17	17	To require the Federal Energy Regulatory Commission to
18	18	extend the time period during which licensees are re-
19	19	quired to commence construction of certain hydropower
20	20	projects.
21	21	Be it enacted by the Senate and House of Representa-1
22	22	tives of the United States of America in Congress assembled, 2
23	23	SECTION 1. EXTENSION OF TIME TO COMMENCE CON-3
24	24	STRUCTION OF CERTAIN HYDROPOWER 4
25	25	PROJECTS. 5
26	26	(a) D
27	27	EFINITION OFCOVEREDPROJECT.—In this sec-6
28	28	tion, the term ‘‘covered project’’ means a hydropower 7

32	32	project with respect to which the Federal Energy Regu-1
33	33	latory Commission issued a license before March 13, 2020. 2
34	34	(b) A
35	35	UTHORIZATION OF EXTENSION.—Notwith-3
36	36	standing section 13 of the Federal Power Act (16 U.S.C. 4
37	37	806), on the request of a licensee of a covered project, 5
38	38	the Federal Energy Regulatory Commission may, after 6
39	39	reasonable notice and for good cause shown, extend in ac-7
40	40	cordance with subsection (c) the period during which the 8
41	41	licensee is required to commence construction of the cov-9
42	42	ered project for not more than an additional 6 years be-10
43	43	yond the 8 years authorized by that section. 11
44	44	(c) P
45	45	ERIOD OFEXTENSION.—An extension of time 12
46	46	to commence construction of a covered project under sub-13
47	47	section (b) shall— 14
48	48	(1) consist of not more than 3 consecutive 2- 15
49	49	year periods; 16
50	50	(2) begin on the date on which the final exten-17
51	51	sion of the period for commencement of construction 18
52	52	granted to the licensee under section 13 of the Fed-19
53	53	eral Power Act (16 U.S.C. 806) expires; and 20
54	54	(3) end on the date that is not more than 6 21
55	55	years after the latest date to which the Federal En-22
56	56	ergy Regulatory Commission is authorized to extend 23
57	57	the period for commencement of construction under 24
58	58	that section. 25

62	62	(d) REINSTATEMENT OF EXPIREDLICENSE.—If the 1
63	63	time period required under section 13 of the Federal 2
64	64	Power Act (16 U.S.C. 806) to commence construction of 3
65	65	a covered project expires after December 31, 2023, and 4
66	66	before the date of enactment of this Act— 5
67	67	(1) the Federal Energy Regulatory Commission 6
68	68	may reinstate the license for the applicable project 7
69	69	effective as of the date of expiration of the license; 8
70	70	and 9
71	71	(2) the extension authorized under subsection 10
72	72	(b) shall take effect on the date of that expiration. 11
