29	29	To prohibit the application of certain restrictive eligibility
30	30	requirements to foreign nongovernmental organizations
31	31	with respect to the provision of assistance under part
32	32	I of the Foreign Assistance Act of 1961.
33	33	Be it enacted by the Senate and House of Representa-1
34	34	tives of the United States of America in Congress assembled, 2

38	38	SECTION 1. SHORT TITLE. 1
39	39	This Act may be cited as the ‘‘Global Health, Em-2
40	40	powerment and Rights Act’’. 3
41	41	SEC. 2. ASSISTANCE FOR FOREIGN NONGOVERNMENTAL 4
42	42	ORGANIZATIONS UNDER PART I OF THE FOR-5
43	43	EIGN ASSISTANCE ACT OF 1961. 6
44	44	Notwithstanding any other provision of law, regula-7
45	45	tion, or policy, in determining eligibility for assistance au-8
46	46	thorized under part I of the Foreign Assistance Act of 9
47	47	1961 (22 U.S.C. 2151 et seq.), foreign nongovernmental 10
48	48	organizations— 11
49	49	(1) shall not be ineligible for such assistance 12
50	50	solely on the basis of health or medical services, in-13
51	51	cluding counseling and referral services, provided by 14
52	52	such organizations with non-United States Govern-15
53	53	ment funds if such services do not violate the laws 16
54	54	of the country in which they are being provided and 17
55	55	would not violate United States Federal law if pro-18
56	56	vided in the United States; and 19
57	57	(2) shall not be subject to requirements relating 20
58	58	to the use of non-United States Government funds 21
59	59	for advocacy and lobbying activities other than those 22
60	60	that apply to United States nongovernmental organi-23
61	61	zations receiving assistance under part I of such 24
62	62	Act. 25
