A BILL 
To permit the Smithsonian National Museum of the Amer-
ican Latino to be located within the Reserve of the 
National Mall, and for other purposes. 
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Smithsonian National 4
Museum of the American Latino Act’’. 5
SEC. 2. SITE OF SMITHSONIAN NATIONAL MUSEUM OF THE 6
AMERICAN LATINO. 7
(a) A

(1) IN GENERAL.—Notwithstanding any other 1
provision of law or regulation, including section 2
8908(c) of title 40, United States Code, the Smith-3
sonian National Museum of the American Latino 4
may be located within the Reserve (as defined in sec-5
tion 8902(a) of title 40, United States Code). 6

ONFORMING AMENDMENT .—Section 7
201(g)(4) of division T of the Consolidated Appro-8
priations Act, 2021 (20 U.S.C. 80u(g)(4)) is amend-9
ed by striking ‘‘, except that’’ and all that follows 10
and inserting a period. 11
(b) U
SE OFSITEUNDER THEJURISDICTION OFAN-12
OTHERFEDERALAGENCY.—Section 201(g)(2) of division 13
T of the Consolidated Appropriations Act, 2021 (20 14
U.S.C. 80u(g)(2)) is amended to read as follows: 15
‘‘(2) S
ITE UNDER THE JURISDICTION OF AN -16
OTHER FEDERAL AGENCY .— 17
‘‘(A) N
OTIFICATION TO OTHER AGENCY OR 18
ENTITY.—The Board of Regents shall not des-19
ignate a site for the Museum that is under the 20
administrative jurisdiction of another Federal 21
agency or entity without first notifying the head 22
of the Federal agency or entity. 23
‘‘(B) N
OTIFICATION TO COMMITTEES .— 24
Once notified under subparagraph (A), the head 25

of the Federal agency or entity shall promptly 1
submit written notification to the Chair and 2
ranking minority members of the Committee on 3
Rules and Administration, the Committee on 4
Appropriations, and the Committee on Energy 5
and Natural Resources of the Senate, and the 6
Committee on House Administration, the Com-7
mittee on Natural Resources, the Committee on 8
Transportation and Infrastructure, and the 9
Committee on Appropriations of the House of 10
Representatives, stating that the Federal agen-11
cy or entity was notified by the Board of Re-12
gents that a site under its jurisdiction was des-13
ignated and that a transfer will be initiated as 14
soon as practicable. 15
‘‘(C) T
RANSFER.—As soon as practicable 16
after the date on which the individuals de-17
scribed in subparagraph (B) receive the written 18
notification described in such subparagraph, the 19
head of the Federal agency or entity shall 20
transfer to the Smithsonian Institution its ad-21
ministrative jurisdiction over the land or struc-22
ture that has been designated as the site for the 23
Museum.’’. 24

POINTS AND AUTHENTIC EXPERIENCES.—Section 2
201(d)(2)(D) of division T of the Consolidated Appropria-3
tions Act, 2021 (20 U.S.C. 80u(d)(2)(D)) is amended to 4
read as follows: 5
‘‘(D) E
NSURING DIVERSITY OF POLITICAL 6
VIEWPOINTS AND AUTHENTIC EXPERIENCES .— 7
‘‘(i) I
N GENERAL.—The Board of 8
Trustees shall ensure that the exhibits and 9
programs of the Museum accurately and 10
comprehensively represent the varied cul-11
tures, histories, events, and values of His-12
panic or Latino communities. 13
‘‘(ii) S
PECIFIC REQUIREMENTS .—In 14
carrying out its duties, the Board of Trust-15
ees shall ensure that it seeks and utilizes 16
to its maximum ability guidance from a 17
broad array of knowledgeable and re-18
spected sources reflecting the diversity of 19
the political viewpoints and authentic expe-20
riences held by Hispanics or Latinos in the 21
United States, and shall seek such guid-22
ance for both the creation and substantial 23
revision of exhibits and programs. 24

‘‘(iii) DEFINITIONS.—In this subpara-1
graph— 2
‘‘(I) the term ‘broad array’ 3
means a range of experts and publica-4
tions that represent the broad spec-5
trum of Hispanic or Latino commu-6
nities, to include varied viewpoints, 7
political ideologies, cultures, and lived 8
experiences in the United States; and 9
‘‘(II) the term ‘knowledgeable 10
and respected source’ means an indi-11
vidual who has gained through edu-12
cation, publication, or witnessing an 13
important or historical event, the abil-14
ity to advise on at least one unique 15
viewpoint or experience of a particular 16
Hispanic or Latino community, and 17
whose knowledge has been relied upon 18
by a notable segment of that commu-19
nity for education, heritage preserva-20
tion, or historical purposes, and in-21
cludes the work of such an individual 22
which reflects such ability and knowl-23
edge.’’. 24

(d) REPORTS TOCONGRESS.—Not later than 120 1
days after the date of enactment of this Act and every 2
2 years thereafter, the Secretary of the Smithsonian shall 3
submit to the Committee on Natural Resources of the 4
House of Representatives, the Committee on Energy and 5
Natural Resources of the Senate, the Committee on House 6
Administration of the House of Representatives, the Com-7
mittee on Rules and Administration of the Senate, the 8
Committee on Transportation and Infrastructure of the 9
House of Representatives, the Committee on Appropria-10
tions of the House of Representatives, and the Committee 11
on Appropriations of the Senate, a report on actions taken 12
by the Director of the Smithsonian National Museum of 13
the American Latino Museum and the Board of Trustees 14
of the Museum to comply with the requirements of the 15
amendments made by subsection (c), including a descrip-16
tion of actions taken with respect to substantial revisions 17
of current exhibits and programs as well the planning of 18
future exhibits and programs. 19
(e) E
FFECTIVEDATE.—This section and the amend-20
ments made by this section shall take effect as if included 21
in the enactment of section 201 of division T of the Con-22
solidated Appropriations Act, 2021 (20 U.S.C. 80u). 23
