INCLUSION OF SECRETARY OF AGRICULTURE ON 1 COMMITTEE ON FOREIGN INVESTMENT IN 2 UNITED STATES AND CONSIDERATION OF 3 CERTAIN AGRICULTURAL LAND TRANS-4 ACTIONS. 5 (a) I NCLUSION ON THE COMMITTEE.—Section 6 721(k) of the Defense Production Act of 1950 (50 U.S.C. 7 4565(k)) is amended by adding at the end the following: 8 ‘‘(8) I NCLUSION OF THE SECRETARY OF AGRI -9 CULTURE.—The Secretary of Agriculture shall be a 10 member of the Committee with respect to a covered 11 transaction that involves— 12 ‘‘(A) agricultural land; 13 ‘‘(B) agriculture biotechnology; or 14 ‘‘(C) the agriculture industry, including ag-15 ricultural— 16 ‘‘(i) transportation; 17 ‘‘(ii) storage; and 18 ‘‘(iii) processing.’’. 19 (b) C ONSIDERATION OF CERTAINAGRICULTURAL 20 L ANDTRANSACTIONS.—Section 721(b)(1) of the Defense 21 Production Act of 1950 (50 U.S.C. 4565(b)(1)) is amend-22 ed by adding at the end the following: 23 ‘‘(I) C ONSIDERATION OF CERTAIN AGRI -24 CULTURAL LAND TRANSACTIONS .— 25 VerDate Sep 11 2014 22:24 Mar 13, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S732.IS S732 ssavage on LAPJG3WLY3PROD with BILLS 3 •S 732 IS ‘‘(i) IN GENERAL.—After receiving no-1 tification from the Secretary of Agriculture 2 of a reportable agricultural land trans-3 action, the Committee shall determine— 4 ‘‘(I) whether the transaction is a 5 covered transaction; and 6 ‘‘(II) if the Committee deter-7 mines that the transaction is a cov-8 ered transaction, whether the Com-9 mittee should initiate a review pursu-10 ant to subparagraph (D), or take an-11 other action authorized under this sec-12 tion, with respect to the reportable ag-13 ricultural land transaction. 14 ‘‘(ii) S UNSET.—The requirements 15 under this subparagraph shall terminate, 16 with respect to a foreign person of a cov-17 ered country, on the date on which that 18 country is removed from the list of foreign 19 adversaries set forth in section 791.4 of 20 title 15, Code of Federal Regulations. 21 ‘‘(iii) D EFINITIONS.—In this subpara-22 graph: 23 ‘‘(I) C OVERED COUNTRY .—The 24 term ‘covered country’ means the Peo-25 VerDate Sep 11 2014 22:24 Mar 13, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S732.IS S732 ssavage on LAPJG3WLY3PROD with BILLS 4 •S 732 IS ple’s Republic of China, the Demo-1 cratic People’s Republic of Korea, the 2 Russian Federation, or the Islamic 3 Republic of Iran. 4 ‘‘(II) R EPORTABLE AGRICUL -5 TURAL LAND TRANSACTION .—The 6 term ‘reportable agricultural land 7 transaction’ means a transaction— 8 ‘‘(aa) that the Secretary of 9 Agriculture has reason to believe 10 is a covered transaction; 11 ‘‘(bb) that involves the ac-12 quisition of an interest in agricul-13 tural land by a foreign person of 14 a covered country; and 15 ‘‘(cc) with respect to which a 16 person is required to submit a re-17 port to the Secretary of Agri-18 culture under section 2(a) of the 19 Agricultural Foreign Investment 20 Disclosure Act of 1978 (7 U.S.C. 21 3501(a)).’’. 22 Æ VerDate Sep 11 2014 22:24 Mar 13, 2025 Jkt 059200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\S732.IS S732 ssavage on LAPJG3WLY3PROD with BILLS
