3131 NGENERAL.—Section 1201 of title I of the Om-4
3232 nibus Crime Control and Safe Streets Act of 1968 (34 5
3333 U.S.C. 10281) is amended by adding at the end the fol-6
3434 lowing: 7

3838 ‘‘(1) D
3939 EFINITION.—In this subsection, the term 10
4040 ‘retired law enforcement officer’ means an individual 11
4141 who separated from service in good standing as a 12
4242 law enforcement officer in an official capacity at a 13
4343 public agency with or without compensation. 14
4444 ‘‘(2) E
4545 LIGIBILITY.—A retired law enforcement 15
4646 officer shall be eligible for a benefit under this part 16
4747 if the officer died or became permanently and totally 17
4848 disabled as the direct and proximate result of a per-18
4949 sonal injury resulting from a targeted attack be-19
5050 cause of the retired law enforcement officer’s service 20
5151 as a law enforcement officer.’’. 21

5353 ETROACTIVEAPPLICABILITY.— 22
5454 (1) I
5555 N GENERAL.—Except as provided in para-23
5656 graph (2), the amendments made by this section 24

6363 (B) apply to any matter— 3
6464 (i) pending before the Bureau of Jus-4
6565 tice Assistance or otherwise on the date of 5
6666 enactment of this Act; or 6
6767 (ii) filed (consistent with pre-existing 7
6868 effective dates) or accruing after the date 8
6969 of enactment of this Act. 9

7171 XCEPTIONS.—The amendment made by 10
7272 this section shall apply to any action taken against 11
7373 a retired law enforcement officer described in section 12
7474 1201(p) of title I of the Omnibus Crime Control and 13
7575 Safe Streets Act of 1968 (as added by this Act) on 14
7676 or after January 1, 2012. 15
