Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Inspector General for 4
Ukraine Act’’. 5
SEC. 2. INSPECTOR GENERAL FOR UKRAINE. 6
(a) O
FFICE OFINSPECTORGENERAL.—There is 7
hereby established the Office of the Inspector General for 8
Ukraine. 9

(b) APPOINTMENT OF INSPECTORGENERAL; RE-1
MOVAL.— 2
(1) A
PPOINTMENT.—The head of the Office of 3
the Inspector General for Ukraine is the Inspector 4
General for Ukraine (in this section referred to as 5
the ‘‘Inspector General’’), who shall be appointed by 6
the President with the advice and consent of the 7
Senate. 8
(2) Q
UALIFICATIONS.—The appointment of the 9
Inspector General shall be made solely on the basis 10
of integrity and demonstrated ability in accounting, 11
auditing, financial analysis, law, management anal-12
ysis, public administration, or investigations. 13
(3) D
EADLINE FOR APPOINTMENT .—The ap-14
pointment of an individual as Inspector General 15
shall be made not later than 30 days after the date 16
of the enactment of this Act. 17
(4) C
OMPENSATION.—The annual rate of basic 18
pay of the Inspector General shall be the annual rate 19
of basic pay provided for positions at level IV of the 20
Executive Schedule under section 5315 of title 5, 21
United States Code. 22
(5) P
ROHIBITION ON POLITICAL ACTIVITIES .— 23
For purposes of section 7324 of title 5, United 24
States Code, the Inspector General shall not be con-25

sidered an employee who determines policies to be 1
pursued by the United States in the nationwide ad-2
ministration of Federal law. 3
(c) A
SSISTANTINSPECTORSGENERAL.—The Inspec-4
tor General shall, in accordance with applicable laws and 5
regulations governing the civil service— 6
(1) appoint an Assistant Inspector General for 7
Auditing who shall have the responsibility for super-8
vising the performance of auditing activities relating 9
to programs and operations supported by amounts 10
appropriated or otherwise made available for the 11
military and nonmilitary support of Ukraine; and 12
(2) appoint an Assistant Inspector General for 13
Investigations who shall have the responsibility for 14
supervising the performance of investigative activi-15
ties relating to such programs and operations. 16
(d) S
UPERVISION.— 17
(1) I
N GENERAL.—Except as provided in para-18
graph (2), the Inspector General shall report directly 19
to, and be under the general supervision of, the Sec-20
retary of State and the Secretary of Defense. 21
(2) I
NDEPENDENCE TO CONDUCT INVESTIGA -22
TIONS AND AUDITS.—No officer of the Department 23
of Defense, the Department of State, or the United 24
States Agency for International Development shall 25

prevent or prohibit the Inspector General from initi-1
ating, carrying out, or completing any audit or in-2
vestigation related to amounts appropriated or oth-3
erwise made available for the military and non-4
military support of Ukraine or from issuing any sub-5
poena during the course of any such audit or inves-6
tigation. 7
(e) D
UTIES.— 8
(1) O
VERSIGHT OF MILITARY AND NON -9
MILITARY SUPPORT OF UKRAINE .—It shall be the 10
duty of the Inspector General to conduct, supervise, 11
and coordinate audits and investigations of the 12
treatment, handling, and expenditure of amounts ap-13
propriated or otherwise made available for the mili-14
tary and nonmilitary support of Ukraine, and of the 15
programs, operations, and contracts carried out uti-16
lizing such funds, including— 17
(A) the oversight and accounting of the ob-18
ligation and expenditure of such funds; 19
(B) the monitoring and review of contracts 20
funded by such funds; 21
(C) the monitoring and review of the 22
transfer of such funds and associated informa-23
tion between and among departments, agencies, 24

