1919 This Act may be cited as the ‘‘Buzz Off Act’’. 4

2323 URVEILLANCE.—A Federal law enforcement 7
2424 agency may not use an unmanned aerial vehicle to inten-8
2525 tionally conduct surveillance of, gather evidence or collect 9
2626 information about, or photographically or electronically 10

3333 (b) E
3434 XCEPTION.—Notwithstanding subsection (a), a 4
3535 Federal law enforcement agency may use an unmanned 5
3636 aerial vehicle to photograph, or otherwise record a United 6
3737 States citizen for the purposes of publishing or otherwise 7
3838 publicly disseminating such photograph or recording if the 8
3939 agency obtains the written consent of such United States 9
4040 citizen. 10
4141 (c) A
4242 PPLICABILITY.—Subsection (a) shall not apply 11
4343 in the case that— 12
4444 (1) the President, acting through the Secretary 13
4545 of Homeland Security, authorizes use of an un-14
4646 manned aerial vehicle to conduct surveillance if the 15
4747 Secretary certifies in writing under oath that the 16
4848 surveillance is necessary to counter a high risk of a 17
4949 terrorist attack by a specific individual or organiza-18
5050 tion; or 19
5151 (2) the head of a Federal law enforcement 20
5252 agency first obtains a search warrant signed by a 21
5353 judge authorizing the use of an unmanned aerial ve-22
5454 hicle. 23
