19	19	Be it enacted by the Senate and House of Representa-1
20	20	tives of the United States of America in Congress assembled, 2
21	21	SECTION 1. SHORT TITLE. 3
22	22	This Act may be cited as the ‘‘Smithsonian National 4
23	23	Museum of the American Latino Act’’. 5
24	24	SEC. 2. SITE OF SMITHSONIAN NATIONAL MUSEUM OF THE 6
25	25	AMERICAN LATINO. 7
26	26	(a) A

32	32	(1) IN GENERAL.—Notwithstanding any other 1
33	33	provision of law or regulation, including section 2
34	34	8908(c) of title 40, United States Code, the Smith-3
35	35	sonian National Museum of the American Latino 4
36	36	may be located within the Reserve (as defined in sec-5
37	37	tion 8902(a) of title 40, United States Code). 6

39	39	ONFORMING AMENDMENT .—Section 7
40	40	201(g)(4) of division T of the Consolidated Appro-8
41	41	priations Act, 2021 (20 U.S.C. 80u(g)(4)) is amend-9
42	42	ed by striking ‘‘, except that’’ and all that follows 10
43	43	and inserting a period. 11

46	46	OTHERFEDERALAGENCY.—Section 201(g)(2) of division 13
47	47	T of the Consolidated Appropriations Act, 2021 (20 14
48	48	U.S.C. 80u(g)(2)) is amended to read as follows: 15

50	50	ITE UNDER THE JURISDICTION OF AN -16
51	51	OTHER FEDERAL AGENCY .— 17
52	52	‘‘(A) N
53	53	OTIFICATION TO OTHER AGENCY OR 18
54	54	ENTITY.—The Board of Regents shall not des-19
55	55	ignate a site for the Museum that is under the 20
56	56	administrative jurisdiction of another Federal 21
57	57	agency or entity without first notifying the head 22
58	58	of the Federal agency or entity. 23

60	60	OTIFICATION TO COMMITTEES .— 24
61	61	Once notified under subparagraph (A), the head 25

66	66	submit written notification to the Chair and 2
67	67	ranking minority members of the Committee on 3
68	68	Rules and Administration, the Committee on 4
69	69	Appropriations, and the Committee on Energy 5
70	70	and Natural Resources of the Senate, and the 6
71	71	Committee on House Administration, the Com-7
72	72	mittee on Natural Resources, the Committee on 8
73	73	Transportation and Infrastructure, and the 9
74	74	Committee on Appropriations of the House of 10
75	75	Representatives, stating that the Federal agen-11
76	76	cy or entity was notified by the Board of Re-12
77	77	gents that a site under its jurisdiction was des-13
78	78	ignated and that a transfer will be initiated as 14
79	79	soon as practicable. 15
80	80	‘‘(C) T
81	81	RANSFER.—As soon as practicable 16
82	82	after the date on which the individuals de-17
83	83	scribed in subparagraph (B) receive the written 18
84	84	notification described in such subparagraph, the 19
85	85	head of the Federal agency or entity shall 20
86	86	transfer to the Smithsonian Institution its ad-21
87	87	ministrative jurisdiction over the land or struc-22
88	88	ture that has been designated as the site for the 23
89	89	Museum.’’. 24

103	103	Trustees shall ensure that the exhibits and 9
104	104	programs of the Museum accurately and 10
105	105	comprehensively represent the varied cul-11
106	106	tures, histories, events, and values of His-12
107	107	panic or Latino communities. 13
108	108	‘‘(ii) S
109	109	PECIFIC REQUIREMENTS .—In 14
110	110	carrying out its duties, the Board of Trust-15
111	111	ees shall ensure that it seeks and utilizes 16
112	112	to its maximum ability guidance from a 17
113	113	broad array of knowledgeable and re-18
114	114	spected sources reflecting the diversity of 19
115	115	the political viewpoints and authentic expe-20
116	116	riences held by Hispanics or Latinos in the 21
117	117	United States, and shall seek such guid-22
118	118	ance for both the creation and substantial 23
119	119	revision of exhibits and programs. 24

124	124	graph— 2
125	125	‘‘(I) the term ‘broad array’ 3
126	126	means a range of experts and publica-4
127	127	tions that represent the broad spec-5
128	128	trum of Hispanic or Latino commu-6
129	129	nities, to include varied viewpoints, 7
130	130	political ideologies, cultures, and lived 8
131	131	experiences in the United States; and 9
132	132	‘‘(II) the term ‘knowledgeable 10
133	133	and respected source’ means an indi-11
134	134	vidual who has gained through edu-12
135	135	cation, publication, or witnessing an 13
136	136	important or historical event, the abil-14
137	137	ity to advise on at least one unique 15
138	138	viewpoint or experience of a particular 16
139	139	Hispanic or Latino community, and 17
140	140	whose knowledge has been relied upon 18
141	141	by a notable segment of that commu-19
142	142	nity for education, heritage preserva-20
143	143	tion, or historical purposes, and in-21
144	144	cludes the work of such an individual 22
145	145	which reflects such ability and knowl-23
146	146	edge.’’. 24

150	150	(d) REPORTS TOCONGRESS.—Not later than 120 1
151	151	days after the date of enactment of this Act and every 2
152	152	2 years thereafter, the Secretary of the Smithsonian shall 3
153	153	submit to the Committee on Natural Resources of the 4
154	154	House of Representatives, the Committee on Energy and 5
155	155	Natural Resources of the Senate, the Committee on House 6
156	156	Administration of the House of Representatives, the Com-7
157	157	mittee on Rules and Administration of the Senate, the 8
158	158	Committee on Transportation and Infrastructure of the 9
159	159	House of Representatives, the Committee on Appropria-10
160	160	tions of the House of Representatives, and the Committee 11
161	161	on Appropriations of the Senate, a report on actions taken 12
162	162	by the Director of the Smithsonian National Museum of 13
163	163	the American Latino Museum and the Board of Trustees 14
164	164	of the Museum to comply with the requirements of the 15
165	165	amendments made by subsection (c), including a descrip-16
166	166	tion of actions taken with respect to substantial revisions 17
167	167	of current exhibits and programs as well the planning of 18
168	168	future exhibits and programs. 19
169	169	(e) E
170	170	FFECTIVEDATE.—This section and the amend-20
171	171	ments made by this section shall take effect as if included 21
172	172	in the enactment of section 201 of division T of the Con-22
173	173	solidated Appropriations Act, 2021 (20 U.S.C. 80u). 23