and entities of the United States and private 1
and nongovernmental entities; 2
(D) the maintenance of records on the use 3
of such funds to facilitate future audits and in-4
vestigations of the use of such funds; 5
(E) the investigation of overpayments such 6
as duplicate payments or duplicate billing and 7
any potential unethical or illegal actions of Fed-8
eral employees, contractors, or affiliated entities 9
and the referral of such reports, as necessary, 10
to the Department of Justice to ensure further 11
investigations, prosecutions, recovery of further 12
funds, or other remedies; 13
(F) the monitoring and review of all mili-14
tary and nonmilitary activities funded by such 15
funds; and 16
(G) the tracking and monitoring of all le-17
thal and nonlethal security assistance provided 18
by the United States, including a review of 19
compliance with all applicable end-use certifi-20
cation requirements. 21
(2) O
THER DUTIES RELATED TO OVERSIGHT .— 22
The Inspector General shall establish, maintain, and 23
oversee such systems, procedures, and controls as 24

the Inspector General considers appropriate to dis-1
charge the duties under paragraph (1). 2
(3) D
UTIES AND RESPONSIBILITIES UNDER 3
CHAPTER 4 OF TITLE 5, UNITED STATES CODE .—In 4
addition to the duties specified in paragraphs (1) 5
and (2), the Inspector General shall also have the 6
duties and responsibilities of inspectors general 7
under chapter 4 of title 5, United States Code. 8
(4) C
OORDINATION OF EFFORTS .—In carrying 9
out the duties, responsibilities, and authorities of the 10
Inspector General under this section, the Inspector 11
General shall coordinate with, and receive the co-12
operation of each of the following: 13
(A) The Inspector General of the Depart-14
ment of Defense. 15
(B) The Inspector General of the Depart-16
ment of State. 17
(C) The Inspector General of the United 18
States Agency for International Development. 19

(1) A
UTHORITIES UNDER CHAPTER 4 OF TITLE 21
5, UNITED STATES CODE .—In carrying out the du-22
ties specified in subsection (e), the Inspector General 23
shall have the authorities provided in section 406 of 24

title 5, United States Code, including the authorities 1
under subsection (e) of such section. 2
(2) A
UDIT STANDARDS.—The Inspector General 3
shall carry out the duties specified in subsection 4
(d)(1) in accordance with section 404(b)(1) of title 5
5, United States Code. 6
(g) P
ERSONNEL, FACILITIES, ANDOTHERRE-7
SOURCES.— 8
(1) P
ERSONNEL.— 9
(A) I
N GENERAL.—The Inspector General 10
may select, appoint, and employ such officers 11
and employees as may be necessary for carrying 12
out the duties of the Inspector General, subject 13
to the provisions of title 5, United States Code, 14
governing appointments in the competitive serv-15
ice, and the provisions of chapter 51 and sub-16
chapter III of chapter 53 of such title, relating 17
to classification and General Schedule pay 18
rates. 19
(B) A
DDITIONAL AUTHORITIES .— 20
(i) I
N GENERAL.—Subject to clause 21
(ii), the Inspector General may exercise the 22
authorities of subsections (b) through (i) of 23
section 3161 of title 5, United States Code 24

(without regard to subsection (a) of that 1
section). 2
(ii) P
ERIODS OF APPOINTMENTS .—In 3
exercising the employment authorities 4
under subsection (b) of section 3161 of 5
title 5, United States Code, as provided 6
under clause (i) of this subparagraph— 7
(I) paragraph (2) of that sub-8
section (relating to periods of appoint-9
ments) shall not apply; and 10
(II) no period of appointment 11
may exceed the date on which the Of-12
fice of the Inspector General for 13
Ukraine terminates under subsection 14
(n). 15
(2) E
MPLOYMENT OF EXPERTS AND CONSULT -16
ANTS.—The Inspector General may obtain services 17
as authorized by section 3109 of title 5, United 18
States Code, at daily rates not to exceed the equiva-19
lent rate prescribed for grade GS–15 of the General 20
Schedule by section 5332 of such title. 21
(3) C
ONTRACTING AUTHORITY .—To the extent 22
and in such amounts as may be provided in advance 23
by appropriations Acts, the Inspector General may 24
enter into contracts and other arrangements for au-25

