30	30	To amend title 10, United States Code, to provide for con-
31	31	current receipt of veterans’ disability compensation and
32	32	retired pay for disability retirees with combat-related dis-
33	33	abilities, and for other purposes.
34	34	Be it enacted by the Senate and House of Representa-1
35	35	tives of the United States of America in Congress assembled, 2

40	40	This Act may be cited as the ‘‘Major Richard Star 2
41	41	Act’’. 3
42	42	SEC. 2. ELIGIBILITY OF DISABILITY RETIREES WITH COM-4
43	43	BAT-RELATED DISABILITIES FOR CONCUR-5
44	44	RENT RECEIPT OF VETERANS’ DISABILITY 6
45	45	COMPENSATION AND RETIRED PAY. 7

47	47	ONCURRENTRECEIPT INCONNECTIONWITH 8
48	48	CRSC.—Section 1413a(b)(3) of title 10, United States 9
49	49	Code, is amended— 10
50	50	(1) in subparagraph (A)— 11
51	51	(A) by striking ‘‘of this title, the amount’’ 12
52	52	and inserting ‘‘of this title— 13
53	53	‘‘(i) the retired pay of the retiree is 14
54	54	not subject to reduction under sections 15
55	55	5304 and 5305 of title 38; and 16
56	56	‘‘(ii) the amount’’; and 17
57	57	(B) by striking ‘‘after any such reduction 18
58	58	under sections 5304 and 5305 of title 38’’; and 19
59	59	(2) in subparagraph (B)— 20
60	60	(A) by striking ‘‘creditable service, the 21
61	61	amount’’ and inserting the following: ‘‘cred-22
62	62	itable service— 23
63	63	‘‘(i) the retired pay of the retiree is 24
64	64	not subject to reduction under sections 25
65	65	5304 and 5305 of title 38; and 26

82	82	for that month to veterans’ disability compensation for a 11
83	83	combat-related disability (as that term is defined in sec-12
84	84	tion 1413a(e) of this title) is entitled to be paid both for 13
85	85	that month without regard to sections 5304 and 5305 of 14
86	86	title 38.’’. 15

114	114	ABLE OF SECTIONS.—The table of sections 11
115	115	at the beginning of chapter 71 of such title is 12
116	116	amended by striking the item relating to section 13
117	117	1414 and inserting the following new item: 14
118	118	‘‘1414. Members eligible for retired pay who are also eligible for veterans’ dis-
119	119	ability compensation: concurrent receipt.’’.
120	120	(4) CONFORMING AMENDMENT .—Section 15
121	121	1413a(f) of such title is amended by striking ‘‘Sub-16
122	122	section (d)’’ and inserting ‘‘Subsection (c)’’. 17

124	124	FFECTIVEDATE.—The amendments made by 18
125	125	this section shall take effect on the first day of the first 19
126	126	month beginning after the date of the enactment of this 20
127	127	Act and shall apply to payments for months beginning on 21
128	128	or after that date. 22
