100100 ‘‘(2) PERSONAL INJURY SUSTAINED IN THE 1
101101 LINE OF DUTY.— 2
102102 ‘‘(A) I
103103 N GENERAL.—Subject to subpara-3
104104 graph (B), as determined by the Bureau, the 4
105105 exposure of a public safety officer to a car-5
106106 cinogen shall be presumed to constitute a per-6
107107 sonal injury within the meaning of subsection 7
108108 (a) or (b) sustained in the line of duty by the 8
109109 officer and directly and proximately resulting in 9
110110 death or permanent and total disability, if— 10
111111 ‘‘(i) the exposure occurred while the 11
112112 public safety officer was engaged in line of 12
113113 duty action or activity; 13
114114 ‘‘(ii) the public safety officer began 14
115115 serving as a public safety officer not fewer 15
116116 than 5 years before the date of the diag-16
117117 nosis of the public safety officer with an 17
118118 exposure-related cancer; 18
119119 ‘‘(iii) the public safety officer was di-19
120120 agnosed with the exposure-related cancer 20
121121 not more than 15 years after the public 21
122122 safety officer’s last date of active service as 22
123123 a public safety officer; and 23
124124 ‘‘(iv) the exposure-related cancer di-24
125125 rectly and proximately results in the death 25

132132 XCEPTION.—The presumption 3
133133 under subparagraph (A) shall not apply if com-4
134134 petent medical evidence establishes that the ex-5
135135 posure of the public safety officer to the car-6
136136 cinogen was not a substantial contributing fac-7
137137 tor in the death or disability of the public safety 8
138138 officer. 9
139139 ‘‘(3) A
140140 DDITIONAL EXPOSURE -RELATED CAN-10
141141 CERS.— 11
142142 ‘‘(A) I
143143 N GENERAL.—From time to time 12
144144 but not less frequently than once every 3 years, 13
145145 the Director shall— 14
146146 ‘‘(i) review the definition of ‘exposure- 15
147147 related cancer’ under paragraph (1); and 16
148148 ‘‘(ii) if appropriate, update the defini-17
149149 tion, in accordance with this paragraph— 18
150150 ‘‘(I) by rule; or 19
151151 ‘‘(II) by publication in the Fed-20
152152 eral Register or on the public website 21
153153 of the Bureau. 22

171171 VIDENCE.—The competent 9
172172 medical evidence described in clause (i) 10
173173 may include recommendations, risk assess-11
174174 ments, and scientific studies by— 12
175175 ‘‘(I) the National Institute for 13
176176 Occupational Safety and Health; 14
177177 ‘‘(II) the National Toxicology 15
178178 Program; 16
179179 ‘‘(III) the National Academies of 17
180180 Sciences, Engineering, and Medicine; 18
181181 or 19
182182 ‘‘(IV) the International Agency 20
183183 for Research on Cancer. 21
184184 ‘‘(C) P
185185 ETITIONS TO ADD TO THE LIST OF 22
186186 EXPOSURE-RELATED CANCERS.— 23
187187 ‘‘(i) I
188188 N GENERAL.—Any person may 24
189189 petition the Director to add a form of can-25

197197 tion under clause (i) shall provide informa-4
198198 tion to show that there is sufficient com-5
199199 petent medical evidence of significant risk 6
200200 to public safety officers of developing the 7
201201 cancer from engagement in their public 8
202202 safety activities. 9
203203 ‘‘(iii) T
204204 IMELY AND SUBSTANTIVE DE -10
205205 CISIONS.— 11
206206 ‘‘(I) R
207207 EFERRAL.—Not later than 12
208208 180 days after receipt of a petition 13
209209 satisfying clause (ii), the Director 14
210210 shall refer the petition to appropriate 15
211211 medical experts for review, analysis 16
212212 (including risk assessment and sci-17
213213 entific study), and recommendation. 18
214214 ‘‘(II) C
215215 ONSIDERATION.—The Di-19
216216 rector shall consider each rec-20
217217 ommendation under subclause (I) and 21
218218 promptly take appropriate action in 22
219219 connection with the recommendation 23
220220 pursuant to subparagraph (B). 24

