2020 This Act may be cited as the ‘‘Ensuring Coast Guard 4
2121 Readiness Act’’. 5

2828 (a) I
2929 NGENERAL.—Subsection (b) of section 1151 of 4
3030 title 14, United States Code, is amended to read as fol-5
3131 lows: 6
3232 ‘‘(b)(1) The President may authorize exceptions to 7
3333 the prohibition in subsection (a) when the President deter-8
3434 mines that it is in the national security interest of the 9
3535 United States to do so, provided that— 10
3636 ‘‘(A) the foreign shipyard concerned is located 11
3737 in a North Atlantic Treaty Organization member 12
3838 country or a country in the Indo-Pacific region that 13
3939 is party to a mutual defense treaty with the United 14
4040 States; and 15
4141 ‘‘(B) the cost of the construction concerned is 16
4242 less than the cost would be if such construction oc-17
4343 curred in a domestic shipyard. 18
4444 ‘‘(2) The President shall transmit notice to Congress 19
4545 of any such determination, and no contract may be made 20
4646 pursuant to the exception authorized until the end of the 21
4747 30-day period beginning on the date the notice of such 22
4848 determination is received by Congress. 23
4949 ‘‘(3) Before the construction of a Coast Guard vessel, 24
5050 or a major component of the hull or superstructure of a 25
5151 Coast Guard vessel, may commence at a foreign shipyard 26

5555 pursuant to this subsection, the Commandant shall submit 1
5656 to Congress a certification that the foreign shipyard is not 2
5757 owned or operated by a Chinese company or a multi-3
5858 national company domiciled in the People’s Republic of 4
5959 China.’’. 5

6262 title 10, United States Code, is amended by inserting ‘‘and 7
6363 section 1151(b) of title 14’’ after ‘‘in subsection (b)’’. 8
