SHORT TITLE. 3 This Act may be cited as the ‘‘Ensuring Account-4 ability and Dignity in Government Contracting Act of 5 2025’’. 6 SEC. 2. MODIFICATIONS TO ENDING TRAFFICKING IN GOV-7 ERNMENT CONTRACTING. 8 (a) C OMPLIANCEPLAN ANDCERTIFICATIONRE-9 QUIREMENT.—Section 1703 of the National Defense Au-10 VerDate Sep 11 2014 23:43 Mar 04, 2025 Jkt 059200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\S426.IS S426 kjohnson on DSK7ZCZBW3PROD with $$_JOB 2 •S 426 IS thorization Act for Fiscal Year 2013 (22 U.S.C. 7104a) 1 is amended— 2 (1) in subsection (c), by striking ‘‘upon re-3 quest’’ and inserting ‘‘at the time each certification 4 required under subsection (a) is made and upon re-5 quest’’; and 6 (2) by adding at the end the following new sub-7 section: 8 ‘‘(e) I NCIDENTREPORTING.—If, after a grant, con-9 tract, or cooperative agreement is provided or entered into, 10 the duly designated representative of the recipient deter-11 mines that the recipient, subcontractor or subgrantee, or 12 agent of the recipient or of a subcontractor or subgrantee 13 has engaged in any of the activities described in section 14 106(g) of the Trafficking Victims Protection Act of 2000 15 (22 U.S.C. 7104(g)) during the term of the grant, con-16 tract, or cooperative agreement, the representative shall 17 promptly submit to the relevant contracting or grant offi-18 cer a report that describes the circumstances relating to 19 such activities and the remedial actions taken to address 20 such activities.’’. 21 (b) M ONITORING AND INVESTIGATION OF TRAF-22 FICKING INPERSONS.—Section 1704 of the National De-23 fense Authorization Act for Fiscal Year 2013 (22 U.S.C. 24 7104b) is amended— 25 VerDate Sep 11 2014 23:43 Mar 04, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S426.IS S426 kjohnson on DSK7ZCZBW3PROD with $$_JOB 3 •S 426 IS (1) in subsection (a)(2), by inserting after the 1 first sentence the following: ‘‘In the event that a 2 duly designated representative of the recipient sub-3 mits a report described in section 1703(e), the In-4 spector General shall conduct an investigation of the 5 activities and remedial actions described in the re-6 port.’’; 7 (2) in subsection (b), by adding at the end the 8 following: ‘‘If the rationale for not completing an in-9 vestigation includes that a recipient acknowledged 10 the activity occurred and has, according to the In-11 spector General, taken appropriate corrective action 12 to remediate it, the Inspector General shall notify 13 the head of the executive agency that awarded the 14 contract, grant, or cooperative agreement and the 15 relevant agency suspension and debarment official.’’; 16 and 17 (3) in subsection (c)(1)— 18 (A) in the matter preceding subparagraph 19 (A)— 20 (i) by striking ‘‘, as amended by sec-21 tion 1702,’’ and inserting ‘‘or failed to 22 take appropriate corrective action to ad-23 dress such activities,’’; and 24 VerDate Sep 11 2014 23:43 Mar 04, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S426.IS S426 kjohnson on DSK7ZCZBW3PROD with $$_JOB 4 •S 426 IS (ii) by inserting ‘‘, suspend payments 1 under the grant, contract, or cooperative 2 agreement until the recipient has taken ap-3 propriate remedial action,’’ after ‘‘debar-4 ment official’’; 5 (B) by striking subparagraph (C); and 6 (C) by redesignating subparagraphs (D), 7 (E), and (F) as subparagraphs (C), (D), and 8 (E), respectively. 9 SEC. 3. OFFICE OF MANAGEMENT AND BUDGET REPORT. 10 Not later than 18 months after the date of the enact-11 ment of this Act, the Director of the Office of Manage-12 ment and Budget shall submit to Congress a report on 13 the feasibility of— 14 (1) amending section 1703 of the National De-15 fense Authorization Act for Fiscal Year 2013 (22 16 U.S.C. 7104a), as amended by section 2(a) of this 17 Act, to require contracting officials, including those 18 at the Department of Homeland Security, the De-19 partment of Defense, the Department of State, and 20 the United States Agency for International Develop-21 ment, to assess compliance of contractor anti-traf-22 ficking plans for product and service categories and 23 geographic locations that Federal agencies identify 24 as higher risk for human trafficking; 25 VerDate Sep 11 2014 23:43 Mar 04, 2025 Jkt 059200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\S426.IS S426 kjohnson on DSK7ZCZBW3PROD with $$_JOB 5 •S 426 IS (2) streamlining agency reporting required by 1 Federal trafficking victims protection laws to pro-2 mote efficiency while meeting congressional informa-3 tion needs; and 4 (3) requiring Federal agencies, such as the De-5 partment of Homeland Security, the Department of 6 Defense, the Department of State, and the United 7 States Agency for International Development, to 8 track and report whether contracting personnel have 9 taken anti-trafficking acquisition training explaining 10 their responsibilities to combat human trafficking. 11 Æ VerDate Sep 11 2014 23:43 Mar 04, 2025 Jkt 059200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6301 E:\BILLS\S426.IS S426 kjohnson on DSK7ZCZBW3PROD with $$_JOB
