A BILL
To increase the penalty for prohibited provision of a phone
in a correctional facility, and for other purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Lieutenant Osvaldo 4
Albarati Stopping Prison Contraband Act’’. 5
SEC. 2. PROHIBITED PROVISION OF A PHONE. 6
Section 1791(b) of title 18, United States Code, is 7
amended— 8
(1) by redesignating paragraphs (4) and (5) as 9
paragraphs (5) and (6), respectively; 10

(2) by inserting after paragraph (3) the fol-1
lowing: 2
‘‘(4) in the case of a violation of subsection 3
(a)(1), imprisonment for not more than 2 years, or 4
both, if the object is specified in subsection 5
(d)(1)(F) of this section;’’; and 6
(3) in paragraph (5), as so redesignated, by in-7
serting ‘‘, in the case of a violation of subsection 8
(a)(2),’’ before ‘‘(d)(1)(F)’’. 9
SEC. 3. REVIEW OF POLICIES. 10
Not later than 1 year after the date of enactment 11
of this Act, the Director of the Bureau of Prisons shall— 12
(1) conduct a review of the policies of the Bu-13
reau of Prisons pertaining to inmates who make, 14
possess, obtain, or attempt to make or obtain a pro-15
hibited object, as defined in section 1791(d)(1) of 16
title 18, United States Code; and 17
(2) update those policies as needed to improve 18
protections for incarcerated individuals and staff. 19
