SHORT TITLE. 3 This Act may be cited as the ‘‘Prison Staff Safety 4 Enhancement Act’’. 5 SEC. 2. ADDRESSING SEXUAL HARASSMENT AND SEXUAL 6 ASSAULT OF BUREAU OF PRISONS STAFF. 7 (a) D EFINITIONS.—In this section: 8 VerDate Sep 11 2014 23:01 Feb 27, 2025 Jkt 059200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H868.IH H868 ssavage on LAPJG3WLY3PROD with BILLS 2 •HR 868 IH (1) CORRECTIONAL OFFICER .—The term ‘‘cor-1 rectional officer’’ has the meaning given the term in 2 section 4051 of title 18, United States Code. 3 (2) I NSPECTOR GENERAL .—The term ‘‘Inspec-4 tor General’’ means the Inspector General of the De-5 partment of Justice. 6 (3) I NCARCERATED INDIVIDUAL .—The term 7 ‘‘incarcerated individual’’ has the meaning given the 8 term ‘‘prisoner’’ in section 4051 of title 18, United 9 States Code. 10 (4) S EXUAL ASSAULT.—The term ‘‘sexual as-11 sault’’ means an act described in subsection (b), (c), 12 or (d) of section 920 of title 10, United States Code. 13 (5) S EXUAL HARASSMENT .—The term ‘‘sexual 14 harassment’’ means unwelcome sexual advances, re-15 quests for sexual favors, or other verbal or physical 16 conduct of a sexual nature that explicitly or implic-17 itly affect an individual’s employment, unreasonably 18 interfere with an individual’s work performance, or 19 create an intimidating, hostile, or offensive work en-20 vironment. 21 (b) R EVIEW ANDANALYSIS.— 22 (1) I N GENERAL.—Not later than 1 year after 23 the date of enactment of this Act, the Inspector 24 General shall carry out a comprehensive statistical 25 VerDate Sep 11 2014 23:01 Feb 27, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H868.IH H868 ssavage on LAPJG3WLY3PROD with BILLS 3 •HR 868 IH review and analysis of the incidence and effects of 1 sexual harassment and sexual assault perpetrated by 2 incarcerated individuals against a correctional officer 3 or other employee of the Bureau of Prisons. 4 (2) A NALYSIS.—The review and analysis re-5 quired under paragraph (1) shall include an analysis 6 of punishments for sexual harassment and sexual as-7 sault as of the date of enactment of this Act in fa-8 cilities controlled by the Bureau of Prisons, includ-9 ing data on the use of such punishments during the 10 5-year period preceding the date of enactment of 11 this Act. 12 (c) R EPORT.—Not later than 180 days after com-13 pleting the review and analysis under subsection (b)(1), 14 the Inspector General shall submit to the Attorney Gen-15 eral and to the Committee on the Judiciary of the Senate 16 and the Committee on the Judiciary of the House of Rep-17 resentatives a report that summarizes the findings of the 18 review and analysis. 19 (d) R ULEMAKING.—Not later than 1 year after re-20 ceiving the report under subsection (c), the Attorney Gen-21 eral shall promulgate a rule adopting national standards 22 for prevention, reduction, and punishment of sexual har-23 assment and sexual assault perpetrated by an incarcerated 24 VerDate Sep 11 2014 23:01 Feb 27, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H868.IH H868 ssavage on LAPJG3WLY3PROD with BILLS 4 •HR 868 IH individual against a correctional officer or other employee 1 of the Bureau of Prisons. 2 Æ VerDate Sep 11 2014 23:01 Feb 27, 2025 Jkt 059200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H868.IH H868 ssavage on LAPJG3WLY3PROD with BILLS
