4747 Individuals with Disabilities Education Improvement 14
4848 Act of 2004 (Public Law 108–446; 118 Stat. 2647) 15
4949 committed Congress to providing 40 percent of the 16
5050 national current average per-pupil expenditure for 17

267267 MOUNT.—With respect to each subpara-8

270270 ‘‘(A) the total number of children with dis-11
271271 abilities in all States who— 12
272272 ‘‘(i) received special education and re-13
273273 lated services during the last school year 14
274274 that concluded before the first day of the 15
275275 fiscal year for which the determination is 16
276276 made; and 17
277277 ‘‘(ii) were aged— 18
278278 ‘‘(I) 3 through 5 (with respect to 19
279279 the States that were eligible for 20
280280 grants under section 619); and 21
281281 ‘‘(II) 6 through 21; and 22
282282 ‘‘(B) the average per-pupil expenditure in 23
283283 public elementary schools and secondary schools 24
284284 in the United States.’’. 25

297297 an emergency requirement pursuant to section 4001(a)(1) 8
