EXCEPTION TO PROHIBITION ON CONSTRUCTION 1 OF COAST GUARD VESSELS IN FOREIGN SHIP-2 YARDS. 3 (a) I NGENERAL.—Subsection (b) of section 1151 of 4 title 14, United States Code, is amended to read as fol-5 lows: 6 ‘‘(b)(1) The President may authorize exceptions to 7 the prohibition in subsection (a) when the President deter-8 mines that it is in the national security interest of the 9 United States to do so, provided that— 10 ‘‘(A) the foreign shipyard concerned is located 11 in a North Atlantic Treaty Organization member 12 country or a country in the Indo-Pacific region that 13 is party to a mutual defense treaty with the United 14 States; and 15 ‘‘(B) the cost of the construction concerned is 16 less than the cost would be if such construction oc-17 curred in a domestic shipyard. 18 ‘‘(2) The President shall transmit notice to Congress 19 of any such determination, and no contract may be made 20 pursuant to the exception authorized until the end of the 21 30-day period beginning on the date the notice of such 22 determination is received by Congress. 23 ‘‘(3) Before the construction of a Coast Guard vessel, 24 or a major component of the hull or superstructure of a 25 Coast Guard vessel, may commence at a foreign shipyard 26 VerDate Sep 11 2014 22:22 Mar 04, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S407.IS S407 kjohnson on DSK7ZCZBW3PROD with $$_JOB 3 •S 407 IS pursuant to this subsection, the Commandant shall submit 1 to Congress a certification that the foreign shipyard is not 2 owned or operated by a Chinese company or a multi-3 national company domiciled in the People’s Republic of 4 China.’’. 5 (b) C ONFORMINGAMENDMENT.—Section 8679(a) of 6 title 10, United States Code, is amended by inserting ‘‘and 7 section 1151(b) of title 14’’ after ‘‘in subsection (b)’’. 8 Æ VerDate Sep 11 2014 22:22 Mar 04, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\S407.IS S407 kjohnson on DSK7ZCZBW3PROD with $$_JOB
