To amend the Apex Project, Nevada Land Transfer and
Authorization Act of 1989 to include the city of North
Las Vegas, Nevada, and the Apex Industrial Park Own-
ers Association, and for other purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Apex Project, Nevada 4
Land Transfer and Authorization Act Amendments Act’’. 5

LAND TRANSFER AND AUTHORIZATION ACT 2

(a) D
EFINITIONS.—Section 2(b) of the Apex Project, 4
Nevada Land Transfer and Authorization Act of 1989 5
(Public Law 101–67; 103 Stat. 169) is amended— 6
(1) in the matter preceding paragraph (1), by 7
striking ‘‘As used in this Act, the following terms 8
shall have the following meanings—’’ and inserting 9
‘‘In this Act:’’; 10
(2) in each of paragraphs (1), (2), (4), and (5), 11
by inserting a paragraph heading, the text of which 12
comprises the term defined in that paragraph; 13
(3) in paragraph (3), by inserting ‘‘C
OUNTY; 14
CLARK COUNTY.—’’ before ‘‘The term’’; 15
(4) in paragraph (6)— 16
(A) by inserting ‘‘FLPMA
TERMS.—’’ be-17
fore ‘‘All’’; and 18
(B) by inserting ‘‘(43 U.S.C. 1701 et 19
seq.)’’ before the period at the end; 20

‘‘(1) APEX INDUSTRIAL PARK OWNERS ASSOCIA -1
TION.—The term ‘Apex Industrial Park Owners As-2
sociation’ means the Apex Industrial Park Owners 3
Association formed on April 9, 2001, and chartered 4
in the State of Nevada (including any successor in 5
interest).’’; and 6
(7) by inserting after paragraph (2) (as so re-7
designated) the following: 8
‘‘(3) C
ITY.—The term ‘City’ means the city of 9
North Las Vegas, Nevada.’’. 10
(b) K
ERR-MCGEESITETRANSFER.—Section 3(b) of 11
the Apex Project, Nevada Land Transfer and Authoriza-12
tion Act of 1989 (Public Law 101–67; 103 Stat. 170) is 13
amended— 14
(1) in the first sentence— 15
(A) by striking ‘‘Clark County’’ and insert-16
ing ‘‘Clark County, the City, or the Apex Indus-17
trial Park Owners Association, individually or 18
jointly, as appropriate,’’; and 19
(B) by striking ‘‘Site’’ and inserting ‘‘Site 20
and other land conveyed in accordance with this 21
Act’’; and 22
(2) in the third sentence, by striking ‘‘Clark 23
County’’ and inserting ‘‘Clark County, the City, or 24

vidually or jointly, as appropriate,’’. 2
(c) A
UTHORIZATION FOR ADDITIONALTRANS-3
FERS.—Section 4 of the Apex Project, Nevada Land 4
Transfer and Authorization Act of 1989 (Public Law 101– 5
67; 103 Stat. 171) is amended— 6
(1) in subsection (c), by striking ‘‘Clark Coun-7
ty’’ and inserting ‘‘Clark County, the City, or the 8
Apex Industrial Park Owners Association, individ-9
ually or jointly, as appropriate,’’; and 10
(2) in subsection (e), by adding at the end the 11
following: 12
‘‘(3) M
INERALMATERIALSSALE.—Notwithstanding 13
the requirements of part 3600 of title 43, Code of Federal 14
Regulations (as in effect on the date of enactment of the 15
Apex Project, Nevada Land Transfer and Authorization 16
Act Amendments Act), the Secretary may sell, at not less 17
than fair market value, without advertising or calling for 18
bids and without regard to volume or time limitations, 19
mineral materials resulting from grading, land balancing, 20
or other activities on the surface of a parcel of land within 21
the Apex Site for which the United States retains an inter-22
est in the minerals.’’. 23

NVIRONMENTAL CONSIDERATIONS.—Section 6 24
of the Apex Project, Nevada Land Transfer and Author-25

is amended by adding at the end the following: 2
‘‘(d) C
OMPLIANCEWITHENVIRONMENTAL ASSESS-3
MENTS.—Each transfer by the United States of land or 4
interest in lands within the Apex Site or rights-of-way 5
issued pursuant to this Act shall be conditioned on the 6
compliance with applicable Federal land laws, including 7
the National Environmental Policy Act of 1969 (42 U.S.C. 8
4321 et seq.) and the Federal Land Policy and Manage-9
ment Act of 1976 (43 U.S.C. 1701 et seq.).’’. 10
