3939 This Act may be cited as the ‘‘Global Health, Em-2
4040 powerment and Rights Act’’. 3
4141 SEC. 2. ASSISTANCE FOR FOREIGN NONGOVERNMENTAL 4
4242 ORGANIZATIONS UNDER PART I OF THE FOR-5
4343 EIGN ASSISTANCE ACT OF 1961. 6
4444 Notwithstanding any other provision of law, regula-7
4545 tion, or policy, in determining eligibility for assistance au-8
4646 thorized under part I of the Foreign Assistance Act of 9
4747 1961 (22 U.S.C. 2151 et seq.), foreign nongovernmental 10
4848 organizations— 11
4949 (1) shall not be ineligible for such assistance 12
5050 solely on the basis of health or medical services, in-13
5151 cluding counseling and referral services, provided by 14
5252 such organizations with non-United States Govern-15
5353 ment funds if such services do not violate the laws 16
5454 of the country in which they are being provided and 17
5555 would not violate United States Federal law if pro-18
5656 vided in the United States; and 19
5757 (2) shall not be subject to requirements relating 20
5858 to the use of non-United States Government funds 21
5959 for advocacy and lobbying activities other than those 22
6060 that apply to United States nongovernmental organi-23
6161 zations receiving assistance under part I of such 24
6262 Act. 25
