R. 901 AN ACT To require the Under Secretary of the Science and Tech- nology Directorate of the Department of Homeland Secu- rity to develop a Department-wide policy and process to safeguard research and development from unauthor- ized access to or disclosure of sensitive information in research and development acquisitions, and for other pur- poses. Be it enacted by the Senate and House of Representa-1 tives of the United States of America in Congress assembled, 2 2 •HR 901 EH SECTION 1. SHORT TITLE. 1 This Act may be cited as the ‘‘Research Security and 2 Accountability in DHS Act’’. 3 SEC. 2. SAFEGUARDING SENSITIVE RESEARCH IN THE DE-4 PARTMENT OF HOMELAND SECURITY. 5 (a) I NGENERAL.—Section 302 of the Homeland Se-6 curity Act of 2002 (6 U.S.C. 182) is amended— 7 (1) in paragraph (13), by striking ‘‘and’’ after 8 the semicolon; 9 (2) in paragraph (14), by striking the period 10 and inserting ‘‘; and’’; and 11 (3) by adding at the end the following new 12 paragraph: 13 ‘‘(15) developing, in coordination with appro-14 priate agency officials, a Department-wide policy 15 and process to safeguard research and development 16 from unauthorized access to or disclosure of sen-17 sitive information in research and development ac-18 quisitions.’’. 19 (b) GAO R EPORT.— 20 (1) I N GENERAL.—Not later than one year 21 after the date of the enactment of this Act, the 22 Comptroller General of the United States shall sub-23 mit to the Committee on Homeland Security of the 24 House of Representatives and the Committee on 25 Homeland Security and Governmental Affairs of the 26 3 •HR 901 EH Senate a report on how the Department of Home-1 land Security has complied with National Security 2 Presidential Memorandum–33 (NSPM–33) and 3 adopted the National Science and Technology Coun-4 cil’s 2022 implementation guidance. 5 (2) E LEMENTS.—The report required under 6 paragraph (1) shall address the following: 7 (A) How the Department of Homeland Se-8 curity has complied with disclosure require-9 ments outlined in NSPM–33, and how viola-10 tions are reported to the relevant executive 11 agencies, including in the intelligence commu-12 nity (as such term is defined in section 3(4) of 13 the National Security Act of 1947 (50 U.S.C. 14 3003(4)). 15 (B) Coordination and compliance with 16 guidelines established by the National Science 17 Foundation, the National Science Technology 18 Council, the Office of Science and Technology 19 Policy, and other executive agencies regarding 20 Federal research security. 21 (C) The role of the Science and Tech-22 nology Directorate of the Department regarding 23 establishing a research security framework for 24 4 •HR 901 EH research and development projects across the 1 Department. 2 (c) C ONGRESSIONALBRIEFING.—Not later than 90 3 days after the date of the enactment of this Act, the Sec-4 retary of Homeland Security shall provide to the Com-5 mittee on Homeland Security of the House of Representa-6 tives and the Committee on Homeland Security and Gov-7 ernmental Affairs of the Senate a briefing addressing the 8 development of policies and processes to safeguard De-9 partment of Homeland Security research and development 10 in accordance with paragraph (15) of section 302 of the 11 Homeland Security Act of 2002 (6 U.S.C. 182), as added 12 by subsection (a). 13 Passed the House of Representatives March 10, 2025.
