A BILL
To amend the Food and Nutrition Act of 2008 to improve
the calculation and reduce the taxpayer cost of payment
errors under the supplemental nutrition assistance pro-
gram, and for other purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Snap Back Inaccurate 4
SNAP Payments Act’’. 5

SEC. 2. QUALITY CONTROL SYSTEM TOLERANCE LEVEL 1
FOR EXCLUDING SMALL ERRORS. 2
Section 16(c) of the Food and Nutrition Act of 2008 3
(7 U.S.C. 2025(c)) is amended— 4
(1) in paragraph (1)— 5
(A) in subparagraph (A)(ii)— 6
(i) in subclause (I), by striking ‘‘and’’ 7
at the end; 8
(ii) in subclause (II)— 9
(I) by inserting ‘‘through fiscal 10
year 2024’’ after ‘‘thereafter’’; and 11
(II) by striking the period at the 12
end and inserting ‘‘; and’’; and 13
(iii) by adding at the end the fol-14
lowing: 15
‘‘(III) for fiscal year 2025 and 16
each fiscal year thereafter, $0.’’; 17
(B) in subparagraph (C)— 18
(i) in the matter preceding clause (i), 19
by striking ‘‘may’’ and inserting ‘‘shall’’; 20
(ii) in clause (ii)(I), by inserting ‘‘, as 21
adjusted under subparagraph (H), if appli-22
cable’’ after ‘‘agency’’; and 23
(iii) in clause (iii), by striking ‘‘10’’ 24
and inserting ‘‘25’’; and 25
(C) by adding at the end the following: 26

‘‘(H) REDUCTION OF PAYMENT ERROR 1
RATE BASED ON PERCENTAGE OF OVERPAY -2
MENTS RECOUPED .—In determining the liabil-3
ity amount of a State agency under subpara-4
graph (C) for fiscal year 2025 and each fiscal 5
year thereafter, the payment error rate de-6
scribed in clause (ii)(I) of that subparagraph 7
shall be equal to the product obtained by multi-8
plying— 9
‘‘(i) the payment error rate of the 10
State agency for that fiscal year; and 11
‘‘(ii) the percentage of the total 12
amount of overpayments of benefits made 13
by the State agency that are not recouped 14
by the State agency under paragraph (9) 15
for that fiscal year.’’; 16
(2) by redesignating paragraph (9) as para-17
graph (10); and 18
(3) by inserting after paragraph (8) the fol-19
lowing: 20
‘‘(9) R
ECOUPMENT OF OVERPAYMENTS .—Each 21
State agency shall seek to recoup any overpayments 22
of benefits made to benefit recipients.’’. 23
