6565 term ‘‘economically distressed area’’ means an area 8
6666 that meets 1 or more of the requirements described 9
6767 in section 301(a) of the Public Works and Economic 10
6868 Development Act of 1965 (42 U.S.C. 3161(a)). 11

7070 URAL AREA.—The term ‘‘rural area’’ 12
7171 means an area located outside a metropolitan statis-13
7272 tical area, as designated by the Office of Manage-14

7575 ECRETARY.—The term ‘‘Secretary’’ means 16

7878 STABLISHMENT.—Not later than 180 days after 18
7979 the date of enactment of this Act, the Secretary, in con-19
8080 sultation with the Secretary of Labor, the Secretary of De-20
8181 fense, the Secretary of Energy, the United States Trade 21
8282 Representative, and the Secretary of Education, shall es-22
8383 tablish within the Department of Commerce the National 23
8484 Manufacturing Advisory Council. 24

8888 (c) MISSION.—The mission of the Advisory Council 1
8989 shall be to— 2
9090 (1) provide a forum for— 3
9191 (A) regular communication between the 4
9292 Federal Government and the manufacturing 5
9393 sector, including manufacturing workers, in the 6
9494 United States; and 7
9595 (B) discussing and proposing solutions to 8
9696 problems relating to the manufacturing sector 9
9797 in the United States, including the manufac-10
9898 turing workforce, supply chain interruptions, 11
9999 and regulatory and other logistical challenges; 12
100100 (2) advise the Secretary regarding policies and 13
101101 programs of the Federal Government that affect 14
102102 manufacturing, including the manufacturing work-15
103103 force, in the United States; and 16
104104 (3) annually produce a national strategic plan, 17
105105 as described in subsection (g), that provides rec-18
106106 ommendations to the Secretary and the appropriate 19
107107 committees of Congress regarding how to help the 20
108108 United States remain the preeminent destination 21
109109 throughout the world for investment in manufac-22
110110 turing, which shall be based on the execution of the 23
111111 duties of the Advisory Council. 24

115115 (d) DUTIES.—The duties of the Advisory Council 1
116116 shall include the following: 2
117117 (1) Meeting not less frequently than once every 3
118118 180 days, in a manner to be determined by the Sec-4
119119 retary and that is in compliance with chapter 10 of 5
120120 title 5, United States Code, in order to provide inde-6
121121 pendent advice and recommendations to the Sec-7
122122 retary regarding issues involving manufacturing in 8
123123 the United States. 9
124124 (2) Identifying and assessing the impact that 10
125125 technological developments, critical production ca-11
126126 pacity, skill availability, investment patterns, and 12
127127 emerging defense needs have on the manufacturing 13
128128 competitiveness of the United States and providing 14
129129 advice and recommendations to the Secretary re-15
130130 garding that impact. 16
131131 (3) Soliciting input from the public and private 17
132132 sectors and academia relating to emerging trends in 18
133133 manufacturing, and the responsiveness of Federal 19
134134 programming with respect to manufacturing, and 20
135135 providing advice and recommendations to the Sec-21
136136 retary for areas of increased Federal attention with 22
137137 respect to manufacturing. 23
138138 (4) Identifying, and providing advice and rec-24
139139 ommendations to the Secretary regarding, global 25

148148 (5) Providing advice and recommendations to 6
149149 the Secretary on matters relating to investment in, 7
150150 and support of, the manufacturing workforce in the 8
151151 United States, including on matters such as— 9
152152 (A) worker participation in planning for 10
153153 the deployment of new technologies across the 11
154154 manufacturing sector in the United States and 12
155155 within workplaces in that sector; 13
156156 (B) training and education priorities for 14
157157 the Federal Government and employers to as-15
158158 sist workers in adapting the skills and experi-16
159159 ences of those workers to fit the demands of the 17
160160 manufacturing sector in the United States in 18
161161 the 21st century; 19
162162 (C) how the development of new tech-20
163163 nologies and processes have impacted, and will 21
164164 impact, the manufacturing workforce of the 22
165165 United States and the economy of the United 23
166166 States, which shall be based on input from 24
167167 manufacturing workers; 25

177177 rural areas; and 7
178178 (E) how to improve access to demand-driv-8
179179 en manufacturing-related education, training, 9
180180 and re-training for workers, including at com-10
181181 munity and technical colleges, through other in-11
182182 stitutions of higher education and through ap-12
183183 prenticeships and work-based learning opportu-13
184184 nities. 14
185185 (6) Providing recommendations to the Secretary 15
186186 on ways to— 16
187187 (A) provide— 17
188188 (i) manufacturing-related worker edu-18
189189 cation, training, and development; and 19
190190 (ii) entrepreneurship training relating 20
191191 to manufacturing; 21
192192 (B) connect individuals and businesses 22
193193 with services described in subparagraph (A) 23
194194 that are offered in the communities of those in-24
195195 dividuals or businesses; 25

204204 higher education, State or local workforce devel-6
205205 opment boards established under section 101 or 7
206206 107 of the Workforce Innovation and Oppor-8
207207 tunity Act (29 U.S.C. 3111, 3122), labor orga-9
208208 nizations, and nonprofit job training providers 10
209209 to develop and support training and job place-11
210210 ment services, and apprenticeship and online 12
211211 learning platforms, for new and incumbent 13
212212 manufacturing workers; 14
213213 (E) integrate new technologies and proc-15
214214 esses into the manufacturing sector in the 16
215215 United States and address the workforce im-17
216216 pacts of those new technologies and processes; 18
217217 and 19
218218 (F) develop best practices for manufactur-20
219219 ers to incorporate, or transition to, employee 21
220220 ownership structures. 22
221221 (7) With respect to the matters described in 23
222222 paragraphs (1) through (6), soliciting input from— 24
223223 (A) economically distressed areas; 25

