To prohibit the Department of Health and Human Services 
from treating pregnancy as an illness for purposes of 
approving abortion drugs. 
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Pregnancy Is Not an 4
Illness Act of 2025’’. 5

SEC. 2. PROHIBITION AGAINST TREATING PREGNANCY AS 1
ILLNESS FOR PURPOSES OF APPROVING 2
ABORTION DRUGS. 3
(a) P
ROHIBITION.—The Department of Health and 4
Human Services, including the Food and Drug Adminis-5
tration, shall not treat pregnancy as an illness for pur-6
poses of— 7
(1) approving any abortion drug under section 8
505 of the Federal Food, Drug, and Cosmetic Act 9
(21 U.S.C. 355); or 10
(2) imposing or maintaining any risk evaluation 11
and mitigation strategy for an abortion drug under 12
section 505–1 of such Act (21 U.S.C. 355–1). 13
(b) N
ULLIFICATION OFAPPROVALS INEFFECT.— 14
(1) I
N GENERAL.—Any prohibited approval of 15
an abortion drug is hereby nullified. 16
(2) P
ROHIBITED APPROVAL DEFINED .—In this 17
subsection, the term ‘‘prohibited approval of an 18
abortion drug’’— 19
(A) means any approval of an abortion 20
drug under section 505 of the Federal Food, 21
Drug, and Cosmetic Act (21 U.S.C. 355) that 22
relied in whole or in part on the treatment of 23
pregnancy as illness; and 24