dits, studies, analyses, and other services with public 1
agencies and with private persons, and make such 2
payments as may be necessary to carry out the du-3
ties of the Inspector General. 4
(4) R
ESOURCES.—The Secretary of State or the 5
Secretary of Defense, as appropriate, shall provide 6
the Inspector General with— 7
(A) appropriate and adequate office space 8
at appropriate locations of the Department of 9
State or the Department of Defense, as the 10
case may be, in Ukraine or at an appropriate 11
United States military installation in the Euro-12
pean theater, together with such equipment, of-13
fice supplies, and communications facilities and 14
services as may be necessary for the operation 15
of such offices, and shall provide necessary 16
maintenance services for such offices and the 17
equipment and facilities located therein; and 18
(B) appropriate and adequate support for 19
audits, investigations, and related activities by 20
the Inspector General or assigned personnel 21
within the territory of Ukraine. 22
(5) A
SSISTANCE FROM FEDERAL AGENCIES .— 23
(A) I
N GENERAL.—Upon request of the In-24
spector General for information or assistance 25

from any department, agency, or other entity of 1
the Federal Government, the head of such enti-2
ty shall, insofar as is practicable and not in 3
contravention of any existing law, furnish such 4
information or assistance to the Inspector Gen-5
eral, or an authorized designee. 6
(B) R
EPORTING OF REFUSED ASSIST -7
ANCE.—Whenever information or assistance re-8
quested by the Inspector General is, in the 9
judgment of the Inspector General, unreason-10
ably refused or not provided, the Inspector Gen-11
eral shall report the circumstances to the Sec-12
retary of State or the Secretary of Defense, as 13
appropriate, and to the appropriate congres-14
sional committees without delay. 15
(h) R
EPORTS.— 16
(1) Q
UARTERLY REPORTS .—Not later than 30 17
days after the end of each fiscal-year quarter, the 18
Inspector General shall submit to the appropriate 19
congressional committees a report summarizing, for 20
the period of that quarter and, to the extent pos-21
sible, the period from the end of such quarter to the 22
time of the submission of the report, the activities 23
during such period of the Inspector General and the 24
activities under programs and operations funded 25

with amounts appropriated or otherwise made avail-1
able for the military and nonmilitary support of 2
Ukraine. Each report shall include, for the period 3
covered by such report, a detailed statement of all 4
obligations, expenditures, and revenues associated 5
with military and nonmilitary support of Ukraine, 6
including the following: 7
(A) Obligations and expenditures of appro-8
priated funds. 9
(B) Operating expenses of agencies or enti-10
ties receiving amounts appropriated or other-11
wise made available for the military and non-12
military support of Ukraine. 13
(C) In the case of any contract, grant, 14
agreement, or other funding mechanism de-15
scribed in paragraph (2)— 16
(i) the amount of the contract, grant, 17
agreement, or other funding mechanism; 18
(ii) a brief discussion of the scope of 19
the contract, grant, agreement, or other 20
funding mechanism; 21
(iii) a discussion of how the depart-22
ment or agency of the United States Gov-23
ernment involved in the contract, grant, 24
agreement, or other funding mechanism 25

identified, and solicited offers from, poten-1
tial individuals or entities to perform the 2
contract, grant, agreement, or other fund-3
ing mechanism, together with a list of the 4
potential individuals or entities that were 5
issued solicitations for the offers; and 6
(iv) the justification and approval doc-7
uments on which was based the determina-8
tion to use procedures other than proce-9
dures that provide for full and open com-10
petition. 11
(D) An accounting comparison of— 12
(i) the military and nonmilitary sup-13
port provided to Ukraine by the United 14
States; and 15
(ii) the military and nonmilitary sup-16
port provided to Ukraine by other North 17
Atlantic Treaty Organization member 18
countries, including allied contributions to 19
Ukraine that are subsequently backfilled or 20
subsidized using United States funds. 21
(E) An evaluation of the compliance of the 22
Government of Ukraine with all requirements 23
for receiving United States funds, including a 24
description of any area of concern with respect 25

