Be it enacted by the Senate and House of Representa-1 tives of the United States of America in Congress assembled, 2 2 •HR 862 EH SECTION 1. SHORT TITLE. 1 This Act may be cited as the ‘‘TSA Commuting Fair-2 ness Act’’. 3 SEC. 2. FEASIBILITY STUDY ON TSA COMMUTING BENE-4 FITS. 5 (a) I NGENERAL.—Not later than 270 days after the 6 date of the enactment of this Act, the Administrator of 7 the Transportation Security Administration shall submit 8 to the Committee on Homeland Security of the House of 9 Representatives and the Committee on Commerce, 10 Science, and Transportation and the Committee on Home-11 land Security and Governmental Affairs of the Senate a 12 study on the feasibility of treating as on-duty hours the 13 time Transportation Security Administration employees 14 working at airport locations spend traveling between reg-15 ular duty locations and airport parking lots and bus and 16 transit stops. 17 (b) C ONSIDERATIONS.—In conducting the feasibility 18 study required under subsection (a), the Administrator of 19 the Transportation Security Administration shall consider 20 the following with respect to Transportation Security Ad-21 ministration employees: 22 (1) The amount of time needed by such employ-23 ees to travel between regular duty locations and air-24 port parking lots and bus and transit stops at small 25 hub airports, medium hub airports, and large hub 26 3 •HR 862 EH airports (as such terms are defined in section 40102 1 of title 49, United States Code). 2 (2) The amount of time such employees spend 3 commuting, on average, exclusive of the time de-4 scribed in paragraph (1). 5 (3) The potential benefits to such employees 6 and the Administration of treating as on-duty hours 7 the time described in such paragraph. 8 (4) The feasibility of using mobile phones, loca-9 tion data, and any other means to allow such em-10 ployees to report their arrival to and departure from 11 the airport parking lots and bus and transit stops 12 concerned. 13 (5) The estimated costs of treating as on-duty 14 hours the time described in such paragraph, includ-15 ing by considering such hours creditable as basic pay 16 for retirement purposes. 17 (6) Other considerations determined appro-18 priate by the Administrator. 19 Passed the House of Representatives March 10, 2025.
