A BILL 
To amend title 10, United States Code, to provide for con-
current receipt of veterans’ disability compensation and 
retired pay for disability retirees with combat-related dis-
abilities, and for other purposes. 
Be it enacted by the Senate and House of Representa-1

SECTION 1. SHORT TITLE. 1
This Act may be cited as the ‘‘Major Richard Star 2
Act’’. 3
SEC. 2. ELIGIBILITY OF DISABILITY RETIREES WITH COM-4
BAT-RELATED DISABILITIES FOR CONCUR-5
RENT RECEIPT OF VETERANS’ DISABILITY 6
COMPENSATION AND RETIRED PAY. 7
(a) C
ONCURRENTRECEIPT INCONNECTIONWITH 8
CRSC.—Section 1413a(b)(3) of title 10, United States 9
Code, is amended— 10
(1) in subparagraph (A)— 11
(A) by striking ‘‘of this title, the amount’’ 12
and inserting ‘‘of this title— 13
‘‘(i) the retired pay of the retiree is 14
not subject to reduction under sections 15
5304 and 5305 of title 38; and 16
‘‘(ii) the amount’’; and 17
(B) by striking ‘‘after any such reduction 18
under sections 5304 and 5305 of title 38’’; and 19
(2) in subparagraph (B)— 20
(A) by striking ‘‘creditable service, the 21
amount’’ and inserting the following: ‘‘cred-22
itable service— 23
‘‘(i) the retired pay of the retiree is 24
not subject to reduction under sections 25
5304 and 5305 of title 38; and 26

(B) by striking ‘‘after any such reduction 2
under sections 5304 and 5305 of title 38’’. 3
(b) C
ONCURRENT RECEIPTGENERALLY.—Section 4
1414(b) of title 10, United States Code, is amended to 5
read as follows: 6
‘‘(b) S
PECIALRULE FORCHAPTER61 DISABILITY 7
R
ETIREES.—A member or former member of the uni-8
formed services who is entitled to retired pay under chap-9
ter 61 of this title for any month and who is also entitled 10
for that month to veterans’ disability compensation for a 11
combat-related disability (as that term is defined in sec-12
tion 1413a(e) of this title) is entitled to be paid both for 13
that month without regard to sections 5304 and 5305 of 14
title 38.’’. 15
(c) T
ECHNICAL ANDCONFORMINGAMENDMENTS.— 16
(1) A
MENDMENTS REFLECTING END OF CON -17
CURRENT RECEIPT PHASE -IN PERIOD.—Section 18
1414 of title 10, United States Code, is further 19
amended— 20
(A) in subsection (a)(1)— 21
(i) by striking the second sentence; 22
and 23
(ii) by striking subparagraphs (A) and 24
(B); 25

(B) by striking subsection (c) and redesig-1
nating subsections (d) and (e) as subsections 2
(c) and (d), respectively; and 3
(C) in subsection (d), as redesignated, by 4
striking paragraphs (3) and (4). 5
(2) S
ECTION HEADING.—The heading of such 6
section 1414 is amended to read as follows: 7
‘‘§ 1414. Members eligible for retired pay who are also 8
eligible for veterans’ disability compensa-9
tion: concurrent receipt’’. 10
(3) T
ABLE OF SECTIONS.—The table of sections 11
at the beginning of chapter 71 of such title is 12
amended by striking the item relating to section 13
1414 and inserting the following new item: 14
‘‘1414. Members eligible for retired pay who are also eligible for veterans’ dis-
ability compensation: concurrent receipt.’’. 
(4) CONFORMING AMENDMENT .—Section 15
1413a(f) of such title is amended by striking ‘‘Sub-16
section (d)’’ and inserting ‘‘Subsection (c)’’. 17
(d) E
FFECTIVEDATE.—The amendments made by 18
this section shall take effect on the first day of the first 19
month beginning after the date of the enactment of this 20
Act and shall apply to payments for months beginning on 21
or after that date. 22