228228 United States, including both urban and rural 2
229229 areas; and 3
230230 (C) areas of the United States that have 4
231231 suffered mass layoffs in the manufacturing sec-5
232232 tor. 6
233233 (8) Identifying Federal, State, or other regula-7
234234 tions that may have caused, or will cause, unneces-8
235235 sary supply chain disruptions, impaired business op-9
236236 erations, increased prices, or other costly burdens 10
237237 for consumers and the manufacturing sector in the 11
238238 United States and recommending to the Secretary 12
239239 steps to— 13
240240 (A) mitigate those consequences; and 14
241241 (B) foster an environment in the United 15
242242 States that is favorable to manufacturers, man-16
243243 ufacturing workers, and consumers. 17
244244 (9) Completing other specific tasks requested by 18
245245 the Secretary. 19

247247 EMBERSHIP.— 20
248248 (1) I
249249 N GENERAL.—The Advisory Council 21
250250 shall— 22
251251 (A) consist of not more than 30 individuals 23
252252 appointed by the Secretary with a balance of 24
253253 backgrounds, experiences, and viewpoints; and 25

259259 (i) private industry, including small 3
260260 and medium-sized manufacturers and any 4
261261 relevant standards development organiza-5
262262 tions or relevant trade associations; 6
263263 (ii) academia; and 7
264264 (iii) labor. 8

266266 UBLIC PARTICIPATION .—The Secretary 9
267267 shall, to the maximum extent practicable, accept rec-10
268268 ommendations from the public regarding the ap-11
269269 pointment of individuals under paragraph (1). 12

271271 ERIOD OF APPOINTMENT ; VACANCIES.— 13
272272 (A) I
273273 N GENERAL.—Each member of the 14
274274 Advisory Council shall be appointed by the Sec-15
275275 retary for a term of 3 years. 16

277277 ENEWAL.—The Secretary may renew 17
278278 an appointment made under subparagraph (A) 18
279279 for not more than 2 additional terms. 19

281281 TAGGER TERMS.—The Secretary may 20
282282 stagger the terms of the members of the Advi-21
283283 sory Council to ensure that the terms of those 22
284284 members expire during different years. 23

291291 (ii), a member appointed to fill a vacancy 2
292292 on the Advisory Council occurring before 3
293293 the expiration of the term for which the 4
294294 predecessor of the newly appointed member 5
295295 was appointed shall be appointed only for 6
296296 the remainder of that term of the prede-7
297297 cessor. 8

299299 URTHER SERVICE.—A member 9
300300 of the Advisory Council who is appointed 10
301301 for the remainder of a term of a prede-11
302302 cessor under clause (i) may serve after the 12
303303 expiration of that term of the predecessor 13
304304 and until the date on which the Secretary 14
305305 has appointed a successor. 15

307307 RANSFER OFFUNCTIONS.— 16

309309 N GENERAL.—All functions of the United 17
310310 States Manufacturing Council of the International 18
311311 Trade Administration of the Department of Com-19
312312 merce, as in existence on the day before the date of 20
313313 enactment of this Act, shall be transferred to the 21
314314 Advisory Council. 22

316316 EEMING OF NAME.—Any reference in any 23
317317 law, regulation, document, paper, or other record of 24
318318 the United States to the United States Manufac-25

323323 tration of the Department of Commerce shall be 2
324324 deemed a reference to the Advisory Council. 3

326326 XISTING ADVISORY COMMITTEE .—Any 4
327327 Federal advisory committee of the Department of 5
328328 Commerce that is operating on the day before the 6
329329 date of enactment of this Act under a charter filed 7
330330 in accordance with section 1008(c) of title 5, United 8
331331 States Code, for the purpose of addressing the pur-9
332332 poses and duties described in this section shall sat-10
333333 isfy the requirement under subsection (b) to estab-11
334334 lish the Advisory Council if, not later than 180 days 12
335335 after that date of enactment, the Federal advisory 13
336336 committee is modified, as necessary, to comply with 14
337337 the requirements of this section. 15

339339 ATIONALSTRATEGICPLAN.—Not later than 16
340340 180 days after the date on which the Advisory Council 17
341341 holds the initial meeting of the Advisory Council, and an-18
342342 nually thereafter, the Advisory Council shall submit to the 19
343343 Secretary and the appropriate committees of Congress— 20
344344 (1) a national strategic plan for manufacturing 21
345345 in the United States that is based on the execution 22
346346 of the duties of the Advisory Council under sub-23
347347 section (d); and 24

353353 ties of the Advisory Council under subsection (d). 3

355355 EPARTMENTAL SUPPORT.—In accordance with 4
356356 prevailing laws and regulations, the Secretary, as the Sec-5
357357 retary considers appropriate, shall furnish to the Advisory 6
358358 Council relevant information that— 7
359359 (1) is in the possession of the Department of 8
360360 Commerce; and 9
361361 (2) relates to the mission of the Advisory Coun-10
362362 cil. 11
363363 (i) N
364364 OADDITIONALFUNDSAUTHORIZED.—No addi-12
365365 tional funds are authorized to be appropriated to carry 13
366366 out this section. 14

368368 UNSET.—The Advisory Council shall terminate 15
369369 on September 30 of the fifth year after the year in which 16
370370 the Advisory Council holds the first meeting of the Advi-17
371371 sory Council. 18