to the ability of the Government of Ukraine to 1
achieve such compliance. 2
(2) C
OVERED CONTRACTS , GRANTS, AGREE-3
MENTS, AND FUNDING MECHANISMS .—A contract, 4
grant, agreement, or other funding mechanism de-5
scribed in this paragraph is any major contract, 6
grant, agreement, or other funding mechanism that 7
is entered into by any department or agency of the 8
United States Government that involves the use of 9
amounts appropriated or otherwise made available 10
for the military and nonmilitary support of Ukraine 11
with any public or private sector entity for any of 12
the following purposes: 13
(A) To build or rebuild physical infrastruc-14
ture of Ukraine. 15
(B) To establish or reestablish a political 16
or societal institution of Ukraine. 17
(C) To provide products or services to the 18
people of Ukraine. 19
(D) To provide lethal or nonlethal weap-20
onry to Ukraine. 21
(E) To otherwise provide military or non-22
military support to Ukraine. 23
(3) P
UBLIC AVAILABILITY .—The Inspector 24
General shall publish on a publicly available internet 25

website each report under paragraph (1) of this sub-1
section in English and other languages that the In-2
spector General determines are widely used and un-3
derstood in Ukraine. 4
(4) F
ORM.—Each report required under this 5
subsection shall be submitted in unclassified form, 6
but may include a classified annex if the Inspector 7
General considers it necessary. 8
(5) R
ULE OF CONSTRUCTION .—Nothing in this 9
subsection shall be construed to authorize the public 10
disclosure of information that is— 11
(A) specifically prohibited from disclosure 12
by any other provision of law; 13
(B) specifically required by Executive order 14
to be protected from disclosure in the interest 15
of national defense or national security or in 16
the conduct of foreign affairs; or 17
(C) a part of an ongoing criminal inves-18
tigation. 19

EPORTCOORDINATION.— 20
(1) S
UBMISSION TO SECRETARIES OF STATE 21
AND DEFENSE.—The Inspector General shall also 22
submit each report required under subsection (h) to 23
the Secretary of State and the Secretary of Defense. 24
(2) S
UBMISSION TO CONGRESS .— 25

(A) IN GENERAL.—Not later than 30 days 1
after receipt of a report under paragraph (1), 2
the Secretary of State and the Secretary of De-3
fense shall submit to the appropriate congres-4
sional committees any comments on the matters 5
covered by the report. Such comments shall be 6
submitted in unclassified form, but may include 7
a classified annex if the Secretary of State or 8
the Secretary of Defense, as the case may be, 9
considers it necessary. 10
(B) A
CCESS.—On request, any Member of 11
Congress may view comments submitted under 12
subparagraph (A), including the classified 13
annex. 14
(j) T
RANSPARENCY.— 15
(1) R
EPORT.—Not later than 60 days after 16
submission to the appropriate congressional commit-17
tees of a report under subsection (h), the Secretary 18
of State and the Secretary of Defense shall jointly 19
make copies of the report available to the public 20
upon request, and at a reasonable cost. 21
(2) C
OMMENTS ON MATTERS COVERED BY RE -22
PORT.—Not later than 60 days after submission to 23
the appropriate congressional committees under sub-24
section (i)(2)(A) of comments on a report under sub-25

