 3
31	31	Budget and Impoundment Control Act of 1974 (2 U.S.C. 4
32	32	601 et seq.) is amended by adding at the end the fol-5
33	33	lowing: 6
34	34	‘‘SEC. 204. PANEL OF HEALTH ADVISORS. 7
35	35	‘‘(a) I
36	36	NGENERAL.—The Panel of Health Advisors 8
37	37	(in this section referred to as the ‘Panel’) shall be within 9
38	38	the Congressional Budget Office. 10
39	39	‘‘(b) D
40	40	UTIES ANDPRIORITYTARGETAREAS.— 11
41	41	‘‘(1) D
42	42	UTIES.—The Panel shall— 12
43	43	‘‘(A) provide technical and functional ex-13
44	44	pertise and recommendations to the Congres-14
45	45	sional Budget Office to improve the office’s 15
46	46	studies, analysis, and cost estimates related to 16
47	47	health and health care issues and policies; 17
48	48	‘‘(B) meet at least once annually; and 18
49	49	‘‘(C) issue an annual report to the chair 19
50	50	and ranking minority members of the Com-20
51	51	mittee on the Budget of the House of Rep-21
52	52	resentatives and the Committee on the Budget 22
53	53	of the Senate which— 23
54	54	‘‘(i) details the work of the Panel and 24
55	55	includes such recommendations as have 25
56	56	been approved by a vote of at least 9 mem-26

61	61	gressional Budget Office; and 2
62	62	‘‘(ii) includes a description prepared 3
63	63	by the Director of the Congressional Budg-4
64	64	et Office detailing how the office utilized 5
65	65	any such recommendations provided under 6
66	66	clause (i) and the extent to which any such 7
67	67	recommendations were integrated into the 8
68	68	office’s studies and cost estimates. 9
69	69	‘‘(2) P
70	70	RIORITY TARGET AREAS .—For the pur-10
71	71	poses of this section, the Director of the Congres-11
72	72	sional Budget Office, in consultation with the chairs 12
73	73	and ranking minority members of the Committee on 13
74	74	the Budget of the House of Representatives and the 14
75	75	Committee on the Budget of the Senate, as well as 15
76	76	members on the Panel, shall determine priorities to 16
77	77	address in meetings of the Panel, and the report de-17
78	78	tailed under paragraph (1)(C). The Panel shall pro-18
79	79	vide expertise and recommendations under para-19
80	80	graph (1) with specific respect to the following 20
81	81	areas: 21
82	82	‘‘(A) Non-economic and economic studies 22
83	83	on health and health care issues and policies 23
84	84	developed by the Congressional Budget Office. 24

92	92	Congressional Budget Office to project non-eco-5
93	93	nomic and economic impacts of health care pol-6
94	94	icy changes and legislation. 7
95	95	‘‘(D) Health care components of the Con-8
96	96	gressional Budget Office’s annual Budget and 9
97	97	Economic Outlook publications, Federal Health 10
98	98	Subsidies for Health Insurance reports, Health 11
99	99	Insurance Coverage Projections, and other offi-12
100	100	cial publications related to health and health 13
101	101	care by the Congressional Budget Office. 14
102	102	‘‘(3) P
103	103	UBLICATION.—The Director of the Con-15
104	104	gressional Budget Office shall publish, on the Of-16
105	105	fice’s public website, the annual report prepared pur-17
106	106	suant to paragraph (1)(C). 18

108	108	THICAL DISCLOSURE ; CONFIDEN-19
109	109	TIALITY.—The Director of the Congressional Budget 20
110	110	Office may establish— 21
111	111	‘‘(A) a system for public disclosure by 22
112	112	members of the Panel related to potential con-23
113	113	flicts of interest relating to such members; and 24

118	118	bers of the Panel to protect information ob-2
119	119	tained by the Government on a confidential 3

121	121	fidential congressional requests for analytical 5
122	122	reports and budgetary scoring estimates. 6

