LIMITATIONS ON PROVISION OF INCENTIVES FOR 1 CRITICAL SKILLS TO SENIOR EXECUTIVE 2 SERVICE EMPLOYEES OF DEPARTMENT OF 3 VETERANS AFFAIRS. 4 Section 706(d) of title 38, United States Code, is 5 amended by adding at the end the following: 6 ‘‘(7)(A) Subject to subparagraph (B)(ii), a critical 7 skill incentive may not be provided under paragraph (1) 8 to an employee of the Department employed in a Senior 9 Executive Service position, or a position in another com-10 parable system for senior-level Government employees, as 11 defined by the Secretary, whose position is at the Central 12 Office of the Department, including the Veterans Health 13 Administration, the Veterans Benefits Administration, 14 and the National Cemetery Administration, regardless of 15 the actual location where the employee performs the func-16 tions of the position. 17 ‘‘(B)(i) A critical skill incentive provided under para-18 graph (1) to an employee of the Department employed in 19 a Senior Executive Service position, or a position in an-20 other comparable system for senior-level Government em-21 ployees, as defined by the Secretary, not described in sub-22 paragraph (A) of this paragraph may only be provided— 23 ‘‘(I) on an individual basis and may not be pro-24 vided to a group of such employees; and 25 VerDate Sep 11 2014 00:03 Mar 01, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S396.IS S396 kjohnson on DSK7ZCZBW3PROD with $$_JOB 3 •S 396 IS ‘‘(II) upon approval of the following officers or 1 those serving in an acting capacity: 2 ‘‘(aa) The Under Secretary for Benefits, 3 the Under Secretary for Health, or the Under 4 Secretary for Memorial Affairs. 5 ‘‘(bb) The Assistant Secretary for Human 6 Resources and Administration. 7 ‘‘(cc) The Director of the Office of Man-8 agement or the Chief Financial Officer. 9 ‘‘(dd) The Assistant Secretary for Ac-10 countability and Whistleblower Protection. 11 ‘‘(ee) The General Counsel. 12 ‘‘(ff) Such other officers as the Secretary 13 determines appropriate. 14 ‘‘(ii) In the case of an employee of the Department 15 employed in a Senior Executive Service position, or a posi-16 tion in another comparable system for senior-level Govern-17 ment employees, as defined by the Secretary, whose posi-18 tion is primarily at the Central Office of the Department, 19 but who performs some portion of the employee’s job func-20 tion at other facilities of the Department, as defined by 21 the Secretary, not at Central Office— 22 ‘‘(I) the employee shall not be considered de-23 scribed in subparagraph (A) with respect to the por-24 tion of the employee’s job function that is based out 25 VerDate Sep 11 2014 00:03 Mar 01, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S396.IS S396 kjohnson on DSK7ZCZBW3PROD with $$_JOB 4 •S 396 IS of non-Central Office facilities of the Department; 1 and 2 ‘‘(II) any critical skill incentive provided under 3 paragraph (1) to the employee for the portion of the 4 employee’s job function that is based out of facilities 5 of the Department other than the Central Office 6 shall be proportionate to the time spent at those De-7 partment facilities. 8 ‘‘(C)(i) Not later than one year after the date of the 9 enactment of the Stop Government Rewards Enriching 10 Executives in the District Act of 2025, and not less fre-11 quently than once each year thereafter, the Secretary shall 12 submit to the Committee on Veterans’ Affairs of the Sen-13 ate and the Committee on Veterans’ Affairs of the House 14 of Representatives an annual report on the employees of 15 the Department employed in a Senior Executive Service 16 position, or a position in another comparable system for 17 senior-level Government employees, as defined by the Sec-18 retary, who were provided a critical skill incentive under 19 paragraph (1). 20 ‘‘(ii) Reports submitted pursuant to clause (i) may 21 be submitted by incorporating their contents into other 22 congressionally mandated reports to the committees de-23 scribed in such clause. 24 VerDate Sep 11 2014 00:03 Mar 01, 2025 Jkt 059200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\S396.IS S396 kjohnson on DSK7ZCZBW3PROD with $$_JOB 5 •S 396 IS ‘‘(D) In this paragraph, the term ‘Senior Executive 1 Service position’ has the meaning given such term in sec-2 tion 3132(a) of title 5.’’. 3 Æ VerDate Sep 11 2014 00:03 Mar 01, 2025 Jkt 059200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6301 E:\BILLS\S396.IS S396 kjohnson on DSK7ZCZBW3PROD with $$_JOB
