EXEMPTION OF ALIENS WORKING AS FISH PROC-1 ESSORS FROM THE NUMERICAL LIMITATION 2 ON H–2B NONIMMIGRANT VISAS. 3 (a) I NGENERAL.—Section 214(g)(10) of the Immi-4 gration and Nationality Act (8 U.S.C. 1184(g)(10)) is 5 amended— 6 (1) by striking ‘‘The numerical limitations of 7 paragraph (1)(B)’’ and inserting ‘‘(A) The numer-8 ical limitation under paragraph (1)(B)’’; and 9 (2) by adding at the end the following: 10 ‘‘(B)(i) The numerical limitation under paragraph 11 (1)(B) shall not apply to any nonimmigrant alien issued 12 a visa or otherwise provided status under section 13 101(a)(15)(H)(ii)(b) who is employed (or has received an 14 offer of employment)— 15 ‘‘(I) as a fish roe processor, a fish roe techni-16 cian, or a supervisor of fish roe processing; or 17 ‘‘(II) as a fish processor. 18 ‘‘(ii) As used in clause (i)— 19 ‘‘(I) the term ‘fish’ means fresh or saltwater 20 finfish, mollusks, crustaceans, and all other forms of 21 aquatic animal life, including the roe of such ani-22 mals, other than marine mammals and birds; and 23 ‘‘(II) the term ‘processor’— 24 ‘‘(aa) means any person engaged in the 25 processing of fish, including handling, storing, 26 VerDate Sep 11 2014 10:25 Apr 14, 2025 Jkt 000000 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S1292.IS S1292 mprince on LAP1J3WLY3PROD with $$_JOB 3 •S 1292 IS preparing, heading, eviscerating, shucking, 1 freezing, changing into different market forms, 2 manufacturing, preserving, packing, labeling, 3 dockside unloading, holding, and all other proc-4 essing activities; and 5 ‘‘(bb) does not include any person engaged 6 in— 7 ‘‘(AA) harvesting or transporting fish 8 or fishery products without otherwise en-9 gaging in processing; 10 ‘‘(BB) practices such as heading, evis-11 cerating, or freezing intended solely to pre-12 pare a fish for holding on board a harvest 13 vessel; or 14 ‘‘(CC) operating a retail establish-15 ment.’’. 16 (b) R EPEAL.—Section 14006 of the Department of 17 Defense Appropriations Act, 2005 (Public Law 108–287) 18 is repealed. 19 Æ VerDate Sep 11 2014 10:25 Apr 14, 2025 Jkt 000000 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\S1292.IS S1292 mprince on LAP1J3WLY3PROD with $$_JOB