124	124	EMBERSHIP.— 7
125	125	‘‘(1) N
126	126	UMBER AND APPOINTMENT .—The mem-8
127	127	bership of the Panel shall include 15 members ap-9
128	128	pointed not later than 90 days after the date of the 10
129	129	enactment of this section, of which— 11
130	130	‘‘(A) 3 members shall be appointed by the 12
131	131	chair of the Committee on the Budget of the 13
132	132	House of Representatives; 14
133	133	‘‘(B) 3 members shall be appointed by the 15
134	134	ranking minority member of the Committee on 16
135	135	the Budget of the House of Representatives; 17
136	136	‘‘(C) 3 members shall be appointed by the 18
137	137	chair of the Committee on the Budget of the 19
138	138	Senate; 20
139	139	‘‘(D) 3 members shall be appointed by the 21
140	140	ranking minority member of the Committee on 22
141	141	the Budget of the Senate; and 23
142	142	‘‘(E) 3 members shall be appointed by the 24
143	143	Director of the Congressional Budget Office. 25

147	147	‘‘(2) QUALIFICATIONS.—The membership of the 1
148	148	Panel shall aim to include, but not be limited to, in-2
149	149	dividuals with national recognition for their expertise 3
150	150	in health finance and economics, actuarial science, 4
151	151	health facility management, life sciences and drug 5
152	152	development, investment in health care companies, 6
153	153	health plans and integrated delivery systems, reim-7
154	154	bursement of health facilities, allopathic and osteo-8
155	155	pathic physicians, and other providers of health serv-9
156	156	ices, Medicare, Medicaid, and other related fields. 10
157	157	‘‘(3) S
158	158	PECIAL GOVERNMENT EMPLOYEES .— 11
159	159	Members of the Panel shall serve as special Govern-12
160	160	ment employees (as defined in section 202(a) of title 13
161	161	18, United States Code). 14

163	163	ERMS.— 15
164	164	‘‘(1) I
165	165	N GENERAL.—The terms of the members 16
166	166	of the Panel shall be for 3 years, except that the Di-17
167	167	rector of the Congressional Budget Office shall des-18
168	168	ignate staggered terms of the members first ap-19
169	169	pointed. 20

171	171	ACANCIES.— 21
172	172	‘‘(A) I
173	173	N GENERAL.—A vacancy in the 22
174	174	Panel shall be filled in the manner in which the 23
175	175	original appointment was made. 24

179	179	‘‘(B) TERM OF MEMBER APPOINTED TO 1
180	180	FILL VACANCY.—Any member appointed to fill 2
181	181	a vacancy occurring before the expiration of the 3
182	182	term for which the member’s predecessor was 4
183	183	appointed shall be appointed only for the re-5
184	184	mainder of that term, except that a member 6
185	185	may serve after the expiration of that member’s 7
186	186	term until a successor has taken office. 8

188	188	HAIR; VICE CHAIR.— 9
189	189	‘‘(A) I
190	190	N GENERAL.—The Director of the 10
191	191	Congressional Budget Office shall designate a 11
192	192	member of the Panel, at the time of appoint-12
193	193	ment of the member, as chair and a member as 13
194	194	vice chair for that term of appointment, except 14
195	195	that in the case of vacancy of the chair or vice 15
196	196	chair, the Director of the Congressional Budget 16
197	197	Office may designate another member for the 17
198	198	remainder of that member’s term. 18
199	199	‘‘(B) R
200	200	EQUIREMENTS.— The chair and 19
201	201	vice chair shall be appointed by the Director of 20
202	202	the Congressional Budget Office— 21
203	203	‘‘(i) after considering recommenda-22
204	204	tions received from the chairs of the Com-23
205	205	mittees on the Budget of the House of 24
206	206	Representatives and the Senate; 25

212	212	‘‘(iii) solely on the basis of their fit-3
213	213	ness to perform their duties. 4

215	215	IMITS.—Members of the Panel shall be 5
216	216	limited to two 3-year terms, for a total of not to ex-6
217	217	ceed 6 years of service on the Panel. For purposes 7
218	218	of this paragraph, any year of service on the Panel 8
219	219	by a person appointed to fill a vacancy under para-9
220	220	graph (2) shall be included in determining the num-10
221	221	ber of years that such person has served on the 11
222	222	Panel.’’. 12

224	224	LERICALAMENDMENT.—The table of contents 13
225	225	of such Act is amended by inserting after the item relating 14
226	226	to section 203 the following: 15
