3131 PPOINTMENT.—The head of the Office of 3

105105 duty of the Inspector General to conduct, supervise, 11
106106 and coordinate audits and investigations of the 12
107107 treatment, handling, and expenditure of amounts ap-13
108108 propriated or otherwise made available for the mili-14
109109 tary and nonmilitary support of Ukraine, and of the 15
110110 programs, operations, and contracts carried out uti-16
111111 lizing such funds, including— 17
112112 (A) the oversight and accounting of the ob-18
113113 ligation and expenditure of such funds; 19
114114 (B) the monitoring and review of contracts 20
115115 funded by such funds; 21
116116 (C) the monitoring and review of the 22
117117 transfer of such funds and associated informa-23
118118 tion between and among departments, agencies, 24

250250 ESOURCES.—The Secretary of State or the 5
251251 Secretary of Defense, as appropriate, shall provide 6
252252 the Inspector General with— 7
253253 (A) appropriate and adequate office space 8
254254 at appropriate locations of the Department of 9
255255 State or the Department of Defense, as the 10
256256 case may be, in Ukraine or at an appropriate 11
257257 United States military installation in the Euro-12
258258 pean theater, together with such equipment, of-13
259259 fice supplies, and communications facilities and 14
260260 services as may be necessary for the operation 15
261261 of such offices, and shall provide necessary 16
262262 maintenance services for such offices and the 17
263263 equipment and facilities located therein; and 18
264264 (B) appropriate and adequate support for 19
265265 audits, investigations, and related activities by 20
266266 the Inspector General or assigned personnel 21
267267 within the territory of Ukraine. 22

285285 quested by the Inspector General is, in the 9
286286 judgment of the Inspector General, unreason-10

288288 eral shall report the circumstances to the Sec-12
289289 retary of State or the Secretary of Defense, as 13
290290 appropriate, and to the appropriate congres-14

296296 days after the end of each fiscal-year quarter, the 18
297297 Inspector General shall submit to the appropriate 19

300300 sible, the period from the end of such quarter to the 22
301301 time of the submission of the report, the activities 23
302302 during such period of the Inspector General and the 24
303303 activities under programs and operations funded 25

312312 with military and nonmilitary support of Ukraine, 6
313313 including the following: 7
314314 (A) Obligations and expenditures of appro-8
315315 priated funds. 9
316316 (B) Operating expenses of agencies or enti-10
317317 ties receiving amounts appropriated or other-11
318318 wise made available for the military and non-12
319319 military support of Ukraine. 13
320320 (C) In the case of any contract, grant, 14
321321 agreement, or other funding mechanism de-15
322322 scribed in paragraph (2)— 16
323323 (i) the amount of the contract, grant, 17
324324 agreement, or other funding mechanism; 18
325325 (ii) a brief discussion of the scope of 19
326326 the contract, grant, agreement, or other 20
327327 funding mechanism; 21
328328 (iii) a discussion of how the depart-22
329329 ment or agency of the United States Gov-23
330330 ernment involved in the contract, grant, 24
331331 agreement, or other funding mechanism 25

347347 (i) the military and nonmilitary sup-13
348348 port provided to Ukraine by the United 14
349349 States; and 15
350350 (ii) the military and nonmilitary sup-16
351351 port provided to Ukraine by other North 17
352352 Atlantic Treaty Organization member 18
353353 countries, including allied contributions to 19
354354 Ukraine that are subsequently backfilled or 20
355355 subsidized using United States funds. 21
356356 (E) An evaluation of the compliance of the 22
357357 Government of Ukraine with all requirements 23
358358 for receiving United States funds, including a 24
359359 description of any area of concern with respect 25

367367 MENTS, AND FUNDING MECHANISMS .—A contract, 4
368368 grant, agreement, or other funding mechanism de-5
369369 scribed in this paragraph is any major contract, 6
370370 grant, agreement, or other funding mechanism that 7
371371 is entered into by any department or agency of the 8
372372 United States Government that involves the use of 9
373373 amounts appropriated or otherwise made available 10
374374 for the military and nonmilitary support of Ukraine 11
375375 with any public or private sector entity for any of 12
376376 the following purposes: 13
377377 (A) To build or rebuild physical infrastruc-14
378378 ture of Ukraine. 15
379379 (B) To establish or reestablish a political 16
380380 or societal institution of Ukraine. 17
381381 (C) To provide products or services to the 18
382382 people of Ukraine. 19
383383 (D) To provide lethal or nonlethal weap-20
384384 onry to Ukraine. 21
385385 (E) To otherwise provide military or non-22
386386 military support to Ukraine. 23

388388 UBLIC AVAILABILITY .—The Inspector 24
389389 General shall publish on a publicly available internet 25

404404 subsection shall be construed to authorize the public 10
405405 disclosure of information that is— 11
406406 (A) specifically prohibited from disclosure 12
407407 by any other provision of law; 13
408408 (B) specifically required by Executive order 14
409409 to be protected from disclosure in the interest 15
410410 of national defense or national security or in 16
411411 the conduct of foreign affairs; or 17
412412 (C) a part of an ongoing criminal inves-18
413413 tigation. 19

474474 publish a notice of each waiver made under this sub-14
475475 section in the Federal Register no later than the 15
476476 date on which a report required under subsection 16
477477 (h), or any comment under subsection (i)(2)(A), is 17
478478 submitted to the appropriate congressional commit-18
479479 tees. The report and comments shall specify whether 19
480480 waivers under this subsection were made and with 20
481481 respect to which elements in the report or which 21
482482 comments, as appropriate. 22
