3030 (a) I
3131 NGENERAL.—Section 214(g)(10) of the Immi-4
3232 gration and Nationality Act (8 U.S.C. 1184(g)(10)) is 5
3333 amended— 6
3434 (1) by striking ‘‘The numerical limitations of 7
3535 paragraph (1)(B)’’ and inserting ‘‘(A) The numer-8
3636 ical limitation under paragraph (1)(B)’’; and 9
3737 (2) by adding at the end the following: 10
3838 ‘‘(B)(i) The numerical limitation under paragraph 11
3939 (1)(B) shall not apply to any nonimmigrant alien issued 12
4040 a visa or otherwise provided status under section 13
4141 101(a)(15)(H)(ii)(b) who is employed (or has received an 14
4242 offer of employment)— 15
4343 ‘‘(I) as a fish roe processor, a fish roe techni-16
4444 cian, or a supervisor of fish roe processing; or 17
4545 ‘‘(II) as a fish processor. 18
4646 ‘‘(ii) As used in clause (i)— 19
4747 ‘‘(I) the term ‘fish’ means fresh or saltwater 20
4848 finfish, mollusks, crustaceans, and all other forms of 21
4949 aquatic animal life, including the roe of such ani-22
5050 mals, other than marine mammals and birds; and 23
5151 ‘‘(II) the term ‘processor’— 24
5252 ‘‘(aa) means any person engaged in the 25
5353 processing of fish, including handling, storing, 26

5858 freezing, changing into different market forms, 2
5959 manufacturing, preserving, packing, labeling, 3
6060 dockside unloading, holding, and all other proc-4
6161 essing activities; and 5
6262 ‘‘(bb) does not include any person engaged 6
6363 in— 7
6464 ‘‘(AA) harvesting or transporting fish 8
6565 or fishery products without otherwise en-9
6666 gaging in processing; 10
6767 ‘‘(BB) practices such as heading, evis-11
6868 cerating, or freezing intended solely to pre-12
6969 pare a fish for holding on board a harvest 13
7070 vessel; or 14
7171 ‘‘(CC) operating a retail establish-15
7272 ment.’’. 16

7474 EPEAL.—Section 14006 of the Department of 17
7575 Defense Appropriations Act, 2005 (Public Law 108–287) 18
7676 is repealed. 19
