5757 RATE BASED ON PERCENTAGE OF OVERPAY -2
5858 MENTS RECOUPED .—In determining the liabil-3
5959 ity amount of a State agency under subpara-4
6060 graph (C) for fiscal year 2025 and each fiscal 5
6161 year thereafter, the payment error rate de-6
6262 scribed in clause (ii)(I) of that subparagraph 7
6363 shall be equal to the product obtained by multi-8
6464 plying— 9
6565 ‘‘(i) the payment error rate of the 10
6666 State agency for that fiscal year; and 11
6767 ‘‘(ii) the percentage of the total 12
6868 amount of overpayments of benefits made 13
6969 by the State agency that are not recouped 14
7070 by the State agency under paragraph (9) 15
7171 for that fiscal year.’’; 16
7272 (2) by redesignating paragraph (9) as para-17
