COMPENSATION FOR POULTRY GROWERS AND LAY-1 ERS IN CONTROL AREAS. 2 Section 10407 of the Animal Health Protection Act 3 (7 U.S.C. 8306) is amended— 4 (1) in subsection (d), in the subsection heading, 5 by inserting ‘‘ FORDESTROYEDANIMALS’’ after 6 ‘‘C OMPENSATION’’; and 7 (2) by adding at the end the following: 8 ‘‘(e) C OMPENSATION FOR POULTRYGROWERS AND 9 L AYERS INCONTROLAREAS.— 10 ‘‘(1) D EFINITION OF CONTROL AREA .—In this 11 subsection, the term ‘control area’ means a Control 12 Area determined by the Administrator of the Animal 13 and Plant Health Inspection Service. 14 ‘‘(2) C OMPENSATION.— 15 ‘‘(A) I N GENERAL.—Except as provided in 16 paragraph (3), the Secretary shall compensate 17 the owner of a poultry growing or laying facility 18 that is located within a control area. 19 ‘‘(B) A MOUNT.— 20 ‘‘(i) I N GENERAL .—Compensation 21 paid under subparagraph (A) shall be in 22 an amount that is equal to the product ob-23 tained by multiplying— 24 ‘‘(I) the average income from the 25 5 most recent flocks of birds that the 26 VerDate Sep 11 2014 00:26 Mar 08, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S574.IS S574 ssavage on LAPJG3WLY3PROD with BILLS 3 •S 574 IS poultry growing or laying facility grew 1 or laid; and 2 ‘‘(II) the number of flocks of 3 birds that the owner of the poultry 4 growing or laying facility was prohib-5 ited from growing or laying during the 6 period of time in which the control 7 area was in effect. 8 ‘‘(ii) L IMITATION.—Compensation 9 paid any owner of a poultry growing or 10 laying facility under this subsection shall 11 not exceed the difference between— 12 ‘‘(I) the amount described in 13 clause (i); and 14 ‘‘(II) any compensation received 15 by the owner from a State or other 16 source for the 1 or more flocks of 17 birds that the owner was prohibited 18 from growing or laying. 19 ‘‘(C) T IMING.—Compensation shall be paid 20 under subparagraph (A) not later than 60 days 21 after the date on which the owner of a poultry 22 growing or laying facility submits a request to 23 the Secretary for compensation. 24 ‘‘(3) E XCEPTIONS.— 25 VerDate Sep 11 2014 00:26 Mar 08, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S574.IS S574 ssavage on LAPJG3WLY3PROD with BILLS 4 •S 574 IS ‘‘(A) IN GENERAL.—The exceptions de-1 scribed in subsection (d)(3) shall apply to this 2 subsection. 3 ‘‘(B) C OMPENSATION FOR DESTROYED 4 ANIMALS.—No payment shall be made by the 5 Secretary under this subsection to an owner of 6 a poultry growing or laying facility who has re-7 ceived compensation under subsection (d) for a 8 facility in the same control area during the 9 same period of time.’’. 10 Æ VerDate Sep 11 2014 00:26 Mar 08, 2025 Jkt 059200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\S574.IS S574 ssavage on LAPJG3WLY3PROD with BILLS
