Be it enacted by the Senate and House of Representa-1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘25th Anniversary of 4 9/11 Commemorative Coin Act’’. 5 SEC. 2. FINDINGS. 6 Congress finds the following: 7 VerDate Sep 11 2014 10:22 Apr 14, 2025 Jkt 000000 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\S1289.IS S1289 mprince on LAP1J3WLY3PROD with $$_JOB 2 •S 1289 IS (1) On September 11, 2001, the United States 1 suffered the deadliest terrorist attacks on United 2 States soil (referred to in this section as ‘‘the at-3 tacks’’). 4 (2) 2,977 people were killed during the attacks, 5 marking the single worst foreign attack on United 6 States soil since Pearl Harbor in 1941. 7 (3) In New York City, 2 planes hit the Twin 8 Towers during the attacks, causing both 110-story 9 towers to collapse in less than 2 hours, as well as 10 destroying 5 other buildings in the World Trade 11 Center complex, leaving a death toll of 2,753 people, 12 including all passengers and crew members of Amer-13 ican Airlines Flight 11 and all passengers and crew 14 members of United Airlines Flight 175. 15 (4) During the attacks, American Airlines 16 Flight 77 struck the side of the Pentagon, killing 17 184 passengers, crew members, and personnel. 18 (5) In Pennsylvania, during the attacks, United 19 Airlines Flight 93 crashed near Shanksville, killing 20 all 40 passengers and crew members. 21 (6) The attacks took the lives of 441 first re-22 sponders in New York, specifically 343 firefighters 23 from the New York City Fire Department, 37 offi-24 cers from the Port Authority Police Department, 23 25 VerDate Sep 11 2014 10:22 Apr 14, 2025 Jkt 000000 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S1289.IS S1289 mprince on LAP1J3WLY3PROD with $$_JOB 3 •S 1289 IS officers from the New York City Police Department, 1 and 38 individuals from other agencies. 2 (7) The collapse of the towers following the at-3 tacks created massive dust clouds that left hundreds 4 of densely populated city blocks covered with harm-5 ful contaminants, exposing first responders, local 6 workers, residents, and students. 7 (8) More than 2 decades after these horrific 8 terrorist attacks took place, the ongoing physical 9 and mental health impacts continue to deeply affect 10 tens of thousands of individuals across the country 11 who were in lower Manhattan and the surrounding 12 area following the attacks, as well as those from 13 around the country who participated in the rescue, 14 recovery, and relief efforts, due to their exposure to 15 the dust, smoke, and debris. Thousands of others 16 have died due to illnesses and injuries relating to the 17 attacks. 18 (9) The National September 11 Memorial and 19 Museum at the World Trade Center is continuously 20 dedicated to remembering, reflecting, and educating 21 for many generations to come so that the story of 22 September 11, 2001, is never forgotten. 23 (10) The National September 11 Memorial and 24 Museum at the World Trade Center is committed to 25 VerDate Sep 11 2014 10:22 Apr 14, 2025 Jkt 000000 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S1289.IS S1289 mprince on LAP1J3WLY3PROD with $$_JOB 4 •S 1289 IS supporting family members, survivors, rescue and re-1 covery workers, and military personnel who were af-2 fected by the attacks by providing services, edu-3 cation, and programming. 4 SEC. 3. COIN SPECIFICATIONS. 5 (a) D ENOMINATIONS.—The Secretary of the Treas-6 ury (referred to in this Act as the ‘‘Secretary’’) shall mint 7 and issue the following coins in commemoration of the 8 25th anniversary of the September 11, 2001, terrorist at-9 tacks on the United States and the establishment of the 10 National September 11 Memorial and Museum at the 11 World Trade Center: 12 (1) $5 GOLD COINS.—Not more than 50,000 $5 13 coins, each of which shall— 14 (A) weigh 8.359 grams; 15 (B) have a diameter of 0.850 inches; and 16 (C) contain not less than 90 percent gold. 17 (2) $1 SILVER COINS.—Not more than 400,000 18 $1 coins, each of which shall— 19 (A) weigh 26.73 grams; 20 (B) have a diameter of 1.500 inches; and 21 (C) contain not less than 90 percent silver. 22 (b) L EGALTENDER.—The coins minted under this 23 Act shall be legal tender, as provided in section 5103 of 24 title 31, United States Code. 25 VerDate Sep 11 2014 10:22 Apr 14, 2025 Jkt 000000 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\S1289.IS S1289 mprince on LAP1J3WLY3PROD with $$_JOB 5 •S 1289 IS (c) NUMISMATICITEMS.