15	15	To amend the Apex Project, Nevada Land Transfer and
16	16	Authorization Act of 1989 to include the city of North
17	17	Las Vegas, Nevada, and the Apex Industrial Park Own-
18	18	ers Association, and for other purposes.
19	19	Be it enacted by the Senate and House of Representa-1
20	20	tives of the United States of America in Congress assembled, 2
21	21	SECTION 1. SHORT TITLE. 3
22	22	This Act may be cited as the ‘‘Apex Project, Nevada 4
23	23	Land Transfer and Authorization Act Amendments Act’’. 5

31	31	EFINITIONS.—Section 2(b) of the Apex Project, 4
32	32	Nevada Land Transfer and Authorization Act of 1989 5
33	33	(Public Law 101–67; 103 Stat. 169) is amended— 6
34	34	(1) in the matter preceding paragraph (1), by 7
35	35	striking ‘‘As used in this Act, the following terms 8
36	36	shall have the following meanings—’’ and inserting 9
37	37	‘‘In this Act:’’; 10
38	38	(2) in each of paragraphs (1), (2), (4), and (5), 11
39	39	by inserting a paragraph heading, the text of which 12
40	40	comprises the term defined in that paragraph; 13
41	41	(3) in paragraph (3), by inserting ‘‘C
42	42	OUNTY; 14
43	43	CLARK COUNTY.—’’ before ‘‘The term’’; 15
44	44	(4) in paragraph (6)— 16
45	45	(A) by inserting ‘‘FLPMA

58	58	‘‘(1) APEX INDUSTRIAL PARK OWNERS ASSOCIA -1
59	59	TION.—The term ‘Apex Industrial Park Owners As-2
60	60	sociation’ means the Apex Industrial Park Owners 3
61	61	Association formed on April 9, 2001, and chartered 4
62	62	in the State of Nevada (including any successor in 5
63	63	interest).’’; and 6
64	64	(7) by inserting after paragraph (2) (as so re-7
65	65	designated) the following: 8
66	66	‘‘(3) C
67	67	ITY.—The term ‘City’ means the city of 9
68	68	North Las Vegas, Nevada.’’. 10

71	71	the Apex Project, Nevada Land Transfer and Authoriza-12
72	72	tion Act of 1989 (Public Law 101–67; 103 Stat. 170) is 13

74	74	(1) in the first sentence— 15
75	75	(A) by striking ‘‘Clark County’’ and insert-16
76	76	ing ‘‘Clark County, the City, or the Apex Indus-17
77	77	trial Park Owners Association, individually or 18
78	78	jointly, as appropriate,’’; and 19
79	79	(B) by striking ‘‘Site’’ and inserting ‘‘Site 20
80	80	and other land conveyed in accordance with this 21
81	81	Act’’; and 22
82	82	(2) in the third sentence, by striking ‘‘Clark 23
83	83	County’’ and inserting ‘‘Clark County, the City, or 24

90	90	UTHORIZATION FOR ADDITIONALTRANS-3
91	91	FERS.—Section 4 of the Apex Project, Nevada Land 4
92	92	Transfer and Authorization Act of 1989 (Public Law 101– 5
93	93	67; 103 Stat. 171) is amended— 6
94	94	(1) in subsection (c), by striking ‘‘Clark Coun-7
95	95	ty’’ and inserting ‘‘Clark County, the City, or the 8
96	96	Apex Industrial Park Owners Association, individ-9
97	97	ually or jointly, as appropriate,’’; and 10
98	98	(2) in subsection (e), by adding at the end the 11
99	99	following: 12
100	100	‘‘(3) M
101	101	INERALMATERIALSSALE.—Notwithstanding 13
102	102	the requirements of part 3600 of title 43, Code of Federal 14
103	103	Regulations (as in effect on the date of enactment of the 15
104	104	Apex Project, Nevada Land Transfer and Authorization 16
105	105	Act Amendments Act), the Secretary may sell, at not less 17
106	106	than fair market value, without advertising or calling for 18
107	107	bids and without regard to volume or time limitations, 19
108	108	mineral materials resulting from grading, land balancing, 20
109	109	or other activities on the surface of a parcel of land within 21
110	110	the Apex Site for which the United States retains an inter-22
111	111	est in the minerals.’’. 23

113	113	NVIRONMENTAL CONSIDERATIONS.—Section 6 24
114	114	of the Apex Project, Nevada Land Transfer and Author-25

124	124	issued pursuant to this Act shall be conditioned on the 6
125	125	compliance with applicable Federal land laws, including 7
126	126	the National Environmental Policy Act of 1969 (42 U.S.C. 8
127	127	4321 et seq.) and the Federal Land Policy and Manage-9
128	128	ment Act of 1976 (43 U.S.C. 1701 et seq.).’’. 10