225225 Not later than 30 days after taking any 2
226226 substantive action in connection with a rec-3
227227 ommendation under clause (iii)(II), the Di-4
228228 rector shall notify the Committee on the 5
229229 Judiciary of the Senate and the Committee 6
230230 on the Judiciary of the House of Rep-7
231231 resentatives of the substantive action.’’. 8
232232 (2) A
233233 PPLICABILITY.—The amendment made by 9
234234 paragraph (1) shall apply to any claim under— 10
235235 (A) section 1201(a) of title I of the Omni-11
236236 bus Crime Control and Safe Streets Act of 12
237237 1968 (34 U.S.C. 10281(a)) that is predicated 13
238238 upon the death of a public safety officer on or 14
239239 after January 1, 2020, that is the direct and 15
240240 proximate result of an exposure-related cancer; 16
241241 or 17
242242 (B) section 1201(b) of title I of the Omni-18
243243 bus Crime Control and Safe Streets Act of 19
244244 1968 (34 U.S.C. 10281(b)) that is filed on or 20
245245 after January 1, 2020, and predicated upon a 21
246246 disability that is the direct and proximate result 22
247247 of an exposure-related cancer. 23

249249 IME FOR FILING CLAIM.—Notwithstanding 24
250250 any other provision of law, an individual who desires 25

255255 ment made by paragraph (1) shall not be precluded 2
256256 from filing such a claim within 3 years of the date 3

259259 ONFIDENTIALITY OFINFORMATION.— 5
260260 (1) I
261261 N GENERAL.—Section 812(a) of title I of 6
262262 the Omnibus Crime Control and Safe Streets Act of 7
263263 1968 (34 U.S.C. 10231(a)) is amended— 8
264264 (A) in the first sentence, by striking ‘‘fur-9
265265 nished under this title by any person and iden-10
266266 tifiable to any specific private person’’ and in-11
267267 serting ‘‘furnished under any law to any compo-12
268268 nent of the Office of Justice Programs, or fur-13
269269 nished otherwise under this title, by any entity 14
270270 or person, including any information identifi-15
271271 able to any specific private person,’’; and 16
272272 (B) in the second sentence, by striking 17
273273 ‘‘person furnishing such information’’ and in-18
274274 serting ‘‘entity or person furnishing such infor-19
275275 mation or to whom such information pertains’’. 20
276276 (2) E
277277 FFECTIVE DATE; APPLICABILITY.—The 21
278278 amendments made by paragraph (1) shall— 22
279279 (A) shall take effect for all purposes as if 23
280280 enacted on December 27, 1979; and 24

293293 (A) in subparagraph (A), by inserting ‘‘or 8
294294 (b)’’ after ‘‘subsection (a)’’; 9
295295 (B) in subparagraph (B), by inserting ‘‘or 10
296296 (b)’’ after ‘‘subsection (a)’’; and 11
297297 (C) in subparagraph (C), by inserting ‘‘or 12
298298 (b)’’ after ‘‘subsection (a)’’. 13

300300 PPLICABILITY.—The amendments made 14
301301 by paragraph (1) shall apply to any matter pending 15
302302 before the Department of Justice as of the date of 16
303303 enactment of this Act. 17
304304 SEC. 3. TECHNICAL AMENDMENTS. 18

306306 NGENERAL.—Section 3 of the Safeguarding 19
307307 America’s First Responders Act of 2020 (34 U.S.C. 20
308308 10281 note) is amended by adding at the end the fol-21

312312 duty action’ includes any action— 24

324324 N GENERAL.—The amendment made by 7
325325 subsection (a) shall apply to any claim under section 8
326326 3 of the Safeguarding America’s First Responders 9
327327 Act of 2020 (34 U.S.C. 10281 note)— 10
328328 (A) that is predicated upon the death of a 11
329329 public safety officer on or after January 1, 12
330330 2020; or 13
331331 (B) that is— 14
332332 (i) predicated upon the disability of a 15
333333 public safety officer; and 16
334334 (ii) filed on or after January 1, 2020. 17

336336 IME FOR FILING CLAIM.—Notwithstanding 18
337337 any other provision of law, an individual who desires 19
338338 to file a claim that is predicated upon the amend-20
339339 ment made by subsection (a) shall not be precluded 21