—For purposes of sections 1 5134 and 5136 of title 31, United States Code, all coins 2 minted under this Act shall be considered to be numis-3 matic items. 4 SEC. 4. DESIGN OF COINS. 5 (a) D ESIGNREQUIREMENTS.— 6 (1) I N GENERAL.—The designs of the coins 7 minted under this Act shall be emblematic of the 8 courage, sacrifice, and strength of those individuals 9 who perished in the terrorist attacks of September 10 11, 2001, the bravery of those who risked their lives 11 to save others that day, and the endurance, resil-12 ience, and hope of those who survived. At least 1 13 such coin shall bear the inscription ‘‘Never Forget’’. 14 (2) D ESIGNS AND INSCRIPTIONS.—On each coin 15 minted under this Act, there shall be— 16 (A) a designation of the value of the coin; 17 (B) inscriptions of the words ‘‘Liberty’’, 18 ‘‘In God We Trust’’, ‘‘United States of Amer-19 ica’’, and ‘‘E Pluribus Unum’’; and 20 (C) an inscription of the words ‘‘25th An-21 niversary’’. 22 (b) S ELECTION.—The designs for the coins minted 23 under this Act shall be— 24 VerDate Sep 11 2014 10:22 Apr 14, 2025 Jkt 000000 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\S1289.IS S1289 mprince on LAP1J3WLY3PROD with $$_JOB 6 •S 1289 IS (1) selected by the Secretary, after consultation 1 with— 2 (A) the National September 11 Memorial 3 and Museum at the World Trade Center; and 4 (B) the Commission of Fine Arts; and 5 (2) reviewed by the Citizens Coinage Advisory 6 Committee. 7 SEC. 5. ISSUANCE OF COINS. 8 (a) Q UALITY OFCOINS.—The coins minted under 9 this Act shall be issued in uncirculated and proof qualities. 10 (b) S ENSE OFCONGRESS.—It is the sense of Con-11 gress that the coins minted under this Act should be 12 struck at the United States Mint at West Point, New 13 York, to the greatest extent possible. 14 (c) P ERIOD FORISSUANCE.—The Secretary may 15 issue coins minted under this Act only during the 1-year 16 period beginning on January 1, 2027. 17 SEC. 6. SALE OF COINS. 18 (a) S ALEPRICE.—The coins issued under this Act 19 shall be sold by the Secretary at the price equal to the 20 sum of— 21 (1) the face value of the coins; 22 (2) the surcharge provided in section 7(a) with 23 respect to the coins; and 24 VerDate Sep 11 2014 10:22 Apr 14, 2025 Jkt 000000 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\S1289.IS S1289 mprince on LAP1J3WLY3PROD with $$_JOB 7 •S 1289 IS (3) the cost of designing and issuing the coins 1 (including labor, materials, dies, use of machinery, 2 overhead expenses, marketing, and shipping). 3 (b) B ULKSALES.—The Secretary shall make bulk 4 sales of the coins issued under this Act at a reasonable 5 discount. 6 (c) P REPAIDORDERS.— 7 (1) I N GENERAL.—The Secretary shall accept 8 prepaid orders for the coins minted under this Act 9 before the issuance of the coins. 10 (2) D ISCOUNT.—Sale prices with respect to pre-11 paid orders under paragraph (1) shall be at a rea-12 sonable discount. 13 SEC. 7. SURCHARGES. 14 (a) I NGENERAL.—All sales of coins issued under this 15 Act shall include a surcharge of— 16 (1) $35 per coin for the $5 gold coin; and 17 (2) $10 per coin for the $1 silver coin. 18 (b) D ISTRIBUTION.—Subject to section 5134(f)(1) of 19 title 31, United States Code, all surcharges received by 20 the Secretary from the sale of coins issued under this Act 21 shall be promptly paid by the Secretary to the National 22 September 11 Memorial and Museum at the World Trade 23 Center to support the operations and maintenance of the 24 VerDate Sep 11 2014 10:22 Apr 14, 2025 Jkt 000000 PO 00000 Frm 00007 Fmt 6652 Sfmt 6201 E:\BILLS\S1289.IS S1289 mprince on LAP1J3WLY3PROD with $$_JOB 8 •S 1289 IS National September 11 Memorial and Museum at the 1 World Trade Center. 2 (c) A UDITS.—The National September 11 Memorial 3 and Museum at the World Trade Center shall be subject 4 to the audit requirements of section 5134(f)(2) of title 31, 5 United States Code, with regard to the amounts received 6 under subsection (b). 7 (d) L IMITATION.— 8 (1) I N GENERAL.—Notwithstanding subsection 9 (a), no surcharge may be included with respect to 10 the issuance under this Act of any coin during a cal-11 endar year if, as of the time of that issuance, the 12 issuance of that coin would result in the number of 13 commemorative coin programs issued during that 14 year to exceed the annual 2 commemorative coin 15 program issuance limitation under section 16 5112(m)(1) of title 31, United States Code. 17 (2) G UIDANCE.—The Secretary may issue guid-18 ance to carry out this subsection. 19 SEC. 8.
