20	20	To amend the Animal Health Protection Act to provide com-
21	21	pensation for poultry growers and layers in control areas,
22	22	and for other purposes.
23	23	Be it enacted by the Senate and House of Representa-1
24	24	tives of the United States of America in Congress assembled, 2
25	25	SECTION 1. SHORT TITLE. 3
26	26	This Act may be cited as the ‘‘Healthy Poultry As-4
27	27	sistance and Indemnification Act of 2025’’. 5

32	32	ERS IN CONTROL AREAS. 2
33	33	Section 10407 of the Animal Health Protection Act 3
34	34	(7 U.S.C. 8306) is amended— 4
35	35	(1) in subsection (d), in the subsection heading, 5
36	36	by inserting ‘‘
37	37	FORDESTROYEDANIMALS’’ after 6
38	38	‘‘C
39	39	OMPENSATION’’; and 7
40	40	(2) by adding at the end the following: 8
41	41	‘‘(e) C
42	42	OMPENSATION FOR POULTRYGROWERS AND 9
43	43	L
44	44	AYERS INCONTROLAREAS.— 10
45	45	‘‘(1) D
46	46	EFINITION OF CONTROL AREA .—In this 11
47	47	subsection, the term ‘control area’ means a Control 12
48	48	Area determined by the Administrator of the Animal 13
49	49	and Plant Health Inspection Service. 14
50	50	‘‘(2) C
51	51	OMPENSATION.— 15
52	52	‘‘(A) I
53	53	N GENERAL.—Except as provided in 16
54	54	paragraph (3), the Secretary shall compensate 17
55	55	the owner of a poultry growing or laying facility 18
56	56	that is located within a control area. 19
57	57	‘‘(B) A
58	58	MOUNT.— 20
59	59	‘‘(i) I
60	60	N GENERAL .—Compensation 21
61	61	paid under subparagraph (A) shall be in 22
62	62	an amount that is equal to the product ob-23
63	63	tained by multiplying— 24
64	64	‘‘(I) the average income from the 25
65	65	5 most recent flocks of birds that the 26

69	69	poultry growing or laying facility grew 1
70	70	or laid; and 2
71	71	‘‘(II) the number of flocks of 3
72	72	birds that the owner of the poultry 4
73	73	growing or laying facility was prohib-5
74	74	ited from growing or laying during the 6
75	75	period of time in which the control 7
76	76	area was in effect. 8
77	77	‘‘(ii) L
78	78	IMITATION.—Compensation 9
79	79	paid any owner of a poultry growing or 10
80	80	laying facility under this subsection shall 11
81	81	not exceed the difference between— 12
82	82	‘‘(I) the amount described in 13
83	83	clause (i); and 14
84	84	‘‘(II) any compensation received 15
85	85	by the owner from a State or other 16
86	86	source for the 1 or more flocks of 17
87	87	birds that the owner was prohibited 18
88	88	from growing or laying. 19
89	89	‘‘(C) T
90	90	IMING.—Compensation shall be paid 20
91	91	under subparagraph (A) not later than 60 days 21
92	92	after the date on which the owner of a poultry 22
93	93	growing or laying facility submits a request to 23
94	94	the Secretary for compensation. 24

96	96	XCEPTIONS.— 25

100	100	‘‘(A) IN GENERAL.—The exceptions de-1
101	101	scribed in subsection (d)(3) shall apply to this 2
102	102	subsection. 3

104	104	OMPENSATION FOR DESTROYED 4
105	105	ANIMALS.—No payment shall be made by the 5
106	106	Secretary under this subsection to an owner of 6
107	107	a poultry growing or laying facility who has re-7
108	108	ceived compensation under subsection (d) for a 8
109	109	facility in the same control area during the 9
110	110	same period of time.’’. 10
