3232 ROHIBITION.—The Department of Health and 4
3333 Human Services, including the Food and Drug Adminis-5
3434 tration, shall not treat pregnancy as an illness for pur-6
3535 poses of— 7
3636 (1) approving any abortion drug under section 8
3737 505 of the Federal Food, Drug, and Cosmetic Act 9
3838 (21 U.S.C. 355); or 10
3939 (2) imposing or maintaining any risk evaluation 11
4040 and mitigation strategy for an abortion drug under 12
4141 section 505–1 of such Act (21 U.S.C. 355–1). 13

4343 ULLIFICATION OFAPPROVALS INEFFECT.— 14

4545 N GENERAL.—Any prohibited approval of 15
4646 an abortion drug is hereby nullified. 16

4848 ROHIBITED APPROVAL DEFINED .—In this 17
4949 subsection, the term ‘‘prohibited approval of an 18
5050 abortion drug’’— 19
5151 (A) means any approval of an abortion 20
5252 drug under section 505 of the Federal Food, 21
5353 Drug, and Cosmetic Act (21 U.S.C. 355) that 22
5454 relied in whole or in part on the treatment of 23
5555 pregnancy as illness; and 24