section (h), the Secretary of State and the Secretary 1
of Defense shall jointly make copies of the comments 2
available to the public upon request, and at a rea-3
sonable cost. 4
(k) W
AIVER.— 5
(1) A
UTHORITY.—The President may waive the 6
requirement under paragraph (1) or (2) of sub-7
section (j) with respect to availability to the public 8
of any element in a report under subsection (h), or 9
any comment under subsection (i)(2)(A), if the 10
President determines that the waiver is justified for 11
national security reasons. 12
(2) N
OTICE OF WAIVER.—The President shall 13
publish a notice of each waiver made under this sub-14
section in the Federal Register no later than the 15
date on which a report required under subsection 16
(h), or any comment under subsection (i)(2)(A), is 17
submitted to the appropriate congressional commit-18
tees. The report and comments shall specify whether 19
waivers under this subsection were made and with 20
respect to which elements in the report or which 21
comments, as appropriate. 22
(3) S
UBMISSION OF COMMENTS .—The Presi-23
dent may not waive under this subsection subpara-24
graph (A) or (B) of subsection (i)(2). 25

(l) DEFINITIONS.—In this section: 1
(1) A
MOUNTS APPROPRIATED OR OTHERWISE 2
MADE AVAILABLE FOR THE MILITARY AND NON -3
MILITARY SUPPORT OF UKRAINE .—The term 4
‘‘amounts appropriated or otherwise made available 5
for the military and nonmilitary support of Ukraine’’ 6
means— 7
(A) amounts appropriated or otherwise 8
made available on or after January 1, 2022, 9
for— 10
(i) the Ukraine Security Assistance 11
Initiative under section 1250 of the Na-12
tional Defense Authorization Act for Fiscal 13
Year 2016 (Public Law 11492; 129 Stat. 14
1608); 15
(ii) any foreign military financing 16
accessed by the Government of Ukraine; 17
(iii) the Presidential drawdown au-18
thority under section 506(a) of the Foreign 19
Assistance Act of 1961 (22 U.S.C. 20
2318(a)); 21
(iv) the defense institution building 22
program under section 332 of title 10, 23
United States Code; 24

(v) the building partner capacity pro-1
gram under section 333 of title 10, United 2
States Code; 3
(vi) the International Military Edu-4
cation and Training program of the De-5
partment of State; and 6
(vii) the United States European 7
Command; and 8
(B) amounts appropriated or otherwise 9
made available on or after January 1, 2022, for 10
the military, economic, reconstruction, or hu-11
manitarian support of Ukraine under any ac-12
count or for any purpose not described in sub-13
paragraph (A). 14
(2) A
PPROPRIATE CONGRESSIONAL COMMIT -15
TEES.—The term ‘‘appropriate congressional com-16
mittees’’ means— 17
(A) the Committees on Appropriations, the 18
Committee on Armed Services, the Committee 19
on Foreign Relations, and Committee on Home-20
land Security and Governmental Affairs of the 21
Senate; and 22
(B) the Committees on Appropriations, the 23
Committee on Armed Services, the Committee 24
on Foreign Affairs, and the Committee on 25

(m) A
UTHORIZATION OFAPPROPRIATIONS.— 3
(1) I
N GENERAL.—There is authorized to be 4
appropriated $70,000,000 for fiscal year 2025 to 5
carry out this section. 6
(2) O
FFSET.—The amount authorized to be ap-7
propriated for fiscal year 2025 for the Economic 8
Support Fund for Ukraine under title IV of the 9
Ukraine Security Supplemental Appropriations Act, 10
2024 (Public Law 118–50; 138 Stat. 913) is hereby 11
reduced by $70,000,000. 12
(n) T
ERMINATION.— 13
(1) I
N GENERAL.—The Office of the Inspector 14
General for Ukraine shall terminate on the date that 15
is 5 years after the date of the enactment of this 16
Act. 17
(2) F
INAL REPORT.—The Inspector General 18
shall, prior to the termination of the Office of the 19
Inspector General for Ukraine under paragraph (1), 20
prepare and submit to the appropriate congressional 21
committees a final forensic audit report on programs 22
and operations funded with amounts appropriated or 23
