3131 EFINITIONS.—Section 2(b) of the Apex Project, 4

3535 striking ‘‘As used in this Act, the following terms 8

5959 TION.—The term ‘Apex Industrial Park Owners As-2
6060 sociation’ means the Apex Industrial Park Owners 3
6161 Association formed on April 9, 2001, and chartered 4
6262 in the State of Nevada (including any successor in 5
6363 interest).’’; and 6

9393 67; 103 Stat. 171) is amended— 6
9494 (1) in subsection (c), by striking ‘‘Clark Coun-7
9595 ty’’ and inserting ‘‘Clark County, the City, or the 8
9696 Apex Industrial Park Owners Association, individ-9
9797 ually or jointly, as appropriate,’’; and 10
9898 (2) in subsection (e), by adding at the end the 11
9999 following: 12

101101 INERALMATERIALSSALE.—Notwithstanding 13
102102 the requirements of part 3600 of title 43, Code of Federal 14
103103 Regulations (as in effect on the date of enactment of the 15
104104 Apex Project, Nevada Land Transfer and Authorization 16
105105 Act Amendments Act), the Secretary may sell, at not less 17
106106 than fair market value, without advertising or calling for 18
107107 bids and without regard to volume or time limitations, 19
108108 mineral materials resulting from grading, land balancing, 20
109109 or other activities on the surface of a parcel of land within 21
110110 the Apex Site for which the United States retains an inter-22
111111 est in the minerals.’’. 23

113113 NVIRONMENTAL CONSIDERATIONS.—Section 6 24
114114 of the Apex Project, Nevada Land Transfer and Author-25

126126 the National Environmental Policy Act of 1969 (42 U.S.C. 8
127127 4321 et seq.) and the Federal Land Policy and Manage-9
128128 ment Act of 1976 (43 U.S.C. 1701 et seq.).’’. 10
