21	21	To amend title 28, United States Code, to prohibit the
22	22	issuance of national injunctions, and for other purposes.
23	23	Be it enacted by the Senate and House of Representa-1
24	24	tives of the United States of America in Congress assembled, 2
25	25	SECTION 1. SHORT TITLE. 3
26	26	This Act may be cited as the ‘‘Judicial Relief Clari-4
27	27	fication Act of 2025’’. 5

31	31	SEC. 2. NON-PARTY RELIEF. 1
32	32	(a) I
33	33	NGENERAL.—Chapter 155 of title 28, United 2
34	34	States Code, is amended by adding at the end the fol-3
35	35	lowing: 4
36	36	‘‘§ 2285. Non-party relief 5
37	37	‘‘No court of the United States (and no district court 6
38	38	of the Virgin Islands, Guam, or the Northern Mariana Is-7
39	39	lands) shall issue any order, including an injunction, 8
40	40	vacatur, stay, temporary restraining order, declaratory re-9
41	41	lief, or equitable relief, that purports to restrain the en-10
42	42	forcement against a non-party or compel action in favor 11
43	43	of a non-party with respect to any statute, regulation, 12
44	44	order, executive action, or similar authority, unless the 13
45	45	court determines the non-party is represented by a party 14
46	46	acting in a representative capacity pursuant to the Federal 15
47	47	Rules of Civil Procedure.’’. 16

49	49	LERICALAMENDMENT.—The table of sections 17
50	50	for chapter 155 of title 28, United States Code is amended 18
51	51	by inserting after the item relating to section 2285 the 19
52	52	following: 20
53	53	‘‘2285. Non-party relief.’’.
54	54	SEC. 3. TEMPORARY RESTRAINING ORDERS.

56	56	Section 1292(a) of title 28, United States Code, is 22
57	57	amended by adding at the end the following: 23
58	58	‘‘(4) Temporary restraining orders issued pur-24
59	59	suant to the Federal Rules of Civil Procedure or any 25

64	64	ment of, or compel action with respect to, any stat-2
65	65	ute, regulation, order, executive action, or similar 3
66	66	authority, by the United States or one of the several 4
67	67	States within the meaning of section 1332, an agen-5
68	68	cy thereof, or an officer or employee thereof acting 6
69	69	in an official capacity.’’. 7
70	70	SEC. 4. DECLARATORY JUDGMENTS. 8
71	71	Section 2201(a) of title 28, United States Code, is 9
72	72	amended, in the first sentence, by inserting ‘‘before the 10
73	73	court’’ after ‘‘party’’. 11
74	74	SEC. 5. JUDICIAL REVIEW. 12
75	75	Chapter 7 of title 5, United States Code, is amend-13
76	76	ed— 14
77	77	(1) in section 705, in the second sentence, by 15
78	78	inserting ‘‘limited to a person, as defined in section 16
79	79	551, before the court’’ after ‘‘process’’; and 17
80	80	(2) in section 706— 18
81	81	(A) in the second sentence of the matter 19
82	82	preceding paragraph (1), by inserting ‘‘, limited 20
83	83	to a person, as defined in section 551, before 21
84	84	the court’’ after ‘‘shall’’; and 22
85	85	(B) in paragraph (2), in the matter pre-23
86	86	ceding subparagraph (A), by striking ‘‘and set 24
87	87	aside’’. 25

91	91	SEC. 6. RULE OF CONSTRUCTION. 1
92	92	Nothing in this Act, or an amendment made by this 2
93	93	Act, shall be construed to imply that Federal courts other-3
94	94	wise possess the authority to grant relief that is prohibited 4
95	95	by this Act and the amendments made by this Act. 5
