IMPOSITION OF SANCTIONS ON PERSONS ENGAG-1 ING IN TRANSACTIONS IN AFGHANISTAN 2 RARE EARTH MINERALS. 3 (a) I NGENERAL.—On and after the date that is 180 4 days after the date of the enactment of this Act, the Presi-5 dent shall impose the sanctions described in subsection (d) 6 with respect to a foreign person the President determines 7 knowingly, on or after such date of enactment, engages 8 in a significant transaction with a person that is part of, 9 or operates for or on behalf of, the rare earth mineral sec-10 tor of Afghanistan. 11 (b) E XCEPTIONRELATING TO IMPORTATION OF 12 G OODS.— 13 (1) I N GENERAL.—Notwithstanding subsection 14 (a), the authorities and requirements to impose 15 sanctions under subsection (a) shall not include the 16 authority or a requirement to impose sanctions on 17 the importation of goods. 18 (2) G OOD DEFINED.—In this subsection, the 19 term ‘‘good’’ means any article, natural or man- 20 made substance, material, supply or manufactured 21 product, including inspection and test equipment, 22 and excluding technical data. 23 (c) P ENALTIES.—A person that violates, attempts to 24 violate, conspires to violate, or causes a violation of sub-25 section (a) or any regulation, license, or order issued to 26 VerDate Sep 11 2014 16:53 Mar 03, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H969.IH H969 ssavage on LAPJG3WLY3PROD with BILLS 3 •HR 969 IH carry out subsection (a) shall be subject to the penalties 1 set forth in subsections (b) and (c) of section 206 of the 2 International Emergency Economic Powers Act (50 3 U.S.C. 1705) to the same extent as a person that commits 4 an unlawful act described in subsection (a) of that section. 5 (d) S ANCTIONSDESCRIBED.—The sanctions to be 6 imposed on a foreign person described in subsection (a) 7 are the following: 8 (1) B LOCKING OF PROPERTY .—The President 9 shall block, in accordance with the International 10 Emergency Economic Powers Act (50 U.S.C. 1701 11 et seq.), all transactions in all property and interests 12 in property of any person subject to subsection (a) 13 if such property and interests in property are in the 14 United States, come within the United States, or are 15 or come within the possession or control of a United 16 States person. 17 (2) E XCLUSION FROM UNITED STATES .—The 18 Secretary of State shall deny a visa to, and the Sec-19 retary of Homeland Security shall exclude from the 20 United States, any person subject to subsection (a) 21 that is an alien. 22 Æ VerDate Sep 11 2014 16:53 Mar 03, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\H969.IH H969 ssavage on LAPJG3WLY3PROD with BILLS
