Be it enacted by the Senate and House of Representa-1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Fort Ontario Holo-4 caust Refugee Shelter National Historical Park Establish-5 ment Act’’. 6 SEC. 2. DEFINITIONS. 7 In this Act: 8 VerDate Sep 11 2014 00:57 Mar 05, 2025 Jkt 059200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\S432.IS S432 ssavage on LAPJG3WLY3PROD with BILLS 2 •S 432 IS (1) MAP.—The term ‘‘map’’ means the map en-1 titled ‘‘Fort Ontario Holocaust Refugee Shelter Na-2 tional Historical Park Proposed Boundary’’, num-3 bered 962/194,681, and dated September 2024. 4 (2) N ATIONAL HISTORICAL PARK .—The term 5 ‘‘National Historical Park’’ means the Fort Ontario 6 Holocaust Refugee Shelter National Historical Park 7 established by section 3(a)(1). 8 (3) S ECRETARY.—The term ‘‘Secretary’’ means 9 the Secretary of the Interior. 10 (4) S TATE.—The term ‘‘State’’ means the State 11 of New York. 12 SEC. 3. ESTABLISHMENT OF FORT ONTARIO HOLOCAUST 13 REFUGEE SHELTER NATIONAL HISTORICAL 14 PARK. 15 (a) E STABLISHMENT.— 16 (1) I N GENERAL.—Subject to paragraph (3), 17 there is established in the State as a unit of the Na-18 tional Park System the Fort Ontario Holocaust Ref-19 ugee Shelter National Historical Park. 20 (2) P URPOSE.—The purpose of the National 21 Historical Park is to preserve, protect, and interpret 22 for the benefit of present and future generations re-23 sources associated with the stories of the 982 refu-24 gees from World War II who were housed at Fort 25 VerDate Sep 11 2014 00:57 Mar 05, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S432.IS S432 ssavage on LAPJG3WLY3PROD with BILLS 3 •S 432 IS Ontario from August of 1944 until February of 1 1946. 2 (3) C ONDITIONS OF ESTABLISHMENT .— 3 (A) D ETERMINATION BY THE SEC -4 RETARY.—The National Historical Park shall 5 not be established until the date on which the 6 Secretary determines that a sufficient quantity 7 of land or interests in land has been acquired 8 from land identified as ‘‘Proposed Boundary’’ 9 on the map to constitute a manageable park 10 unit. 11 (B) N OTICE.—Not later than 30 days 12 after the date on which the Secretary makes a 13 determination under subparagraph (A), the 14 Secretary shall publish in the Federal Register 15 notice of the establishment of the National His-16 torical Park. 17 (4) M AP.—The map shall be on file and avail-18 able for public inspection in the appropriate offices 19 of the National Park Service. 20 (5) B OUNDARY.—The boundary of the National 21 Historical Park shall include any land or interests in 22 land acquired by the Secretary under this section. 23 (b) A DMINISTRATION.— 24 VerDate Sep 11 2014 00:57 Mar 05, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S432.IS S432 ssavage on LAPJG3WLY3PROD with BILLS 4 •S 432 IS (1) IN GENERAL.—The Secretary shall admin-1 ister the National Historical Park in accordance 2 with— 3 (A) this section; and 4 (B) the laws generally applicable to units 5 of the National Park System, including— 6 (i) sections 100101(a), 100751(a), 7 100752, 100753, and 102101 of title 54, 8 United States Code; and 9 (ii) chapters 1003 and 3201 of title 10 54, United States Code. 11 (2) A GREEMENTS.— 12 (A) C OOPERATIVE AGREEMENTS .—In ac-13 cordance with section 101702 of title 54, 14 United States Code, the Secretary may enter 15 into cooperative agreements with the State or 16 other public and private entities to provide in-17 terpretive and educational services within the 18 National Historical Park. 19 (B) I NTERPRETATION AND RESTORATION 20 AGREEMENTS.—The Secretary may enter into 21 agreements to identify, interpret, and restore 22 nationally significant historic or cultural re-23 sources located on non-Federal land within the 24 VerDate Sep 11 2014 00:57 Mar 05, 2025 Jkt 059200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\S432.IS S432 ssavage on LAPJG3WLY3PROD with BILLS 5 •S 432 IS boundary of, or in close proximity to, the Na-1 tional Historical Park. 2 (C) P UBLIC ACCESS.—Any cooperative 3 agreement entered into under subparagraph (B) 4 to provide assistance to non-Federal land shall 5 provide for reasonable public access to the non- 6 Federal land. 7 (3) A CQUISITION OF LAND.— 8 (A) I N GENERAL.—Subject to subpara-9 graph (B), the Secretary may acquire land and 10 interests in land located within the boundary of 11 the National Historical Park by— 12 (i) donation; 13 (ii) purchase with donated or appro-14 priated funds; or 15 (iii) exchange. 16 (B) L IMITATION.—Any land owned by the 17 State or a political subdivision of the State may 18 be acquired for inclusion in the National His-19 torical Park only by donation. 20 (4) M ANAGEMENT PLAN .—Not later than 3 fis-21 cal years after the date on which funds are made 22 available to carry out this section, the Secretary, in 23 consultation with the State, shall complete a general 24 VerDate Sep 11 2014 00:57 Mar 05, 2025 Jkt 059200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\S432.IS S432 ssavage on LAPJG3WLY3PROD with BILLS 6 •S 432 IS management plan for the National Historical Park 1 in accordance with— 2 (A) section 100502 of title 54, United 3 States Code; and 4 (B) any other applicable laws. 5 Æ VerDate Sep 11 2014 00:57 Mar 05, 2025 Jkt 059200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6301 E:\BILLS\S432.IS S432 ssavage on LAPJG3WLY3PROD with BILLS
