Be it enacted by the Senate and House of Representa-1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘DEI to DIE Act’’. 4 SEC. 2. ELIMINATION OF DIVERSITY, EQUITY, AND INCLU-5 SION IN FEDERAL GOVERNMENT. 6 (a) F INDINGS.—Congress finds the following: 7 (1) The Biden Administration forced illegal and 8 immoral discrimination programs, going by the name 9 ‘‘diversity, equity, and inclusion’’ (in this Act re-10 VerDate Sep 11 2014 22:17 Feb 24, 2025 Jkt 059200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H800.IH H800 ssavage on LAPJG3WLY3PROD with BILLS 2 •HR 800 IH ferred to as ‘‘DEI’’), into virtually all aspects of the 1 Federal Government, in areas ranging from airline 2 safety to the military. 3 (2) This was a concerted effort stemming from 4 President Biden’s first day in office, when he issued 5 Executive Order 13985, ‘‘Advancing Racial Equity 6 and Support for Underserved Communities Through 7 the Federal Government’’. 8 (3) Pursuant to Executive Order 13985 and 9 follow-on orders, nearly every Federal agency and 10 entity submitted ‘‘Equity Action Plans’’ to detail the 11 ways that they have furthered DEIs infiltration of 12 the Federal Government. 13 (4) The public release of these plans dem-14 onstrated immense public waste and shameful dis-15 crimination. 16 (5) That ends today. Americans deserve a Gov-17 ernment committed to serving every person with 18 equal dignity and respect, and to expending precious 19 taxpayer resources only on making America great. 20 (b) E LIMINATION.— 21 (1) I N GENERAL.—The Director of the Office of 22 Management and Budget (in this Act referred to as 23 ‘‘OMB’’), assisted by the Attorney General and the 24 Director of the Office of Personnel Management (in 25 VerDate Sep 11 2014 22:17 Feb 24, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H800.IH H800 ssavage on LAPJG3WLY3PROD with BILLS 3 •HR 800 IH this Act referred to as ‘‘OPM’’), shall coordinate the 1 termination of all discriminatory programs, includ-2 ing illegal diversity, equity, and inclusion (in this 3 Act referred to as ‘‘DEI’’) and diversity, equity, in-4 clusion, and accessibility (in this Act referred to as 5 ‘‘DEIA’’) mandates, policies, programs, preferences, 6 and activities in the Federal Government, under 7 whatever name they appear. 8 (2) A PPLICATION.—To carry out paragraph (1), 9 the Director of OPM, with the assistance of the At-10 torney General as requested, shall review and revise, 11 as appropriate, all existing Federal employment 12 practices, union contracts, and training policies or 13 programs to comply with this Act. Federal employ-14 ment practices, including Federal employee perform-15 ance reviews, shall reward individual initiative, skills, 16 performance, and hard work and shall not under any 17 circumstances consider DEI or DEIA factors, goals, 18 policies, mandates, or requirements. 19 (c) R EQUIREDACTIONS.—Each agency, department, 20 or commission head, in consultation with the Attorney 21 General, the Director of OMB, and the Director of OPM, 22 as appropriate, shall take the following actions not later 23 than 60 days after the date of the enactment of this Act: 24 VerDate Sep 11 2014 22:17 Feb 24, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H800.IH H800 ssavage on LAPJG3WLY3PROD with BILLS 4 •HR 800 IH (1) Terminate, to the maximum extent allowed 1 by law, all DEI, DEIA, and ‘‘environmental justice’’ 2 offices and positions (including ‘‘Chief Diversity Of-3 ficer’’ positions); all ‘‘equity action plans’’, ‘‘equity’’ 4 actions, initiatives, or programs, ‘‘equity-related’’ 5 grants or contracts; and all DEI or DEIA perform-6 ance requirements for employees, contractors, or 7 grantees. 8 (2) Provide the Director of the OMB with a list 9 of all— 10 (A) agency or department DEI, DEIA, or 11 ‘‘environmental justice’’ positions, committees, 12 programs, services, activities, budgets, and ex-13 penditures in existence on November 4, 2024, 14 and an assessment of whether these positions, 15 committees, programs, services, activities, budg-16 ets, and expenditures have been misleadingly re-17 labeled in an attempt to preserve their pre-No-18 vember 4, 2024 function; 19 (B) Federal contractors who have provided 20 DEI training or DEI training materials to 21 agency or department employees; and 22 (C) Federal grantees who received Federal 23 funding to provide or advance DEI, DEIA, or 24 VerDate Sep 11 2014 22:17 Feb 24, 2025 Jkt 059200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H800.IH H800 ssavage on LAPJG3WLY3PROD with BILLS 5 •HR 800 IH ‘‘environmental justice’’ programs, services, or 1 activities since January 20, 2021. 2 (3) Direct the deputy agency or department 3 head to— 4 (A) assess the operational impact (includ-5 ing the number of new DEI hires) and cost of 6 the prior administration’s DEI, DEIA, and 7 ‘‘environmental justice’’ programs and policies; 8 and 9 (B) recommend actions, such as congres-10 sional notifications under section 530D of title 11 28, United States Code, to align agency or de-12 partment programs, activities, policies, regula-13 tions, guidance, employment practices, enforce-14 ment activities, contracts (including set-asides), 15 grants, consent orders, and litigating positions 16 with the policy of equal dignity and respect 17 identified in subsection (a) of this Act. The 18 agency or department head and the Director of 19 OMB shall jointly ensure that the deputy agen-20 cy or department head has the authority and 21 resources needed to carry out this Act. 22 (d) M EETINGS.—To inform and advise the President, 23 so that he may formulate appropriate and effective civil- 24 rights policies for the Executive Branch, the Assistant to 25 VerDate Sep 11 2014 22:17 Feb 24, 2025 Jkt 059200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H800.IH H800 ssavage on LAPJG3WLY3PROD with BILLS 6 •HR 800 IH the President for Domestic Policy shall convene a monthly 1 meeting attended by the Director of OMB, the Director 2 of OPM, and each deputy agency or department head to— 3 (1) hear reports on the prevalence and the eco-4 nomic and social costs of DEI, DEIA, and ‘‘environ-5 mental justice’’ in agency or department programs, 6 activities, policies, regulations, guidance, employ-7 ment practices, enforcement activities, contracts (in-8 cluding set-asides), grants, consent orders, and liti-9 gating positions; 10 (2) discuss any barriers to measures to comply 11 with this Act; and 12 (3) monitor and track agency and department 13 progress and identify potential areas for additional 14 Presidential or legislative action to advance the pol-15 icy of equal dignity and respect. 16 (e) S EVERABILITY.—If any provision of this Act, or 17 the application of any provision to any person or cir-18 cumstance, is held to be invalid, the remainder of this Act 19 and the application of its provisions to any other persons 20 or circumstances shall not be affected. 21 Æ VerDate Sep 11 2014 22:17 Feb 24, 2025 Jkt 059200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6301 E:\BILLS\H800.IH H800 ssavage on LAPJG3WLY3PROD with BILLS
